HomeMy WebLinkAbout20050426.tiff RESOLUTION RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST VERNON AND LINDA WOLFE FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Veron and Linda Wolfe, VI #0400124, are allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 8th day of February, 2005, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Veron and Linda Wolfe, property owners, were present at said hearing, and WHEREAS,the Board of County Commissioners deems it advisable to refer said violation to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon such referral until May 8, 2005,to allow adequate time for the property owners to submit the Zoning Permits for a mobile home and remove, restore, or screen the noncommercial junkyard from all adjacent properties and public rights-of-way, to bring the subject property into compliance and for an inspection of the property by the Department of Planning Services staff. For the mobile homes, the following items were requested (by Wendi Inloes): 1.) The derelict mobile home be removed 2.) The 2 (farm labor) mobile homes shall have Zoning Permits (ZPMH) applications and building permit applications completed and submitted for processing. 3.) The 2 older mobile homes (previously permitted through ZPAD-8l {PR-9710115} & ZPAD-82 {PR-9730116}) shall complete the ZPMH application (1 for Accessory to Farm {a son} and 1 for Medical Hardship {for "Grannie"}), WITHOUT any fees,but shall be submitted to the Department of Planning Services for re justification. 4.) The other mobile home (previously permitted as MHZP-57 {for their eldest son}), shall complete and record a Quick Claim deed creating 2 (two) separate legal lots in the SW4 of S7T4NR63W (the N2 and S2 of the SW4). Once the Quick Claim deeds are recorded a copy shall be provided to our office so MHZP-57 can be converted to a Principle Dwelling instead of an Accessory to the Farm. We also discussed the "Noncommercial Junkyard". I explained any vehicles without current license plates and/or are not in running condition shall be screened from all adjacent properties and all public rights-of-ways. Mr. Wolfe asked about farm trucks. I explained as long as they are soley utilized on the property(don't go on any county roads), they do not need current license plates, but they do need to be working (otherwise, their derelict). We also discussed their building situation. Their COC application (for an Ag Exempt building) has been received and is being processed by Lin Dodge. I explained that they should be receiving something in the mail shortly stating such. I explained due to the list of items to be corrected, I would go ahead and send a 60 day letter, instead of the standard 30 day letter.
