HomeMy WebLinkAbout20052403.tiff HEARING CERTIFICATION DOCKET NO. 2005-59 RE: CREATION OF THE SOUTHWESTERN WELD COUNTY LAW ENFORCEMENT AUTHORITY A public hearing was conducted on August 8, 2005, at 9:00 a.m., with the following present: Commissioner William H. Jerke, Chair Commissioner M. J. Geile, Pro-Tem Commissioner David E. Long Commissioner Robert D. Masden Commissioner Glenn Vaad Also present: Acting Clerk to the Board, Jenny VanEgdom County Attorney, Bruce Barker The following business was transacted: I hereby certify that pursuant to a notice dated July 15, 2005, and duly published July 20, 27, and August 3, 2005, in the Fort Lupton Press, a public hearing was conducted to consider the Creation of the Southwestern Weld County Law Enforcement Authority. Bruce Barker, County Attorney, made this a matter of record. Mr. Barker stated Chris Fellows is the Attorney for the applicant. (Changed to Tape #2005-32). He stated this is a single property, owned by one party, and the statute states creation of a ballot issue, and a TABOR ballot issue are required. He further stated the creation statute requires completion 30 to 40 days prior to an intent resolution being approved. Mr. Barker stated in order to have the issue on the November 1, 2005 ballot, the Clerk and Recorder's Office will need to receive the necessary documents between September 7, and September 10, 2005. He stated two resolutions come before the Board today; the creation resolution, and the resolution which sets the ballot issue. He stated the intent will need to be continued September 21,2005,to comply with the State statute regarding timing. He further stated the TABOR ballot issue may be referred to the Clerk and Recorder's Office, for the purpose of placing on the ballot. Responding to Chair Jerke, Mr. Barker stated a work session has not been held regarding this matter. Chris Fellows,Attorney, stated the resolutions before the Board are a product of a year's worth of work, among himself, the Director of Finance and Administration, and the Director of Planning Services. He stated as Weld County experiences urbanized growth,the cost of providing law enforcement is hard to control. He stated at the request of staff,the law enforcement authority documents were drafted, using the BeeBee Draw Law Enforcement Authority as a model and template. He stated this Law Enforcement Authority is set up so that at the discretion of the County, the entire Southwestern quadrant can be included in the District; multiple districts will not need to be formed. Chair Jerke requested a work session, in order to gain more information about the proposed Law EnforcementAuthority. Responding to Chair Jerke, Mr. Fellows stated a hearing would need to be completed no later than September 10, 2005. Responding to Mr. Barker, Mr. Fellows stated a meeting regarding the policies of the Authority will take place on August 29, 2005. Mr. Barker 2005-2403 SD0118 HEARING CERTIFICATION - CREATION OF THE SOUTHWESTERN LAW ENFORCEMENT AUTHORITY PAGE 2 suggested the hearing be continued until August 29,2005,and scheduling a work session regarding the Law Enforcement Authority. Commissioner Vaad moved to continue said hearing to August 29, 2005, at 9:00 a.m. Seconded by Commissioner Masden, the motion carried unanimously. There being no further discussion, the hearing was completed at 10:00 a.m. This Certification was approved on the 15th day of August, 2005.
