HomeMy WebLinkAbout20051337.tiff 310 RESOLUTION RE: APPROVE VACATION OF USE BY SPECIAL REVIEW PERMIT #1432 - MARK AND KRISTI WEIMER WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, by Resolution dated December 31,2003,the Board approved Use by Special Review Permit#1432 for a Business Permitted as a Use by Right or Accessory Use in the Industrial Zone District(parking of company vehicles and equipment)in the A(Agricultural)Zone District for Mark and Kristi Weimer on the following described real estate, to-wit: Lot A of Recorded Exemption#2612;being part of the SE1/4 of Section 22, Township 6 North, Range 64 West of the 6th P.M., Weld County, Colorado WHEREAS,the Board has received a request from Mark and Kristi Weimer, 27725 Weld County Road 66,Gill,Colorado 80624-9519,to vacate said Use by Special Review Permit#1432, and WHEREAS,the Board of County Commissioners heard all of the testimony and statements of those present,studied the request of the applicant and the recommendations of the Department of Planning Services staff and all of the exhibits and evidence presented in this matter and,having been fully informed, deems it advisable to approve said vacation. The Weimer's are requesting that USR-1432 for a site specific development plan and use by special review permit for a business permitted as a use by right or accessory use in the industrial zone district (parking of company vehicles and equipment) in the A (Agricultural) Zone District be vacated. The Weimer's initially asked to have their application to be vacated after receiving the attached letter from staff dated April 8, 2004. After conversation with the Department of Planning Services the applicants agreed to attempt to finish the application. Three letters have been sent since. The last letter dated March 22, 2005 was sent certified notifying the Weimer's that if no response was received within ten days the Department of Planning Services would utilize their original letter dated April 15, 2004 to vacate the Use by Special Review. No comments have been received from Kristi and/or Mark Weimer. Background information: Legal Description: Lot A of RE-2612; being part of SE4 of Section 22, T6N, R64W of the 6th P.M., Weld County, CO. Location: North of and adjacent to CR 66 (Carlton Road) and approximately 1/4 mile west of CR 57. It is at this time that we are formally withdrawing our application for a Use by Special Review (specifically USR-1432). We are currently pursuing other means to accomplish what we were trying to do with this USR. We are hoping this does not hinder us if we decide to pursue this again.
