RE: ACCEPT PETITION TO VACATE A PORTION OF WELD COUNTY ROAD 37.7
BETWEEN WELD COUNTY ROADS 37 AND 39, SUBJECT TO DEDICATED AND
RECORDED EASEMENTS AND RIGHTS-OF-WAY -WILLIAM AND CHARLES
JERKE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with a Petition to Vacate a Portion of Weld
County Road 37.7 between Weld County Roads 37 and 39, subject to dedicated and recorded
easements and rights-of-way from William Jerke, 22911 Weld County Road 39, LaSalle,
Colorado 80645,and Charles Jerke, 1711 Glen Meadows Drive,Greeley,Colorado 80631,a copy
of which is attached hereto and included by reference, being more fully described as follows:
The public road right-of-way commencing at the northwest corner of
the southwest quarter of Section 8, Township 4 North, Range 65
West, thence west 80 rods to the northwest corner of the northeast
quarter of the southeast quarter of Section 7 in said Township and
Range, thence north one-half mile to the section line between
Sections 6 and 7,Township 4 North, Range 65 West of the 6th P.M.,
Weld County, Colorado
WHEREAS,the County Attorney's Office recommends approval of said request since that
portion of Weld County Road 37.7 is not needed for the safety and welfare of the traveling public,
and
WHEREAS,the adjoining landowners were mailed ten days notice by the Clerk to the Board
of a public hearing set for March 14, 2005, to consider the vacation of that portion of Weld County
Road 37.7 which is described above, and
WHEREAS,any persons owning dedicated and recorded easements and rights-of-way for
the use of the right-of-way to be vacated, if any, may continue such use after formal vacation by
Weld County, and
WHEREAS, on March 14, 2005, the Board deemed it advisable to continue the matter to
March 16, 2005, due to the lack of a full quorum, and
WHEREAS,on March 16, 2005,the Board of County Commissioners heard testimony and
reviewed all other evidence presented therein by staff and the public, and
WHEREAS,the evidence showed that the vacation of that portion of Weld County Road 37
which is described above will not leave any land adjoining the roadway without an established public
road or private access easement connecting the land with another established public road, and

WHEREAS,the Board of County Commissioners deems it advisable to vacate said portion
of Weld County Road 37.7 between Weld County Roads 37 and 39, subject to dedicated and
recorded easements and rights of ways,with said vacation to become effective upon recording as
required below.
NOW,THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Road Petition from William and Charles Jerke, be, and hereby is,
accepted.
BE IT FURTHER RESOLVED by the Board that the portion of Weld County Road 37.7
between Weld County Roads 37 and 39, which is described above be, and hereby is, vacated.
BE IT FURTHER RESOLVED by the Board that the Clerk to the Board be, and hereby is,
directed to record this Resolution in the records of the Weld County Clerk and Recorder.
The above and foregoing Resolution was,on motion duly made and seconded,adopted by
the folk3wing vote on the 16th day of March, A.D., 2005.

Existing utilities,including but not limited to,oil and gas pipelines,sewer,gas,water, or
similar pipelines and appurtenances, ditches or canals and appurtenances, and electric, telephone,
and similar lines and appurtenances within the right-of-way or holding a recorded interest to use or
cross this right-of-way are:

As support for this petition, Petitioners state that the right-of-way has not been
constructed nor maintained by Weld County;that no part is within a City or Town or a County other
than the County of Weld, that no portion of the right-of-way is shown as part of an approved or
recorded subdivision plat,map,or unincorporated community legally filed prior to any regulations
controlling subdivisions;that the right-of-way is not used by the public;that vacation of the right-of-
way will not leave any land adjoining said roadway land adjoining said roadway without an
established public road or private-access easement connecting said land with another established
public road.
Petitioners agree that they will permit any persons owning dedicated and recorded
easements and rights-of-way for the use of the right-of-way to continue such use after formal
vacation by Weld County. Further,. Petitioners agree to pay costs of providing notice including
publication, and recording of the resolution.
1This information shall be provided in the form of a certified list of the names,addresses and the corresponding Parcel
Identification Number assigned by the Weld County Assessor of the owners of property(the surface estate)who owns one acre or
more of land adjacent to the roadway. The source of such list shall be the records of the Weld County Assessor,or an ownership
update from a title or abstract company or attorney,derived from such records or from the records of the Weld County Clerk and
Recorder. If the list was assembled from the records of the Weld County Assessor,the applicant shall certify that such list was
assembled within thirty(30)days of to petition submission date.
2This information may be found by utility locates,title research,review of utility permits issued by the Department of
Public Works and site investigation.

Re: Request to Vacate Roadway
Dear Mayor Evans:
Enclosed is a copy of a notice for a public hearing to be held before the Board of County
Commissioners of Weld County, Colorado, pursuant to C.R.S. § 43-2-303, for the vacation of a
public roadway in Section 7, township 4 North, Range 65 West of the 6th P.M., Weld County,
Colorado. The roadway was never constructed. Enclosed is a copy of a map showing in yellow
the roadway to be vacated. The location of the actually constructed road is shown on the map in
pink. The part shown in blue bisects property which the Weld County Assessor lists as being
owned by"Intrawest Bank of Greeley Trustee, c/o PDS Tax Services." That property is located
in Section 6-4-65. Those parcels are shown on the map with green crosshatch. I have sent a
letter to such owner asking if there is a desire to request that the roadway marked in blue also be
vacated.
A copy of the "Road-Viewers Report"which created the public roadway is also enclosed.

from the actually constructed road through Section 6-4-65, the Board of County Commissioners
could consider such request if made by the adjacent property owner. Please let me know in
writing no later than March 11, 2005, if you desire to make such a request. Any such writing

SUBJECT: WCR 37.7, William and Charles Jerke
Request Petition to Vacate a portion of WCR 37.7 between
WCR 37 and WCR 39
Weld County Public Work has reviewed the road viewers report adopting as recommended;
Road Declared Public Highway, also vacating of portions of old road (100/77) recorded in Book
7, Page 51, dated 1/15//1895. The descriptions as follows:
A strip of land sixty feet wide running north and south through the centre of the Northeast 1/4 of
Section 6, Township 4 North, Range 65 West, of the 6th P.M> for a right-of-way for a county
wagon road as the same is now laid out and located upon said described land.
The main street in LaSalle running south was readjusted back to the section line. The proposed
roadway was never constructed.
Public Works would support the WCR 37.7 vacation as we have no future plans to utilize that
right-of-way.
