RESOLUTION
RE: GRANT AMENDMENTS TO THE DEVELOPMENT STANDARDS OF THE UNIT
DEVELOPMENT PLAN IN A C-3 COMMERCIAL DISTRICT FOR NICK AND
FRED SEKICH
WHEREAS, the Board of County. Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home Rule

Charter, is vested with the authority of administering the affairs
of Weld County, Colorado, and
'.� WHEREAS, a public hearing was held on the 13th day of January,
1982 at 2: 00 o' clock p.m. for the purpose of hearing the application
of Nick Sekich, Jr. and Fred Sekich, I-25 and State Highway 66, Mead,

Colorado 80542, requesting amendments to the development standards of
the unit development plan in a C-3 Commercial District covering the
following described parcel of land, to-wit:

WHEREAS, on January 30, 1980 the Board of County Commissioners

approved a change of zone from A Agricultural to C-3 Commercial District,
on the above described parcel, with a unit development plan and subject

to certain development standards, and

WHEREAS, the Weld County Planning Commissions ' resolution for
7 a favorable recommendation, dated December 1, 1981, failed with a
tie vote, and
WHEREAS, the Board of County Commissioners heard all the testimony
and statements of those present, has studied the request of the
applicants, and having been full informed finds as follows :
That the original change of zone was granted to accomodate
an agribusiness that would not be appropriately located
near a municipality; however, the only major change requested
is to development standard #3. Said change would allow
for outside storage of equipment, supplies, etc. of a
nature other than farm related. The Board does not feel
that this change is detrimental to the future develop-
ment of the area.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners
that the application of Nick and Fred Sekich, for amendments to the
development standards of the unit development plan be, and hereby is,
granted.
BE IT FURTHER RESOLVED that the amended development standards
are attached hereto and incorporated herein by reference.

DEVELOPMENT STANDARDS FOR SEKICH PLANNED UNIT
DEVELOPMENT
1. The permitted uses within the Commercial Unit Development area may
be those used as listed on C-3 the Commercial Zone District of the
1 Weld County Zoning Ordinance. Agricultural production will be
permitted. If agricultural production is not pursued on all or any
portion of the Commercial Unit Development that portion not in
agricultural production shall be maintained in a manner so as to
prevent fugitive dust, erosion, growth of noxious weeds, and
non-ornamental ground cover shall not exceed 12 inches in height.

2. Display of merchandise may be permitted. For purposes of this
:j statement "Display merchandise" is defined as representative
samples of the business inventory or product, which are put on
display for the purpose of informing the public and attracting
business, and which are displayed in a neat and acceptable manner.

3. Outdoor storage shall be limited equipment, goods, materials,
r Vr supplies, and vehicles associated with uses allowed in a C-3
'N District.
4. Minimum setback for structures shall be 160 feet from State Highway
right-of-way. Side and rear setbacks shall be in compliance with
_ the requirements for Commercial zoning in the Weld County Zoning
Resolution.

ct hi 5. All signs located on the unit development area shall be in
compliance with the requirements of the Weld County Zoning
Ordinance.

6. The unit development area shall be maintained in such a manner so
:1 as to prevent soil erosion, fugitive dust and the growth of noxious
weeds.

7. All construction and electrical work shall be done in accordance
with the Weld County Building Code.
8. Access to Colorado Highway 66 shall be limited to one 35 foot
commercial access as shown on the unit development plat. All
accesses shall have the approval of the Weld County Engineering
Department and/or the Colorado Division of Highways. All accesses
shall be constructed in accordance with the recommendations and/or
requirements of the Weld County Engineering Department and/or the
Colorado Division of Highways.
9. Use of property shall comply with all County and State Health
Standards and Regulations pertaining to air quality, water quality,
noise emission, and sanitary disposal systems.
10. Lighting shall be arranged to minimize illumination onto adjoining
property and to prevent glare directed at vehicles on public right-
of-ways.
11. As shown on the Unit Development plans, reservation for the addi-
tional right-of-way for Colorado Highway 66 shall be thirty-five
(35) feet.

12. A 20 foot landscape strip shall be maintained along the north side
of the 35 feet of future right-of-way as shown hereon. The
landscaping may be vegetation, a hedge row, berm, wall or combina-
tion thereof. Maintenance of the 20 foot strip shall be the
responsibility of the owner and/or operator of subject property.
13. The Unit Development plan shall be limited to the plans submitted
and governed by the Development Standards stated above and
- applicable Weld County Regulations. Any material deviations from
the plans and/or Developmemt Standards as shown or stated above
shall require the approval of an amendment to the Unit Development
Plan by the Planning Commission.

I hereby certify that pursuant to a notice dated December 7, 1981 and
duly published December 10 and 31, 1981 in the Johnstown Breeze a
public hearing was held on the reqest of Nick and Fred Sekich for
an amendment to the Unit Development Plan of a COZ.
Rod Allison reviewed the Planning Staffs recommendation for denial.
At the Planning Commission' s meeting on this request a motion was made
for a favorable recommendation to the Commissioners; however, the
motion failed on a tie vote.
Thomas Hellerich, attorney for the applicants, elaborated on the request.
Several area residents and landowners were present and testifyed on
behalf of the applicants and their request.
There was no one present in opposition to said request.
Following discussion Commissioner Steinmark made a motion to approve
the amendments to the development standards 1, 3, & 4 . Commissioner ,
Steinmark stated that this parcel was zoned C-3 because of the proposed
agribusiness use; however, the only major change being requested by
the applicants is to allow outside storage of equipment and she doesn't
feel that thiswill be detrimental to the future development of the area.
Commissioner N. Carlson seconded the motion and it carried unanimously.

Colorado, to-wit:

for the following reasons:
Bee use tha proposed amendment that is basicallyto allow outside storage is compatible
wit' the area and with the current zoning that is on the area. The nature of the
corn :1r of this intersection does lend itselt to this. If it were zoned agriculturally
would probably go the other way but, since it is commercially zoned it could
probably have almost anything there that could be inside. This is probably a good
place for this type of operation although it may not be the best place. There
could probably be other places up and down Interstate 25.

NOTES:
Bill Diehl: Felt this is probably an ideal location for this type of business.
The company would also be able to bypass most towns and congested areas because
they would be traveling on the interstate and would not have to go through
these areas to gain access to the interstate. As far as weight permits go---
if they located in Denver, they would have to get a weight permit everytime they
moved through town. "I feel there is a need for this type of business in this
area or they would not be trying to establish this type of business in the
area. I can see no objection to a zone change as far as (this location) on
I-25 is concerned".
Jack Holman: Felt on the outskirts of a city or municipality there are other
areas just as suitable as this where they could be located and it would not
facilitate an amendment to this change of zone.
Bob Ehrlich: Because of the size of this equipment it is important that it
be located near an interstate highway rather than a city or municipality. It
is probably best to stay away from congested areas. He could not see this business
is any different than Sekich Equipment except for the fact the equipment would
be rented.
Fred Otis: "My vote is based on the fact that the Department of Planning Services
staff has recommended denial, which I feel is correct. Secondly, I believe
the emphasis is on one applicant who may or may not have persuaded me that this
is a great place to put this, and there may be other places around the immediate
vicinity to put it, but the problem is that once we change this (the Develop-
ment Standards) we have opened up Pandora's Box to all commercial uses and I
do not think this was the intention of the Planning Commission in earlier
actions. Previously, it was intended to allow all agricultural related uses
and I do think this fits. I think we are opening up that specific piece of
property for other commercial uses that we do not intend to have and don't
want. We don't know that Essex will be there forever. If we could get a
guarantee like that I might feel differently, but we can't get that kind of
guarantee and, therefore, I will vote agains the motion".
Jerry Kiefer: Being close or far away from a municipality to him was a critical
point. He felt the location was appropriate for this type of an operation.
He agrees with Bill Diehl that this is probably a good place for this type
of operation, although he is not sure it is the best place.
Bob Halleran: Because, primarily, while he agrees that a business of this
type should be located outside a municipality, there are several other areas

using this piece of ground. Based on staff comments, because the use and
appearance of the site would not be controlled and the existence of comprehensive
policy, stated above,which addressed commercial uses. Again, it is also my
opinion that the request should be denied.

LEGAL DESCRIPTION: Part of the SW4, Section 23, T3N, R68W of the 6th P.M.
LOCATION: One mile east and two miles south of the town of Mead.
The request is to change development standards one (1) , three (3) , and four (4) ,
and add a building to the site. The specifically referenced user, proposed to
locate on the property, is a crane rental company. If this use was interpreted as
farm equipment, supplies or vehicles no change to standard number three (3) would
be required. The position of the staff is that the crane company is not an agri-
business operation. The crane equipment is not recognized as farm equipment,
supplies, or vehicles by the staff and therefore, would necessitate a change to
Development Standard ##3 to permit it on the site as outdoor storage.
THE DEPARTMENT OF PLANNING SERVICES STAFF RECOMMENDS THAT THIS REQUEST BE DENIED
FOR THE FOLLOWING REASONS:
1. It is the opinion of the Department of Planning Services Staff that the
applicant has not adequately demonstrated in the submitted application
materials or in oral statements made prior to the scheduled Planning Commission
Meeting how the proposal to amend the Unit Development Plan is consistent
with the policies of the Weld County Comprehensive Plan. Furthermore, it is
the opinion of the Planning Services staff that the request is not consistent
with the policies of the Weld County Comprehensive Plan. The following
policies, found on pages 61 and 62, of the Weld County Comprehensive Plan
address commercial developments. The policies are as follows:
"Commercial development will not be encouraged in the unincorporated
areas of the County unless it can be shown by the developer that
the proposed commercial use cannot reasonably be located in an
urban area"; and "Commercial development designed to serve the
agricultural base of the County should be located wherever practical
within a municipality; however, whenever distance from a municipality
makes this an impractical or unprofitable establishment of such
commercial service, facilities within easy access to each agricultural
area will be encouraged".
The present proposal would not provide a commercial area to promote
agri-business uses as originally intended. Rather, it would allow all
uses of the C-3 (Commercial District) . Therefore, because the use and
appearance of the site would not be controlled, and the existence of
the Comprehensive Plan Policies stated above which address commercial
uses, it is the opinion of the staff that the proposed request is not
in compliance with the Comprehensive Plan.
2. The past history of this site and adjoining properties similarly zoned
includes four (4) change of zones and one Special Use. The fourth
change of zone was withdrawn and resubmitted as a Special Use because
the regulations had been changed to permit the agri-business uses by
Special Use permit.
The three (3) change of zones were granted under specific unit development
guidelines intended to permit the agri-businesses, but restrict or
control nonagri-business commercial uses (this action deemed consistent
with Comprehensive Plan policies) . In February of 1980, an amendment to
the Zoning Resolution permitted the agri-business uses to be allowed by
Special Use Permit in the Agricultural District to improve the control
of these uses and lessen the possibility of nonagri-business uses
locating on sites zoned to permit agri-businesses.
To vary from the original intent (as shown in the submittal information'
of the above referenced change of zone requests and as shown in the
actions of the Planning Commission and Board) may encourage consideration
as a changed condition for this location. In the staff opinion, such a
changing condition may be harmful to future planning efforts in this
area of the County.

3. It is the opinion of the Department of Planning Services staff that the
commercial uses which would be allowed on the subject property, if the
current proposal were approved)would not be compatible with the surrounding
land uses. The applicant could establish any commercial use on the
property which would conflict with the desire to encourage agriculture
as the predominent land use for the area.
In general, the staff feels that the agri-business uses proposed on the
property are appropriate, but that the broad granting of uses inherent
in establishing the change in development standards is not, and would
conflict with the Weld County Plan. Under the former procedure, agri-
business uses could be established while avoiding (visibly) the establishment
of a broad range of commercial uses which, according to the plan, are
more appropriately established in municipal areas. Therefore, the staff
feels that amending the existing unit development standards for this
area would be incompatible with the Comprehensive Plan and adjacent land
uses. The action to allow commercial uses (other than agri-businesses)
creates a condition of spot zoning and, therefore, should not be allowed.

The current zoning on the above described property is "C" Commercial
Zone District with a unit development plan. The existing zoning was
approved January 30, 1980. The existing zoning and land development
standards were approved by the Planning Commission and the Board of
County Commissioners as consistent with the Weld County Comprehensive
Plan.
The requested change is for a change in the development standards to
establish the existing zoning as commercial "C-3" district consistent
with the new Weld County Zoning Ordinance adopted in 1981 and to allow
uses consistent with the existing zoning and the needs of the com-
munity. Under the present zoning the applicant can conduct any
commercial activity within the planned unit development. Under the
existing development standards, those commercial uses within the planned
unit development are to be conducted within the confines of the
structures to be built thereon. Further, outdoor storage under the
existing development standards is limited to farm equipment, farm
supplies and farm vehicles.
The existing structures and uses within the planned unit development are
Front Range Truck Sales and American Fertilizer and Chemical Company and
the storage of equipment, etc. relating to these businesses. Located
across Colorado Highway 66 from the planned unit development to the
south is Sekich Equipment Company, a farm equipment company and cafe.

With the growing changes in the economic development and the advance-
ments and changes in machinery and equipment necessary to meet the needs
of the community, this area of Weld County has become ideal for the
development of a commercial area to meet the needs of Weld County and
the surrounding area. The applicant is requesting a change in the
development standards to establish it as a commercial zoning as a "C-3"
district and to allow all uses within the planned unit development that
are permitted for a "C-3" district. Further, with the growing changes
and development in the community area and the changes in the number,
size and variety of machinery and equipment needed to meet the changing
needs of the community, the applicant finds it necessary to request that
the development standards be amended, consistent with the existing
zoning and the comprehensive plan of Weld County. The commercial zoning
has previously been approved and established by the Board of County Com-
missioners as consistent with the comprehensive plan, and the applicant
requests that the development standards be amended consistent with the
uses available under the commercial "C-3" district uses.
In addition to the existing uses presently within the planned unit
development, the applicant requests uses for a farm supply shop, farm
equipment shop, farm tire and sales shop, farm and truck repair shop,
and contemplates the immediate construction of facilities within the
planned unit development to accomodate the structure needs of Essex
Crane Rental Corporation. Essex Crane Company is in the business of
renting cranes for both agricultural and nonagricultural uses. Essex
Crane Company desires to build an office and storage and repair
facilities on the lands within the planned unit development to enable
the company to operate a crane rental business. This business would be
able to service the needs of Weld County and the surrounding area. The
applicant's land is ideally located for such a crane rental and storage
business to meet the needs of Weld County and the surrounding area.
Adequate water service is available and presently developed on the
property. Sewer service can be supplied by septic tank and leech field.
There appears to be no problem with either soil conditions or high water
tables. The road and highway facilities providing access to the
property are adequate in size to meet the requirements of the zone
district and the proposed development standards. Highway 66 services
the site, and there is an existing interchange with Interstate 1-25
within one-half mile of the development. Required setbacks, the
existing and future right-of-way reservations, and highway access as
they exist, and reservations are shown on the drawings attached to the
application. There are no known additional requirements to upgrade the
road and state highway facilities. The applicant has, at his own
expense, constructed the required road accesses needed to connect the
site with the State Highway Number 66.

As indicated in the prior application, the existing zoning and the
proposed change is not located within either a flood or geologic hazard
area, as identified by maps adopted by Weld County, and is not within a
known commercial mineral deposit as defined by Colorado Statutes. As
indicated in the original zoning application for the planned unit
development, the soil conditions on the site do not present limitations
to the construction of structures or facilities proposed to the site.

Range 68 West of the 6th P.M. , Weld County, Colorado, being more
particularly described as follows:
Beginning at the Southwest Corner (SW Cor) of said Section 23 and
considering the South line of the SW4 of said Section 23 as bearing
North 89°25' 17" East, with all other bearings contained herein relative
thereto;
Thence North 89°25' 17" East, along said South line, 2641.88 feet to the
South Quarter Corner (S 4 Cor) of said Section 23;

PROPOSED DEVELOPMENT STANDARDS
FOR SEKICH PLANNED UNIT DEVELOPMENT
1. The permitted uses within the Commercial Unit Development area may
be those used as listed on C-3 the Commercial Zone District of the
Weld County Zoning Agricultural production will be
permitted. If agricultural production is not pursued on all or any
portion of the Commercial Unit Development that portion not in
agricultural production shall be maintained in a manner so as to
prevent fugitive dust, erosion, growth of noxious weeds, and
non-ornamental ground cover shall not exceed 12 inches in height.
2. Display of merchandise may be permitted. For purposes of this
statement "Display merchandise" is defined as representative
samples of the business inventory or product, which are put on
display for the purpose of informing the public and attracting
business, and which are displayed in a neat and acceptable manner.
3. Outdoor storage shall be limited equipment, goods, materials,
supplies, and vehicles associated with uses allowed in a C-3
District.
4. Minimum setback for structures shall be 160 feet from State Highway
right-of-way. Side and rear setbacks shall be in compliance with
the requirements for Commercial zoning in the Weld County Zoning
Resolution.
5. All signs located on the unit development area shall be in
compliance with the requirements of the Weld County Zoning

6. The unit development area shall be maintained in such a manner so
as to prevent soil erosion, fugitive dust and the growth of noxious
weeds.
7. All construction and electrical work shall be done in accordance
with the Weld County Building Code.
8. Access to Colorado Highway 66 shall be limited to one 35 foot
commercial access as shown on the unit development plat. All
accesses shall have the approval of the Weld County Engineering
Department and/or the Colorado Division of Highways. All accesses
shall be constructed in accordance with the recommendations and/or
requirements of the Weld County Engineering Department and/or the
Colorado Division of Highways.
9. Use of property shall comply with all County and State Health
Standards and Regulations pertaining to air quality, water quality,
noise emission, and sanitary disposal systems.
10. Lighting shall be arranged to minimize illumination onto adjoining
property and to prevent glare directed at vehicles on public right-
of-ways.
11. As shown on the Unit Development plans, reservation for the addi-
tional right-of-way for Colorado Highway 66 shall be thirty-five
(35) feet.

12. A 20 foot landscape strip shall be maintained along the north side
of the 35 feet of future right-of-way as shown hereon. The
landscaping may be vegetation, a hedge row, berm, wall or combina-
tion thereof. Maintenance of the 20 foot strip shall be the
responsibility of the owner and/or operator of subject property.
13. The Unit Development plan shall be limited to the plans submitted
and governed by the Development Standards stated above and
applicable Weld County Regulations. Any material deviations from
the plans and/or Developmemt Standards as shown or stated above
shall require the approval of an amendment to the Unit Development
Plan by the Planning Commission.

and are on prime farmland soils.
2. There is no erosion control plan nor revegetation of
disturbed areas in the application, though it may be
developed later. We would recommend that it be done
prior to construction.
