RESOLUTION RE: APPROVAL OF RECORDED EXEMPTION NO. 681 - HAROLD AND JUDY ELAM WHEREAS , the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS , the Board of County Commissioners, pursuant to its authority under Section 30-28-101 (10) (d) , CRS , as amended, did determine at a public meeting held in the Chambers of the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat known as Recorded Exemption No. 681, does not come within the purview of the definition of the terms , "subdivision" and "subdivided land" , and WHEREAS , the request for Recorded Exemption No. 681 was submitted by Harold and Judy Elam for property being located in Part of the SEa SWa, Section 21, Township 5 North, Range 65 West of the 6th P.M. , Weld County, Colorado, being more particularly described in the plat which shall be provided by the applicant and known as Exhibit "A" , said plat to be recorded, and WHEREAS , this request is to divide the property into parcels of 1. 85 acres and 1 acre, more or less. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from the definition of the terms, "subdivision" and "subdivided land" . The parcel of land on which this request is being made is described as part of the SEy SWk, Section 21, T5, R65W of the 6th P.M. , Weld County, Colorado. The property is located .5 (1/2) mile east of Evans on Weld County Road 54. The property contains approximately 2.85 acres of Class VIw irrigated soil. The parcel of land under consideration is the total contiguous land holdings of the applicant. The request is to divide the property into parcels of 1.85 acres and one (1) acre, more or less. Based upon the submitted information and policies of the County, the Depart- ment of Planning Services staff recommends the request be approved for the following reasons: 1. This road serves the Kersey-Evans area and would enable farmers needing Mr. Elam's service to travel to his site without traveling major highways. The proposed usage is consistent with the Weld County Comprehensive Plan in that the proposed usage will serve the agricultural community. Similar uses are in the area. The applicant shall submit a letter to the Clerk to the Board's office when requesting preadvertising for a Board of County Commis- sioner's hearing for a land-use application. The letter shall set forth the reasons why the applicant is requesting the preadvertise- ment. 2. The Clerk to the Board's office shall schedule the request for preadvertisement on the first available regular Board of County Commissioner's meeting. 3. The Clerk to the Board's office shall inform and furnish a copy of the letter requesting the preadvertisement to the Department of Planning Services. 4. The applicant shall appear at the Board of County Commissioner's meeting and explain why the preadvertisement has been requested.
