RESOLUTION RE: DECLARING INTENT TO CREATE SOUTHWESTERN WELD COUNTY LAW ENFORCEMENT AUTHORITY WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS,Section 30-11-401,et seq.,C.R.S.,the Law Enforcement Authority Act of 1969, provides the authority to create law enforcement authorities and directs the procedures for establishment thereof, and WHEREAS, the growth in the southwestern portion of Weld County, and proposals for further development, including Adler Estates Planned Unit Development, has created a demand for law enforcement which exceeds the resources available to the Weld County Sheriff, and WHEREAS,a law enforcement authority is intended to insure the provision of more intensive law enforcement required for a residential development in an unincorporated area of the County located away from existing municipalities, and WHEREAS,after discussions between the Weld County Sheriff's Office,the Weld County Attorney's Office, and the Director of Finance, it appears from the legal and fiscal standpoint that the creation of a law enforcement authority is necessary and appropriate in order to provide adequate law enforcement in the southwestern portion of Weld County in general,and Adler Estates Planned Unit Development, in particular, and WHEREAS, a petition signed by 100% of the owners and electors for the proposed law enforcement authority has been submitted to the Board of County Commissioners, WHEREAS,the area to be included within the initial law enforcement authority is a tract of land located in the Southeast Quarter(SE1/4)of Section 33,Township 3 North, Range 68 West of the 6th P.M.,Weld County, Colorado, being more particularly described as follows: Commencing at the southeast corner of Section 33,whence the east one-quarter corner of Section 33 bears north 00°19'30"west 2651.44 feet;thence along the east line of the Southeast Quarter of Section 33 north 00°19'30"west 412.64 feet to the point of beginning;thence leaving said east line south 47°14'44" west 231.97 feet;thence north 54°03'07"west 320.48 feet;thence north 89°40'30"east429.59 feet to a point on the east line of the Southeast Quarter of Section 33;thence along said east line south 00°19'30"east 33.10 feet to the point of beginning;containing 1.000 acres, more or less,excepting all interests in the mineral estate, and WHEREAS,use of the Southwestern Weld County Law Enforcement Authority will provide more adequate law enforcement for persons residing in developed or developing unincorporated areas of Weld County, will prevent the crime rate from rising therein, and will better assist police, sheriff, and other law enforcement agencies in prevention of crime and in the detection and apprehension of criminal offenders, and WHEREAS, the procedural requirements of Section 30-11-401, C.R.S., have been met, including publication in a newspaper of general circulation in the area of authority once a week,for at least three consecutive weeks,of notice of the date,time,and place of the meeting whereby this Board considered the action contemplated herein. and 11111111111111111111 11111 I I I I 111111 I I I 11111 I I I I I I I I 2005-2233 3493477 07/30/2007 02:07P Weld County, CO SD0118 1 of 11 R 0.00 D 0.00 Steve Moreno Clerk& Recorder • INTENT TO CREATE SOUTHWESTERN WELD COUNTY LAW ENFORCEMENT AUTHORITY PAGE 2 WHEREAS, the Board of County Commissioners finds it has jurisdiction herein. NOW,THEREFORE,BE IT RESOLVED that the Board of County Commissioners of Weld County,Colorado, hereby declares its intent to create an Authority pursuant to Section 30-11-401, et seq.,C.R.S.,which shall be known as the Southwestern Weld County Law Enforcement Authority (hereinafter referred to as"SWWCLEA"). BE IT FURTHER RESOLVED that the SWWCLEA shall be deemed created thirty days following the canvass of votes cast at the election indicating approval of the creation of the Authority, which election shall be held on the 1st day of November, 2005. BE IT FURTHER RESOLVED that the polling place shall be the office of the Weld County Clerk and Recorder,and the election shall be by mail-ballot election pursuant to Section 1-7.5-101, et seq, C.R.S. The precinct for this election is the area proposed to be included within the SWCLEA. Persons eligible to vote may vote at the vote center located at the Southwest Weld County Service Center, 4209 County Road 24'/ (Del Camino) on November 1, 2005 between the hours of 7:00 AM and 7:00 PM. The vote center will also be open for early voting from 8:00 AM to 5:00 PM Monday, October 17, 2005, through Friday, October 21, 2005, and Monday, October 24, 2005, through Friday, October 28, 2005. Applications for absentee ballots can be submitted at the Election Department of the Weld County Clerk and Recorder's Office for the election through October 21, 2005. Applications can be made in person at 1402 N 17th Avenue, Greeley or by mail: PO Box 459, Greeley, Colorado, 80632.
