of the subdivision process may not be all-inclusive, as other concerns or issues may arise during the remaining
application process.
Comments
LI Weld County Department of Public Works has reviewed this case through another earlier referral. This
request appears to only involve lot line adjustments with the access remaining as previously documented.

Recommendation

RE: Case Number RS-1072: Redesign of Western Dairy Men Cooperative PUD
Jacqueline:
The Colorado Division of Wildlife has reviewed the Redesign of Western Dairy Men Cooperative PUI)project.
We conducted a site visit on 09/14/04. The approximately 55 acre site is located immediately south of Highway
119,between Weld County Roads 7 and 7 'A. The site includes oil operations but is otherwise undeveloped. There
is a dirt access road off of CR 7 A. The vegetation includes short-grass prairie and wetland vegetation surrounding
several ponds. We observed an active prairie dog colony visible from Highway 119. The area is suitable habitat
for small ground-dwelling mammals, songbirds,raptors,and waterfowl.
The proposal is to redesign the layout for 19 lots on the property and to make them accessible from both Highway
119 and CR 7 %. The redesign places the lots closer to Highway 119 and leaves about 18 acres of open areas
northeast and south of the lots.
The Colorado Division of Wildlife advises implementing the proposal to minimize negative impacts on wildlife
and to maximize any remaining open areas for use as wildlife habitat. Therefore,we recommend the following:
• Since prairie dogs are present on the proposed development area we recommend that they either be
captured alive and moved to another location or humanely killed before any earth-moving over their
burrows occurs.
• Burrowing owls are classified as Threatened in Colorado and killing one is illegal. They live in prairie dog
holes and we suggest a survey for the presence of burrowing owls prior to any earth-moving. They are
susceptible to being buried and killed by construction activity.
o if construction takes place between November 1 and February 28, it is very unlikely that owls
would be present since they migrate out of the state during the winter.
o The Division suggests a ground-nesting bird survey prior to construction if the activity is going to
take place any time between March 1 and October 31.
• Wetland areas are important habitat for many species. We recommend preservation of vegetation buffer
zones to maintain the high habitat value of these areas.

• The spread and control of noxious weeds on the sites is a concern of the CDOW and for wildlife. The
CDOW recommends implementing weed control practices. We suggest performing any re-vegetation or
landscaping with native trees and a mix of native grasses that will restore short-grass prairie habitat.
