TO: Board of County Commissioners COLORADO DATE: June 14, 2005 FROM: Bethany Salzman, Code Compliance II Kim Ogle, Planning Manager SUBJECT: Racing and Arena Facility County Road 39 and CR 28 A maximum of 1000 visitors will be allowed on site during approved horse racing events. The facility shall have appropriate levels of security on premises, including parking area, food stations and at all points of ingress and egress. Appropriate documentation shall be provided indicating that ingress and egress to this site is approved by the appropriate land owners and/or mineral resource entities. Two points of ingress and egress and all gates shall be opened before racing events so as to not back up, stage, or park overflow traffic on County Road 39 or County Road 28. The off-street parking including both access drives shall be surfaced with gravel or the equivalent and shall be graded to prevent any drainage problems. There shall be no parking or staging of vehicles on County Road 39 or County Road 28. Horse racing events shall only be held on weekends and holidays, or as stipulated by the Board of County Commissioners. Hours of operation shall be from 10:00 A.M. to 6:00 P.M. during weekends and holidays or as stipulated by the Board of County Commissioners. Two (2) persons trained in emergency medical technology for the first three hundred fifty (350) persons and one (1) for every three hundred fifty (350) persons after that, together with at least one (1) emergency ambulance available for use at all times. A total of 4 EMTs and one secondary or back-up ambulance or equivalent shall be on premises during the hours of each event. Should area lighting be utilized, the rays of light shall not illuminate adjacent properties and shall be turned off one-half hour after the close of business for each given event. If electrical systems are not self-supporting, electrical systems installation and maintenance in compliance with minimum County electrical standards shall be required. No alcoholic beverages shall be allowed on-site nor shall alcohol be served during horse racing and practice events. Animal and feed wastes, bedding, debris and other organic wastes shall be disposed of so that vermin infestation, odors, disease hazards, and nuisances are minimized. Such wastes shall be removed weekly from the facility and disposed of by a commercial hauler. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30- 20-100.5, C.R.S.) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. The applicant shall operate in accordance with the approved "waste handling plan", e.g., all solid and liquid wastes shall be disposed of in an appropriate manner as regulated by the County Health Department. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The applicant shall have sufficient equipment available to implement dust control. The facility shall adhere to the maximum permissible noise levels allowed in Commercial Zone District as delineated in 25-12-103, C.R.S. Adequate handwashing and toilet facilities shall be provided for the volunteers and attendees. Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to Individual Sewage Disposal Systems. Should port-a-lets be utilized, ten (10) units shall be in operation on site and shall be cleaned after each event, in some instances daily. A permanent, adequate water supply shall be provided for drinking and sanitary purposes. Should bottled water be utilized, adequate supplies shall be on hand at all times. The water system shall comply with the requirements for a community water system as defined in the Primary Drinking Water Regulations (5 CCR 1003-1), if a commercial well is utilized for potable drinking. The applicant shall comply with Colorado Retail Food Establishment Rules and Regulations governing the regulation of food service establishments. There shall be no open burning conducted on the site, with the exception to burning defined as "agricultural open burning" as defined by Regulation No. 9 of the Colorado Air Quality Control Commission Regulations. If construction of a new building is required, a building permit shall be obtained prior to the construction of any new building. The bleachers, when built, shall be built to standard ICC/ANSI 300-2002. The property owner shall allow any mineral owner the right of ingress or egress for the purposes of exploration development, completion, recompletion, re-entry, production and maintenance operations associated with existing or future operations located on these lands. Personnel from the Weld County Government shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with all applicable Federal, State of Colorado and Weld County regulations. However, security will be at the gate to close off entrance if we are to reach 1,000 people. 7. We will have several water coolers distributed proportionately throughout the area. The water will come from El Vergel Lounge. A staff person will make sure that water coolers are always full. There will also be bottled water for sale. There will be toilets marked male and female. They will be provided by Platteville Potties Inc. 10. We will have a stand that will be used as a central command post. It will also serve as the emergency post. It will be manned throughout the event and will be able to direct people to emergency personnel, security, and answer any other general questions that may arise. Easiest access to the property is from Platteville. Hwy 85 to county road 32 East to county road 39 South to County road 28. Property sits on right hand corner. 13. Eight security officers will be on hand with cellular phones to communicate with hospital, police, and fire services. The initial complaint was received on May 5, 2005; however, due to lack of information could not be verified. I received an additional complaint on May 20,2005 and thus conducted a site inspection on May 23,2005. I verified that the site is completely set up to host horse racing events (i.e. port-a-pots, starting gate, side fences and a shed/concession stand). A compliance encouragement letter was sent. Two(2)days later, this application was submitted to your office. Due to the number of patrons (participants), potential safety concerns and complaints received, the Department of Planning Services recommends that this application be denied and the applicant be advised to complete and submit a Use by Special Review application. Furthermore,staff recommends that the Board of County Commissioners advise the applicant to cease and desist from operating until and if a Use by Special Review permit is approved and recorded. Horse match racing is an ever increasing popular sport in Northern Colorado. El Herradero plans to capitalize on this phenomena. Carril El Herradero will provide horse match racing,and rodeos. The company's stock will be held by its President, Alberto I. Loya. Carril El Herradero views its mission as providing a safe and entertaining way for the Northern Colorado community to enjoy themselves. Carril El Herradero is dedicated to building long-term relationships with its clientele through superior customer satisfaction, and excellent facility. We will be known throughout the area as the premiere match race facility in the area. The goal is steady expansion,and becoming profitable by the third year of operation. The company provides a safe and welcoming environment where horse aficionados from around the state can come and enjoy a relaxing afternoon. Match races will be held on Saturday and Sundays and occasionally on Wednesday's. The operation will be run year round with the summers as our busy season. We will be targeting all horse aficionados in the area, with an emphasis on the Latino segment of the community. Reliable sources and research indicate that there is an extremely large match racing following in the area. S . President and founder Alberto I. Loya brings significant management experience to his position. He is currently the owner of Loya Insurance Agency in Greeley that has well over 2,000 clients. Mr. Loya also is President and founder of El Vergel Corporation, D.B.A. El Vergel Lounge in Platteville and has been for the past 8 years. Alberto was a board of director for Southwest Liquor Concessionare, which ran the liquor concessions at Island Grove Park from 2000 to 2003 catering to groups of over 5,000. Prior to that Mr. Loya owned and operated RoadRunner Security for 8 years which guarded bars, nightclubs, and special events in Weld, Lorimer, Boulder,and Adams County. Mr. Loya was also instrumental in the formation of Greeley Fiesta This organization was started with a loan for$20,000 and turned over three years later with$40,000 in the bank under Alberto's direction. Mr. Loya is also a member of Greeley Rotary and has recently been asked and accepted to be on the United Way of Weld County Board of Directors. Carril El Herradero will open its doors to the general public with a temporary permit. Within 2 months we will be operating with a Use by Special Review plan. The financial strategy of El Rancho Corporation emphasizes reinvestment of income for growth during the first few years of operation,with the company reaching profitability by year three.
