HomeMy WebLinkAbout840095.tiff RESOLUTION RE: MEMORANDUM OF AGREEMENT WITH THE COUNTY COUNCIL WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado Statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, there has been a recent problem of communications of the salaries of the County Commissioners from the County Council that has resulted in a special investigation, and WHEREAS, it has been recommended in order to resolve the associated issues and avoid future conflicts between. the County Council and County Commissioners concerning this matter and future communications for the benefit of the citizens of Weld County that a Memorandum of Agreement be entered into by the Board of County Commissioners and the County Council , and WHEREAS, a Memorandum of Agreement has been presented to the County Council, and WHEREAS, the County Commissioners feel that immediate action needs to be taken to reduce their salary from $28,000 per year to $25,750 dollars per year with the difference being escrowed in a Trust Fund by the County Treasurer until the special prosecution investigation in this matter is concluded. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, that they formally present the Memorandum of Agreement attached hereto and incorporated herein by reference to the County Council for their consideration, and BE IT FURTHER RESOLVED that immediately the County Commissioners salary will be reduced from $28,000 per year to $25,750 per year with the difference being escrowed in a Trust Fund by the County Treasurer until the special prosecution investigation in concluded. MEMORANDUM OF AGREEMENT With the recent problem of communication of the salaries of the County Commissioners from the Council the following is agreed to in an attempt to resolve the associated issues and avoid future conflict between the County Council and County Commissioners concerning this matter and future communications for the benefit of the citizens of Weld County: 1. The County Commissioners' salary will be immediately reduced from $28,000 per year to $25,750 per year with the difference being escrowed in a trust fund by the County Treasurer until the special prosecution investigation is concluded. 2. Upon completion of the investigation if conclusive evidence is presented that the payment rate of $28,000 per year for 1983 and 1984 was incorrect or improper, any overpayment will be addressed jointly by the County Council and County Commissioners. 3. If in the course of resolving any appropriate overpayment due from the Commissioners an impasse is reached, or legal clarification is required, the two parties will file for a declaratory judgment for resolution of the issue. 4. To avoid future problems of communication the following protocol of correspondence will be immediately implemented. A. The attached confirmation letter regarding salaries should be an on-going part of the financial audit. B. All correspondence to the County Commissioners or departments under their administrative control should be sent to the Board via the Clerk to the Board for permanent record and receipt recognized under the communications section of the Board's agenda as a matter of record. The Clerk to the Board then will retain the permanent copy and it will be filmed and recorded as a permanent county record. C. Department heads under the Board will communicate and respond via the Board to the Council, to insure that the Board is aware of all correspondence to and from departments to the Council. I- ' , D. The County Council's secretary should become a public notary and resolutions of the County Council should be attested to, notarized, and sealed, similar to how the Clerk to the Board notarizes the Board of County Commissioners' resolutions.
