The purpose of this application is to amend an existing Subdivision Exemption known as Subdivision Exemption No . 162 which was approved on or about July 14, 1982 . Subdivision Exemption No . 162 was approved as a means of correcting legal descriptions, lot lines and lots which were in a state of confusion prior to the approval of the Subdivision Exemption. The approval of the Subdivision Exemption resulted in the creation of two parcels . The first Parcel "A" totaled 23 .42 acres and the second Parcel "B" was a parcel of 122.86 acres. Subsequent to this approval it became obvious that Parcel "B" could not efficiently be utilized due to the fact that Parcel "B" was divided by the Greeley Loveland Irrigation Ditch. The owners of the property, Don and Judy Roth, were informed that the Greeley Loveland Irrigation Company would not permit a bridge to be erected across the ditch , therefore , Parcel "B" is , in reality, two separate and distinct parcels due to the ditch. The purpose of this request is to amend the existing Subdivision Exemption which will still result in two lots . Parcel "A" is not changed in any manner, however, Parcel "B" will now be that land South of the North bank of the Greeley Loveland Irrigation Ditch which totals 80 .16 acres . Therefore, this • • Weld County Department of Planning Services November 21, 1990 Page 2 request is to amend the Subdivision Exemption to approve Parcel "A" which does not change and remains as 23 . 42 acres but Parcel "B" will now be 80 .16 acres . The remaining land located North of the Greeley Loveland Irrigation Ditch by virtue of being 42 . 7 acres is a valid and legal parcel on its own due to the fact that it is in excess of 35 acres. This 42 .7 acre parcel has one residence located upon it and should be considered as a separate parcel . The newly created parcel "B" being 80 . 16 acres and located South of the Greeley Loveland Irrigation Ditch can also be considered as a separate and distinct parcel of land due to the fact that exceeds 80 acres and thus would qualify for a building permit on its own as it contains 80 acres which is the minimum required upon irrigated land. This Amended Subdivision Exemption is beneficial as it properly recognizes the fact that the land is actually two parcels of land due to the irrigation canal and the property can then be properly utilized with the South parcel of 80 acres being used for residential and irrigated crop production and the North parcel used for residential and dryland farming. This proposal is consistent with the Weld County Comprehensive Plan as well as the Master Plan of the City of Greeley due to its location and existing use. The master plan of the City of Greeley desires to keep residential development at one unit per twenty acres within its urban growth boundaries . This Amended Subdivision Exemption results in three parcels land, one being 23 .42 acres, the second being 80 .16 acres and the third being 42.7 acres . Thus it is consistent with both Weld County and Greeley in relation to their plans. Additionally these uses are compatible with existing surrounding land uses which consist of agricultural and rural residential . We would request your approval of this Amended Subdivision Exemption. Planning Services 915 Tenth Street Greeley, Colorado 80631 Re: Subdivision Exemption Gentlemen: Attached to this letter are application requirement documents including the application form and attachments, two plot maps, and your application fee in the amount of $35.00. The main purpose of this subdivision exemption is to adjust property lines between two contiguous parcels of property. I would add that both of these parcels are currently owned by Don and Judy Roth. At the present time, Parcel "A" consists of 27.68 acres and Parcel "B" consists of 118.60 acres. The existing legal description of Parcel "A" is attached to this letter marked as Exhibit "1". The existing Parcel "B" is described in a legal description attached to this letter as Exhibit "2". The purpose of this subdivision exemption is to change the property lines between the exising Parcel "A" and Parcel "B" and to create a new Parcel "A" and new Parcel "B". The legal description of the land being transferred from existing Parcel "A" to Parcel "B" is attached to this letter and marked Exhibit "3". I would add that the new Parcel "A" will consists of 23.42 acres and the new Parcel "B" will consists of 122.86 acres. The new legal description of the new Parcel "A" is attached to this letter as Exhibit "4" (and is also contained on the plot map), and the new legal description of the new Parcel "B" is attached to this letter as Exhibit "5" (it is also described on the plot map). The practical request behind this subdivision exemption is that when the original property was divided into two parcels, the boundary line between "A" and "B" was impractical as it did not follow what is commonly called the "Ashcroft Draw". The result of not having the property lines along the Ashcroft Draw resulted in a large portion of acreage in both Parcels "A" and "B" being unavailable for any type of farming or other agricultural use due to the draw. The new boundary line between the properties is a common-sense boundary line following the Ashcroft Draw and allows the acreage in both Parcels "A" and "B" • Weld Co. Planning Services June 21, 1982 Page Two to be used for certain agricultural purposes. It should also be mentioned that it is the intent of the applicants to sell Parcel "A" and the new boundary lines will make the sale of Parcel "A" much more feasible and practical as there is no substantial amount of wasteland as prior to this request. Additionally, Parcel "B" below the ditch is now a full 80-acre irrigated parcel, which more fully complies with the policies of Weld County for agricultural land. It is the request of the applicants that this subdivision exemption be granted as it does comply with the policies of the Weld County Comprehensive Plan, and the two parcels created are compatible with surrounding land uses which are basically small agricultural and residential parcels in the west Greeley area.
