RE: DETERMINATION THAT CONDITION OF APPROVAL #2.E OF RECORDED
EXEMPTION #3927, JENNIFER SPERL, CIO ANTON SPERL, HAS BEEN SATISFIED
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, on October 18, 2004, the Department of Planning Services conditionally
approved the application of Jennifer Sperl, c/o Anton Sperl, 11435 County Road 23, Fort Lupton,
Colorado 80621,for Recorded Exemption#3927 to divide the property into parcels estimated to be
approximately 58.2 acres and 13.2 acres,for property which is located on the following described
real estate, to-wit:
Lot B of Recorded Exemption#804; being part of the
E1/2SE1/4 of Section 2,Township 2 North, Range 68
West of the 6th P.M., Weld County, Colorado, and
WHEREAS, Condition of Approval #2.E of said RE #3927 states: "The applicant[s] shall
address the requirements of Weld County School District RE-1 as stated in the referral response
received September 5, 2004. Evidence of such shall be submitted in writing to the Weld County
Department of Planning Services," and
WHEREAS,the applicants have asked the Board to delete said Condition of Approval#2.E,
and
WHEREAS,on March 9,2005,the Board considered the applicants'request,and heard from
the applicants and the Superintendent of Weld County School District RE-1 that they intend to enter
into an agreement whereby the applicants or their successors may pay the required fee to the
School District at such time as a dwelling is constructed on the lots of said RE #3927, which
agreement satisfies the School District as required by Condition of Approval #2.E, and
WHEREAS,the Board therefore determined that said Condition of Approval#2.E has been
satisfied.
NOW,THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County,Colorado,that the Board finds Condition of Approval#2.E for Recorded Exemption#3927,
be, and hereby is, satisfied.

The Department of Planning Services has forward application RE-3927 to the Board of County
Commissioners requesting denial. Application RE-3927 was conditionally approved by
Planning Staff on October 18, 2004. Condition of Approval number 2.E states "The applicant
shall address the requirements of Weld County School District RE-1 as stated in the referral
response received September 5, 2004. Evidence of such shall be submitted in writing to the
Weld County Department of Planning Services." This condition has not been met. The
applicant and his representives have submitted the attached letters in response to condition
2.E.

Dear Mr. Gathman:
Water Colorado, LLC is assisting Mr. Anton Sperl in the sale of the following located
property:
56 acres in the East Half of the Southwest Quarter of Section 2, Township 2
North, Range 67 West of the 6th PM.
Mr. Sperl has applied for a Recorded Exemption from Weld County on the above
described property. In the course of obtaining approval, Mr. Sperl received
communication from the Weld County School District RE-1 stating that their
authorization of his Recorded Exemption is dependant upon a full in lieu payment for a
single family dwelling unit on each parcel in the amount of$1,051.20.
We wish to file an objection to this condition on the basis that a dwelling does not exist
on the parcel, nor does Mr. Sperl or the purchaser of the property intend to build a
dwelling in the immediate future, It is their intent to leave the property in agricultural
use.
Please present this matter to the County Commissioners for an appeal to be heard at the
next meeting.

Your recorded exemption application is being processed. If it is determined that the application meets the
approval criteria of Chapter 24 of the Weld County Code, you will be notified that the recorded exemption is
approved. If the staff determines that the application does not meet the approval criteria or if staff has

Approved with Conditions
The Weld County Department of Planning Services has determined through an administrative review that the
standards of Section 24-8-40 of the Weld County Code have been met. This Recorded Exemption is
approved with the following conditions in accordance with information submitted in the application and the
policies of Weld County.
1. A Weld County septic permit is required for any proposed home. The septic system shall be installed
according to the Weld County Individual Sewage Disposal System (I.S.D.S.) regulations.
2. Prior to recording the plat:
A. The plat shall be titled: Recorded Exemption No. 1311-2-4 RE-3927
B. When feasible,there shall be no"net increase"in the number of accesses to a public road.The
site currently has 5 accesses. The applicant shall submit a plan to the Department of Planning
Services indicating how they propose to provide adequate access to both lots without creating a
"net increase" OR the applicant shall submit justification for the need for the existing multiple
access points and/or the need for additional access points.The submitted information shall be
reviewed in accordance with Chapter 8, Article II and Chapter 24, Article II, Section 24-8-40 of
the Weld County Code.
C. All accesses shall be clearly shown on the plat.
D. County Roads 23 and 24.5 are designated on the Weld County Road Classification Plan as
collector status roads,which require 80 feet of right-of-way at full build out.There is presently 60
feet of right-of-way.A total of 40 feet from the centerline of County Roads 23 and 24.5 shall be
delineated on the plat as right-of-way reservation for future expansion of County Roads 23 and
24.5. These roads are maintained by Weld County.
E) The applicant shall address the requirements of Weld County School District RE-1 as stated in
the referral response dated September 5,2004. Evidence of such shall be submitted in writing
to the Weld County Department of Planning Services. A
F. The applicant shall provide evidence of water for the proposed LotXof this recorded exemption
(copy of domestic well permit or letter from water district indicating the ability to serve the
property).
G. The applicant shall attempt to address the requirements(concerns)of the Town of Platteville as
stated in their referral dated September 27,2004. Written evidence of such shall be submitted
to the Department of Planning Services.
,W The applicant shall provide the Weld County Department of Planning Services with a Statement
of Taxes from the Weld County Treasurer showing no delinquent taxes exist for the original
parcel.
I. The following notes shall be placed on the plat:
1) All proposed or existing structures will or do meet the minimum setback and offset
requirements for the zone district in which the property is located. Pursuant to the
definition of setback in the Weld County Code, the required setback is measured from
the future right-of-way line.
* No building or structure as defined and limited to those occupancies listed as Groups A,
B, E, F,H, I, M and R in Section 302.1 of the 2003 international Building Code, shall be
constructed within a 200-foot radius of any tank battery or within a 150-foot radius of any
wellhead. Any construction within a 200-foot radius of any tank battery or 150-foot radius
of any wellhead shall require a variance from the terms of the Section 23-3-10 of the
Weld County Code.
2) Lot A is not eligible for a future land exemption in accordance with Section 24-8-20.C.1 of
the Weld County Code.
3) Prior to the release of building permits, the applicant shall submit a recorded deed
describing the Lot upon which the building permit is requested with the building permit
applications. The legal description on such deed shall include the Lot designation and
Recorded Exemption number.
4) Prior to the release of building permits, the applicant shall submit evidence to the
Department of Planning Services that Lot B has an adequate water supply of sufficient
quality, quantity and dependability.
5) Prior to the release of building permits for any structure exceeding 3,600 square feet,the
applicant must comply with the requirements of Appendix III-A of the International Fire
Code.
6) Should noxious weeds exist on the property or become established as a result of the
proposed development the applicant/landowner shall be responsible for controlling the
noxious weeds, pursuant to Chapter 15, Articles I and II of the Weld County Code.
7) Recorded Exemptions on adjacent properties may raise the issue of compliance with the
intent of the Recorded Exemption Process. Approval of this Recorded Exemption does
not guarantee approval of future applications on adjacent properties.
8) Building permits shall be obtained prior to the construction of any building. Buildings that
meet the definition of an Ag Exempt Building per the requirements of Section 29-1-20
and Section 29-3-20.6.13 of the Weld County Code do not need building permits,
however, a Certificate of Compliance must be filed with the Planning Department and an
electrical and/or plumbing permit is required for any electrical service to the building or
water for watering or washing of livestock or poultry.
9) Effective January 1, 2003, Building Permits issued on the proposed lots will be required
to adhere to the fee structure of the County Road Impact Program. (Ordinance 2002-11)
10) WELD COUNTY'S RIGHT TO FARM: Weld County is one of the most productive
agricultural counties in the United States, ranking fifth in total market value of agricultural
products sold. The rural areas of Weld County may be open and spacious, but they are
intensively used for agriculture. Persons moving into a rural area must recognize and
accept there are drawbacks, including conflicts with longstanding agricultural practices
and a lower level of services than in town. Along with the drawbacks come the incentives
which attract urban dwellers to relocate to rural area:open views,spaciousness,wildlife,
lack of city noise and congestion, and the rural atmosphere and way of life. Without
neighboring farms, those features which attract urban dwellers to rural Weld County
would quickly be gone forever.
Agricultural users of the land should not be expected to change their long-established
agricultural practices to accommodate the intrusions of urban users into a rural area.
Well run agricultural activities will generate off-site impacts, including noise from tractors
and equipment; slow-moving farm vehicles on rural roads; dust from animal pens, field
work, harvest, and gravel roads; odor from animal confinement, silage, and manure;
smoke from ditch burning;flies and mosquitoes;and the use of pesticides and fertilizers
in the fields, including the use of aerial spraying. Ditches and reservoirs cannot simply
be moved out of the way of residential development without threatening the efficient
delivery of irrigation to fields which is essential to farm production.
Section 35-3.5-102, C. R. S.,provides that an agricultural operation shall not be found to
be a public or private nuisance if the agricultural operation alleged to be a nuisance
employs methods or practices that are commonly or reasonably associated with
agricultural production.
Weld County covers a land area of over 4,000 square miles in size (twice the State of
Delaware) with more than 3,700 miles of state and County roads outside of
municipalities. The sheer magnitude of the area to be served stretches available
resources. Law enforcement is based on responses to complaints more than on patrols
of the county and the distances which must be traveled may delay all emergency
responses, including law enforcement, ambulance, and fire. Fire protection is usually
provided by volunteers who must leave their jobs and families to respond to
emergencies. County gravel roads, no matter how often they are bladed,will not provide
the same kind of surface expected from a paved road. Snow removal priorities mean
that roads from subdivisions to arterials may not be cleared for several days after a major
snowstorm. Snow removal from roads within subdivisions are of the lowest priority for
public works or may be the private responsibility of the homeowners. Services in rural
areas, in many cases,will not be equivalent to municipal services. Rural dwellers must,
by necessity, be more self-sufficient than urban dwellers.
Children are exposed to different hazards in the county than in an urban or suburban
setting. Farm equipment and oil field equipment, ponds and irrigation ditches, electrical
power for pumps and center pivot operations, high speed traffic, sand burs, puncture
vines, territorial farm dogs, and livestock present real threats to children. Controlling
children's activities is important, not only for their safety, but also for the protection of the
farmer's livelihood. Parents are responsible for their children.
3. The applicant shall submit two(2)paper copies of the plat for preliminary approval to the Weld County
Department of Planning Services. Upon approval of the paper copies the applicant shall submit a Mylar
plat along with all other documentation required as conditions of approval. The Mylar plat shall be
recorded in the office of the Weld County Clerk and Recorder by Department of Planning Services'
Staff. The plat shall be prepared in accordance with the requirements of Section 24-8-60 of the Weld
County Code. The Mylar plat and additional requirements shall be submitted within sixty(60)days from
the date the Administrative Review was signed. The applicant shall be responsible for paying the
recording fee.
4. The Department of Planning Services respectfully requests the surveyor provide a digital copy of this
Recorded Exemption. Acceptable CAD formats are .dwg, .dxf, and .dgn (Microstation); acceptable
GIS formats are ArcView shapefiles, Arclnfo Coverages and Arclnfo Export files format type is .e00.
The preferred format for Images is .tif(Group 4). (Group 6 is not acceptable). This digital file may be
sent to maps@co.weld.co.us.
5. The Weld County Department of Planning Staff's approval of this Recorded Exemption Application is
based on satisfying the Conditions of Approval.Should an applicant be unwilling or unable to meet any
one of these conditions within 60 days of approval,then this case will be forwarded to the Weld County
Board of County Commissioners with a staff recommendation for denial.

Dear Dr. J. Barbie,
I received your agreement form dated September 9, 04, with an attached request for an In
Lieu payment of$1,054.20 to the RE-1 school district.
As per our discussion over the phone on September 5, I pointed out to you the following
facts:
A) The parcel, subject for exemption, has no dwelling on it.
B) The parcel is for sale.
C) I have no knowledge whether the future buyer is going to construct a dwelling on it.
D) I have no idea when the property will be sold.
C) Whoever builds on this parcel is liable for the full In Lieu payment to the schooldistrict.
D) I can not be held liable for something that does not exist.
It should be clear that my application (for the exemption of lot B)did not include an
application to built a single family unit or any structure, that would demand such payment to
the school district... It merely hypothetically suggested the possibility that the future buyer
might or might not build a family dwelling on the newly aquired property.
We agreed on the following:
➢ The future owners plans are out of my control.
➢ At the point of sale the new owner shall sign an agreement, obligating him to pay the
In Lieu payment, should he decide to build a single family dwelling on said property.
➢ I will forward the new owners name and contact to the schooldistrict.

RE: Recorded Exemption (RE-3927). Address all staff comments and issues
Dear Mr. Gathman,
Thank you for the speedy processing of my application for exemption.
Arrangements were made to deliver two (2) paper copies of the plat for review, prepared by a
state certified surveyor, to your office.
Response to staff comments and issues:
1. The exempted parcel RE-3927 is open land consisting of 2 fields. One 45 acre corn field and
one 18 acre hayfield.
2. There are no plans, on my part, to build or to add any additional access roads.
3. There is an existing well on the property. See enclosed attachment.
4. The existing requirements for the RE-1 school district are not applicable as the parcel is open
land with no structures. See enclosed attached copy, addressed to Dr. J. Barbie of the RE-1
school district.
5. Conformity to the City of Platteville's building code and other rules are not applicable at this
point. (No plans for building). Active jurisdiction range is 3 miles, as pointed out by the
Platteville town clerk, Mrs. Rebecca Kunzler. Actual distance, from the property to the City of
Platteville, is 6 miles. Future building permits may be subject to building codes, falling under
the jurisdiction, of Weld County.
6. Weld county tax receipt enclosed.

8, It is understood and agreed that upon entry of an order granting said Petition,Petitioner shall be bound by the terms of thisbce adopted ontract,the
Conservancy Act and the Rules,Regulations,Bylaws,Resolutions and Policies of the Subdistrict as the.same,from time to time,may

amended. Petitioner may within 15 days of the receipt of this contract,or any annual bill of special assessment,make en objection in writing to the
Board of Directors of the Subdistrict stating in particular why the contract or bill of special assessment is incorrect.The Board of Directors may review
the written objection and with or without hearing act upon the same and notify Petitioner.
9. Because the Subdistrict's plan for augmentation is based on irrigation as stated in¶3 through¶5 above,Petitioner agrees:
a To continue to use the water rights described in¶5 In the same manner and to the same extent as stated in this petition as described in¶6
on the lands described in¶3 and the acres in¶4;and
b. To immediately notify the Subdistrict in writing of any material changes in the information given in¶3 through¶6.A material change includes,
i. any change in the operation or use of the well(s)described in¶5a or¶6;
ii. any change in the use or extent of use of the surface water rights described in¶5b;
D. any sale,lease,or other disposition of any of the water rights listed in¶5 or any of the land deserted In¶3:
iv. any purchase,lease,rental or other acquisition of additional water rights or additional lands which will be imgated:
v. any cessation of irrigation for more than one year.
10. It Is understood and agreed that failure to adhere to¶9 may result In the immediate termination of this contract by the Board of Directors. If your
contract is so terminated you may petition the Board of Directors to be heard on the matter of the termination,
11. a is understood and agreed that any replacement water allotted by the Board of Directors of the Subdistrict shall be for the purpose of permitting
the irrigation use of well water upon the lands described above,provided,however,that all uses which receive the benefit from the allotment shall be
within the Well Augmentation Subdistrict of the Central Colorado Water Conservancy District.
12. It is understood and agreed that the Board of Directors of the Subdistrict will attempt to obtain and maintain judicial or administrative approval of
a plan for augmentation,substitute supply plan or other operating plan,in order to enable Petitioner to operate the wells described above in accordance
with the rules and regulations of the State Engineer governing well pumping,end the laws of the State of Colorado. The Board of Directors of the
Subdistrict do not guarantee that the Petitioner will have the continued and unrestricted use of well water, The Subdistrict will use its best efforts to
obtain and maintain a plan for augmentation,substitute supply plan or other operating plan in order to assist the Petitioner in the continued use of well
water and will take such actions as deemed proper by the Board of Directors to promote and protect said plans.If necessary,Petitioner agrees to curtail
his or her well pumping to the extent ordered by the Board of Directors of the Well Augmentation Subdistrict of the Central Colorado Water Conservancy
Distdct or the State or Division Engineer.
13. The amount of water required is an estimate by the Subdistrict based on conditions at the present time,but is not binding on the Subdistrict,and
is subject to change each year. The State Engineer and Division Engineer,or the Water Court,have the authority to make the final determination as
to the amount of water that is acceptable and so no estimate by the Subdistrict should be considered binding or final. Any person has the right to
present their own engineering estimate to the Subdistrict for consideration.
14. Pursuant to§37-45-125(2)(f).C.F.S.,the annual special assessment herein shall become a tax lien upon the lands for which such water is
petitioned and allocated. Upon termination of this contract,any unpaid assessment will remain a lien upon the land.
15. The term of this contract shall be for the calendar year beginning January 1 after the signing of this contract,but if replacement water is required
during the calendar year the contract is signed,then the term shall begin immediately upon execution in which event the contract shall expire at the end
of the calendar year. The contract shall be automatically renewed each year,if timely payment is made,unless notice in writing is given by either party
canceling the contract thirty(30)days prior to the end of the calendar year.
15. It is understood and agreed that the replacement water allotment is made for the exclusive benefit of the Petitioners lands and may not be
transferred to any lands without the prior written approval of the Board of Directors of said Subdistrict by a new contract.
17. Petitioner understands that the Well Augmentation Subdistrict has adopted a groundwater measuring program,and agrees to install,at Petitioner
cost,such measuring devices as may be called for by the Board of Directors of the Well Augmentation Subdistrict of the Central Colorado Water

The Weld County Public Works Department has reviewed this proposal. Our comments and requirements are
as follows:
COMMENTS:
WCR 24.5 is designated on the Weld County Road Classification Plan (FHU) as a collector status road, which
requires an 80-foot right-of-way at full build out. There is presently a 60-foot right-of-way. This road is
maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Code, Chapter 23,
Article III, Section 23-3-50, the required setback is measured from the future right-of-way line.
WCR 23 is designated on the Weld County Road Classification Plan (FHU) as a collector status road, which
requires an 80-foot right-of-way at full build out. There is presently a 60-foot right-of-way. This road is
maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Code, Chapter 23,
Article III, Section 23-3-50, the required setback is measured from the future right-of-way line.
REQUIREMENTS:
The Weld County Public Works Department recommends approval of this application.
The access shall be placed in such a location to have adequate sight distance in both directions and not below
the crest of a hill or where physical obstructions are present. (Lot B)
The applicant shall utilize the existing residential access to this parcel. (Lot A)
If a drainage culvert is required, a 15-inch corrugated metal pipe is the County's minimum size requirement. If
the applicant chooses to place a larger culvert, please contact the Public Works Department to adequately size
your culvert. (Lot B)
Direct access from a public road shall be limited; only one access is allowed per legal residential parcel. No
circle drives will be allowed. In accordance with Chapter 8, Article II of the Weld County Code, this policy shall
apply to all new and existing accesses within the unincorporated areas of Weld County. Properties within
municipalities or other counties that access Weld County roads are also subject to this policy. (Lot B)
Utilize the existing agricultural, oil and gas, and ditch roads that are necessary for your agricultural operation.
(Lot B)
Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the property or
become established as a result of the proposed development, the applicant/landowner shall be responsible for
controlling the noxious weeds.

The Planning Commission for the Town of Platteville considered the aforementioned Referral
at its meeting on Tuesday, September 14, 2004. It was the determination of the Planning
Commission to attach a letter expressing some thoughts in reference to future Referrals.
It is the desire of the Planning Commission that any building and/or development that occurs
within three (3) miles of the Town of Platteville as the result of a Weld County Referral process
conform to the Town's building and development design standards. The primary concern is that the
Town may annex land in the future with buildings and infrastructure built to another standard, which
may not conform to the Town's building and development design standards.
With this being said, it may behoove the Town of Platteville and Weld County to meet and
discuss these items in additional detail, notwithstanding their being addressed in the Coordinated
Planning Agreement.
