Comments made during this phase of the subdivision process may not be all-inclusive, as other concerns or issues may arise during the remaining application process. Comments External Roadways: ❑ The Weld County Roadway Classification Plan currently shows CR 27 with a classification as a minor arterial requiring a 110- foot right-of-way. The applicant shall verify the existing right-of-way and the documents creating the right-of-way shall be noted on the change of zone plat. If the right-of-way cannot be verified, it will be dedicated on the plat. ❑ CR 27 serving this development is paved and maintained by the County adjacent to the proposed development. ❑ The latest County traffic count for CR 27 is approximately 3,842 aadt in the vicinity of the proposed change of zone. The applicant must address the traffic in specific detail for this proposal. A traffic impact study may be required to more fully understand the transportation impacts. The number and type of vehicles generated by the use proposed shall be specified. Transportation routes should be addressed with this change of zone application. Acceleration/deceleration lanes may be required by the Department of Public Works Department to provide safe, efficient access to arterial or collector streets. ❑ Since a development is proposed for this change of zone, Public Works needs an understanding of the proposal and potential impacts on surrounding infrastructure. This proposed zone change to an industrial use may possibly contribute significant traffic to the surrounding area. The applicant may be required to participate and contribute to improvements to the surrounding transportation infrastructure.The applicant may be required to submit off-site roadway improvements agreements. ❑ This proposed zone change to an industrial use might possibly contribute considerable traffic to the surrounding area, including US Highway 85. The applicant may be required to participate and contribute to improvements for the US 85 Highway Access Control Plan. Internal Roadways: ❑ The internal roadway right-of-way shall be 60-feet in width including cul-de-sacs with a 65- foot radius, and dedicated to the public. The typical cross-section of interior road shall be shown as two 12-foot paved lanes with 4-foot gravel shoulders on the change of zone plat. The cul-de-sac edge of pavement radius shall be 50-feet. ❑ Stop signs and street name sign locations must be shown on the final roadway construction plans. ❑ Sufficient off-street, paved parking areas shall be provided in the Industrial Zone Districts to meet the requirements of employees, company vehicles, visitors and customers. ❑ Loading areas in the Industrial Zone Districts shall be located, designed and constructed in a manner that is in conformance with standards. Sufficient space shall be provided in loading areas to accommodate the vehicles being loaded or unloaded without encroachment upon neighboring property or rights-of-way. Said loading areas shall be paved. ❑ Lots in the Industrial Zone Districts shall have safe access to an approved Public or private street. ❑ Intersection sight distance triangles at the development entrance will be required. All landscaping within the triangles must be less than 3'/z feet in height at maturity,and noted on the final roadway plans. ❑ The applicant shall submit to Public Works stamped,signed and dated final plat drawings and roadway/construction& grading plan drawings for review and approval. Construction details should be included. ^` The applicant shall submit Improvements Agreements According to Policy Regarding Collateral For Improvements with the application. These agreements must be reviewed by Public Works and shall be approved by the B0CC prior to recording the plat. Page 1 of 2 ii EXH IBIT 1 Drainage: A final drainage report stamped, signed and dated by a professional engineer licensed in the State of Colorado shall be submitted with the application. The 5-year storm and 100-year storm drainage studies shall take into consideration off-site flows both entering and leaving the development. Increased runoff due to development will require detention of the 100-year storm developed condition while releasing the 5-year storm existing condition. U The final drainage report shall include a flood hazard review documenting any FEMA defined tloodways. The engineer shall reference the specific map panel number, including date. The development site shall be located on the copy of the FEMA map. ❑ The applicant shall prepare a construction detail for typical lot grading with respect to drainage. Front, rear and side slopes around building envelopes must be addressed. In addition,drainage for rear and side lot line swales shall be considered. Building envelopes must be planned to avoid storm water flows,while taking into account adjacent drainage mitigation. ❑ Final drainage construction and erosion control plans (conforming to the drainage report) stamped, signed and dated by a professional engineer licensed in the State of Colorado shall be submitted with the application. Recommendation ❑ The Public Works Department recommends approval of this change of zone. The applicant shall address the comments listed above at the specific step of the review process stated. The review process will continue only when all appropriate elements have been submitted. There is an existing shop/office on the property that is currently served by a commercial well (per USR-1402) and an individual sewage disposal system (SP-0300449) designed for 10 employees. The septic system has been installed and inspected by this Department. Any further development of the site will require a Site Plan Review. Any commercial/industrial development must comply with all applicable Weld County Department of Public Health and Environment, Colorado Department of Public Health and Environment, EPA and/or Oil and Gas regulations. The applicant/developer must contact the appropriate agency for more information regarding the site-specific requirements of each development. The Department recommends approval of this application with the following conditions: 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 4. A plan review is required for each building for which a building permit is required. Plans shall include a floor plan. Plans may be required to bear the wet stamp of a Colorado registered architect or engineer. Two complete sets of plans are required when applying for each permit. Dear Fellow Planning Commissioners: Thank you for the opportunity to review and comment upon the proposed change of zoning. The Fort Lupton Planning Commission met on September 14, 2004 and reviewed the application. As a result of that review, we offer the following comments and concerns relative to the Coordinated Planning Agreement, and other applicable Plans and Policies of the City. 1. Roadway Impacts - The Fort Lupton Transportation Plan shows Weld County Road 27 as an arterial with 120 feet for right-of-way. The proposal does not include any dedication of right-of-way or construction of public improvements. If the development is to be approved, the Commission recommends that 120 feet be dedicated now rather than in the future, and expansion and improvement should occur concurrently with this industrial development. WCR 27 is a narrow two-lane road without emergency lanes, shoulders or turn lanes. If this type of development continues to be approved along the WCR 27 corridor, as we have seen with recent Agricultural to I-3 re-zonings, the road will soon become inadequate to serve the industry and the citizens of Weld County. It is the position of the Commission that development should not precede necessary roadway improvements and development should be held accountable for its impacts. 2. Coordinated Planning Agreement- The subject site is outside of the City's Urban Growth Area but within the Municipal Referral Area as defined by the Coordinated Planning Agreement between the City and County. Section 3.2 of the Agreement states: CZ-1065 Planning Commission Comments Page 2 " To the extent legally possible the County will disapprove proposals for Urban Development in areas of the Municipal Referral Area outside the Urban Growth Area." It is the opinion of the Planning Commission that a rezoning will open the door to development by-right, that will be urban in nature. If the rezoning is approved, the County will no longer have the ability to ensure that the property is developed in conformance with the Coordinated Planning Agreement. 3. Centralized Sewer- It is the opinion of the Commission that all industrial development should be required to hook into a centralized sewer system in this area. A central sewer system is the only practical way to ensure adequate wastewater treatment for the life of the development. A central system is also the only means to ensure that commercial and industrial businesses are accountable for waste that is put into the system, or in this case the surrounding groundwater. A central sewer system such as the City's is continuously monitored. Sources of toxic or hazardous waste can be identified, isolated, and steps taken to prevent further contamination. The Coordinated Planning Agreement rightfully recognizes that development requiring central sewer should not occur in rural areas. 4. Public Input-It is the understanding of the Commission that a construction company under a Use by Special Review permit is already using the property. The Commission recommends that the zoning remain agricultural and that the applicant be required to go through the same special review process. This will allow for public input from affected property owners and from municipalities. I-3 zoning will allow the proposed use without any public hearings or public input.
