The Weld County Health Department has reviewed this final plat application. This PUD was
approved by the BOCC on August 18, 2004 for 6 lots, all served by individual wells. Prior to
recording the Change of Zone plat the applicant submitted a proposed plat showing the
proposed location of each well placement on the lots and the location of the primary and
secondary septic envelopes. This well-septic envelope setback was approved by email to Sheri
Lockman. However, it was noted in that email correspondence that the proposed well locations
have been placed approximately 10 feet from each property line. While this placement is no
concern for Lots 1 and 6 because the wells are placed adjacent to open space, the placement
could be of concern for Lots 2 through 5. Adjacent property owner activities could have a
negative impact on the well.
I spoke to Scott Ohm, Land Images, Inc, the applicant's representative on August 4, 2005 about
the well's proximity to the property line for Lots 2 through 5. I explained the Department's
concerns and asked that the wells be relocated on the lot within the latitude of Condition 9 of the
well permits. Ideally, wells would be placed a minimum 100 feet from property lines (a common
industry standard for protection from potential sources of contamination). This may be difficult
for Lots 4 and 5, based on lot configuration. Wells must still also meet the 100 foot setback to
any septic envelope (septic envelope movement to accommodate the new well placement is
acceptable). Mr. Ohm is agreeable to the requested changes. The Department requests to
review and approve the septic envelope and well locations prior to recording the Final Plat.
The Department recommends that the following plat note be amended to read:
1. Primary and secondary septic envelopes on each lot must meet all setbacks,
including the setback to a potable water supply line all wells.
This plat note particularly applied when the application was review where 2 lots shared a well and
the well was placed in the open space. While it still applies, it is much less likely to be a
problem with each lot served by it's own well.
All plat notes appear to be correct as approved.
The application was approved with the following Department recommended conditions being
placed as notes on the plat:
1. Water service shall be obtained from 6 individual wells.
2. This subdivision is not served by a municipal sanitary sewer system. Sewage
disposal shall be by septic systems designed in accordance with the regulations of
the Colorado Department of Public Health and Environment, Water Quality Control
2005-2467
Division and the Weld County Code in effect at the time of construction, repair,
replacement,or modification of the system. Septic systems shall be designed for site
specific conditions including, but not limited to, shallow groundwater, bedrock,gravel
and/or clay.
3. Primary and secondary septic envelopes on each lot must meet all setbacks,
including the setback to a potable water supply line.
4. Language for the preservation and/or protection of the absorption field envelopes
shall be placed in the development covenants. The covenants shall state that
activities such as permanent landscaping,structures,dirt mounds,animal husbandry
activities,or other activities that would interfere with the construction, maintenance,or
function of the fields should be restricted over the absorption field areas while in use.
5. If required,the applicant shall obtain a storm water discharge permit from the Water
Quality Control Division of the Colorado Department of Public Health and the
Environment. Silt fences shall be maintained on the down gradient portion of the site
during all parts of the construction phase of the project.
6. During development of the site, all land disturbances shall be conducted so that
nuisance conditions are not created. If dust emissions create nuisance conditions,at
the request of the Weld County Health Department, a fugitive dust control plan must
be submitted.
7. In accordance with the Regulations of the Colorado Air Quality Control Commission
any development that disturbs more than 5 acres of land must incorporate all
available and practical methods that are technologically feasible and economically
reasonable in order to minimize dust emissions.
8. If land development creates more than a 25-acre contiguous disturbance,or exceeds
6 months in duration, the responsible party shall prepare a fugitive dust control plan,
submit an air pollution emissions notice, and apply for a permit from the Colorado
Department of Public Health and Environment.
9. "Weld County's Right to Farm" as provided in Appendix 22-E of the Weld County
Code shall be placed on any recorded plat.

Cluster PUD final plan for six residential lots and one agricultural out lot
1. A separate building permit shall be obtained prior to the construction of any building.
2. A plan review is required for each building. Plans may require the wet stamp of a Colorado registered
engineer or architect. Two complete sets of plans are required when applying for each permit.
3. Buildings shall conform to the requirements of the codes adopted by Weld County at the time of permit
application. Current adopted codes include the 2003 International Residential Code; 2003 International
Building Code; 2003 International Mechanical Code; 2003 International Plumbing Code;2003 International
Fuel Gas Code; 2002 National Electrical Code and Chapter 29 of the Weld County Code.
4. Each building will require an engineered foundation based on a site-specific geotechnical report or
an open hole inspection performed by a Colorado registered engineer. Engineered foundations shall be
designed by a Colorado registered engineer.
5. Fire resistance of walls and openings, construction requirements, maximum building height and
allowable areas will be reviewed at the plan review. Setback and offset distances shall be determined
by the Zoning Ordinance.
6. Building height shall be measured in accordance with the 2003 International Building Code for the
purpose of determining the maximum building size and height for various uses and types of construction
and to determine compliance with the Bulk Requirements from Chapter 23 of the Weld County Code.
Building height shall be measured in accordance with Chapter 23 of the Weld County Code in order to
determine compliance with offset and setback requirements. When measuring buildings to determine
offset and setback requirements, buildings are measured to the farthest projection from the building.
Property lines shall be clearly identified and all property pins shall be staked prior to the first site
inspection.

Weld County Public Works Department has reviewed these final plan materials and has the following development
referral comments.
Comments
❑ The Final Drainage Report for Antelope Estates PUD, dated June 25, 2003, by Northern Engineering Services, Inc. (Project
Number AEP: 01-044)is acceptable to Public Works.
o The department will keep the sealed report in the case file for use during the construction phase.
❑ The applicant has submitted an Improvements Agreement According to Policy Regarding Collateral for Improvements (Private
Road Maintenance), which is acceptable to Public Works. The Board of County Commissioners prior to recording the final plat
shall approve the agreement.
❑ The applicant has submitted an Agreement for Improvements for WCR 17 Road Stabilization for Dust Control, which is
acceptable to Public Works.The Board of County Commissioners prior to recording the final plat shall approve the agreement.
❑ Public Works has reviewed (July 2005) Antelope Lane Plan and Profile/Grading Plan, by DMW Civil Engineers. The drawings
are generally acceptable to Public Works.
o The Typical Section—Interior Streets must be amended by deleting the option of full depth asphalt on Sheet 1.
o The Grading&Erosion Control Plan(Sheet 2)must be amended to correct the cul-de-sac right-of-way radius to 65'.
o The engineer shall show the location(s) of silt fence required during construction activities, which is in accordance
with standard erosion control plans(Sheet 2).
o The engineer shall prepare a construction detail for typical lot grading with respect to drainage for the final plan
application. Front, rear and side slopes around building envelopes must be addressed. In addition,drainage for rear
and side lot line swales shall be considered. Building envelopes must be planned to avoid storm water flows, while
taking into account adjacent drainage mitigation.
o The plans must be resubmitted to Public Works. All drawings must be sealed by the engineer of record,before the
Department will permit the case to proceed through the development process and before the plat may be recorded.
This is consistent with County Code: Sec 24-3-50.
o Certified drawings will remain in the department's file for use during construction.
❑ The applicant shall specify the thickness of aggregate base course for the interior street cross-section in correlation with the
Preliminary Geotechnical Subsurface Exploration Report produced by Earth Engineering Consultants, Inc. (June 2001). Weld
County requires a minimum of 4"thick Class 6 aggregate base course.
❑ The applicant must submit three (3) additional sets of final roadway, drainage, utility / construction plan drawings (stamped,
signed, and dated)to Public Works for Weld County Field Inspectors' use during construction of the subdivision.
❑ The applicant or their agents may be required to obtain permits from Weld County's Public Works - Utility Agent, for each
utility.
Recommendation
❑ The above comments are prerequisites and shall be fulfilled prior to recording the final plat.
Any issues shall be resolved with Public Works prior to recording of the final plat.

Dear Ms. Lockman:
We have reviewed the above referenced proposal to subdivide a 121.44-acre parcel into
six residential lots. The State Engineer's Office previously commented on this proposal by our
letter dated May 20, 2004.
Information from this submittal indicates that this is the Final Plat for this development
and water is to be provided by individual on lot wells. In our previous letter dated May 20, 2004
(copy enclosed), we indicated that based on additional information from the applicant, it was our
understanding that Antelope Estates PUD was being created pursuant to Weld County's Rural
Land Use process. Well permit nos. 260827, 260828, 260829, 260830, 260831 and 260832
were issued on May 19, 2005 in accordance with C.R.S. § 37-92-602(3)(b)(II)(A) for Lots 1
through 6 of the Antelope Estates PUD, cluster development. Each well was permitted to
withdraw 0.5 acre-feet annually to serve one single-family dwelling per lot. In addition to the
single-family dwelling, each well could be used for lawn and garden irrigation and domestic
animals watering consistent with the amount of water approved. Such amount, in addition to the
single-family dwelling, will typically allow for the irrigation of 3,000 square-feet of lawns and
gardens and the watering of a few domestic animals. Furthermore, each well will be the only
well on that cluster development lot.
Since no changes in the water supply for the Antelope Estates PUD were identified in
this submittal, the comments from our letter dated May 20, 2004 still apply.

Dear Mr. Lockman:
We have reviewed additional information received on May 12, 2004 from Mr.
Michael Chalona from Land Images, Inc. on the above referenced proposal to subdivide
a 121.44-acre parcel into six residential lots. Although we have-not received a formal
request by the county to review this additional information, in an effort to assist the
county the State Engineer's Office offers the following comments.
In our latest letter to the county dated April 6, 2004 we indicated that a water
court approved plan for augmentation is required for Antelope Estates PUD and
pursuant to Section 30-28-136(1)(h)(I), C.R.S. the proposed water supply will cause
material injury to decreed water rights and is inadequate.
In a letter dated May 11, 2004, Mr. Michael Chalona clarified that Antelope
Estates PUD is being created pursuant to Weld County's Rural Land Use process and
meets the requirements of a cluster development. According to Section 30-28-402
C.R.S., a cluster development requires that at least two-thirds of the total area of the
subject tract be reserved as open space. For Antelope Estates PUD, 80.96 acres of
the 121.44 acres would be required to be reserved as open space. According to this
statute, if this requirement is met, 6 lots (3 lots plus 3 bonus lots) could be developed
on the remaining acreage. In accordance with Section 30-28-404, C.R.S. the State
Engineer's Office could then evaluate well permits for individual on-lot wells, which
would be permitted to withdraw 0.5 acre-feet annually to serve one single-family
dwelling per lot. In addition to the single-family dwelling, the well could be used for lawn
and garden irrigation and domestic animals watering consistent with the amount of
water approved.

^ Furthermore, Section 37-92-602(3)(b)(II)(A) C.R.S., states that if a permit is
sought by a user for a well to "be the only well on a cluster development lot, serving one
single-family residence where the ratio of water usage in a cluster development does
not exceed one acre-foot of annual withdrawals for each thirty-five acres within the
cluster development"..."there shall be a presumption that there will not be material
injury". Within the 121.41 acres, there could be no more than three tracts of 35 acres.
To preserve the statutory presumption of no material injury, the usage will be limited to
3 acre-feet and if there are six lots, there would be 0.5 acre-foot per lot available (3
acre-feet/6 lots = 0.5 acre-foot per lot). Based on this approach, the existing well permit
nos. 244991, 244992 and 254371 previously proposed to supply this development
could be canceled and six new well permits may be issued in accordance with the
provisions of subparagraph (II) of Section 37-92-602 C.R.S., to withdraw 0.5 acre-feet
annually. However, the Division of Water Resources cannot guarantee issuance of any
well permit, prior to a completed review of an application.
If the county approves this development, please ensure you notify this office of
your approval within the statutory requirement of ten days, and provide a copy of the
plan, with a detailed plat map of the development so we can plot the development on
our maps and include the information in our files.

To Whom It May Concern,
The Weld Re-9 School district has reviewed the plans and information for
the Antelope Estates Subdivision as referenced in PF:604. The District
requests a cul-de-sac turn around with a 45 foot turning radius. The plans for
this property do meet this requirement. In addition to the transporation
requirements, the district would require an in-lieu of fee for the six lots being
created.
The total in-lieu payment per parcel of land separated from the original unit
with the intent of future residential development is $759. The plan for the
property described in PF: 604 will result in six new residential lot being
created; therefore, your total in-lieu payment will be $4,554.00.
Payment should be hand delivered to the Weld RE-9 School District
Administration Office, 210 West First Street, Ault, or mailed to Weld RE-9
School District, P.O. Box 68, Ault, Colorado 80610. Please include your
Recorded Exemption (RE) number for reference. A receipt will be mailed
to the party requesting the exemption.
