Os Ed Orr, Property Owner Date Response to Department of Planning Services & Referral Agency Sketch Plan Comments Orr Estates PUD The following statements are intended to address each of the specific County regulations,goals and policies as outlined in the April 27, 2005 letter from the Weld County Department of Planning Services,and to ensure this project is in compliance with the Weld County Comprehensive Plan. ADHEREANCE TO THE WELD COUNTY COMPREHENSIVE PLAN GOALS AND POLICIES PUD.Goal S. — "Demonstrate that adequate facilities and public services are currently available or reasonable obtainable to serve the Planned Unit Development or zone district."—As indicated in the April 27, 2005 letter from the Weld County Department of Planning Services, the proposal is being identified as urban scale development. This proposal does have adequate water supply, which is evidenced by the North Weld County Water District will-serve letter. According to the PUD performance standards identified in Section 27-2-176, all PUD's considered urban scale development shall be served by an approved sewer system, as defined by the Board of County Commissioners. The developer is requesting septic systems to be considered an approved sewer system for this subdivision. STREET/UTILITY/ACCESS STANDARDS PUD.Policy 13— "Creative and innovative approaches to internal road systems will be considered"- The 900'cul-de-sac length did not comply with the Windsor-Severance Fire Protection District standards, and they requested a turn around be located about halfway up the street. As a result, a unique road section has been created, and the site plan has been adjusted accordingly. The developer will address the County Road Impact Fee Program and comply with the fee structure, per Ordinance 2002-11. In accordance with Weld County Public Works Department, the developer will construct the road with three inches of asphalt over six inches of base. A school bus pull-off is identified on the site plan. The location of the pull-off has been reviewed by the School District. The School District has identified the amount of their cash-in-lieu offee for this project during the referral process. The developer will pay the required school impact fee prior to filing the final plat application. A designated road name will be identified on the Final Plan. Should a subdivision identification sign be installed, such signage will adhere to the Weld County PUD and Zoning Ordinance and the applicant will obtain the appropriate permits. A Final drainage plan is being submitted with the application. OPEN SPACE/LANDSCAPING PUD.Policy 4.2—In response to the City of Greeley and Planning staff's comments, 15%open space has been incorporated into the subdivision and will provide a subdivision distance buffer. The proposal includes approximately 3.6 acres of distance buffer open space. The open spaces are configured so distance buffers are provided adjacent to the railroad tracks and CR 64%. The northern distance buffer measures approximately 120'from the property line. This buffer distance does not account for the additional railroad right-of-way to the tracks. The southern distance buffer measures 75'feet. The detention ponds are not included in the open space calculations. The detention facilities shall be located in outlots, which are maintained by the homeowner's association, and not the responsibility of the individual lot owners. The proposed open space, bus/mail pull off and entrance sign location are to remain private under ownership of a homeowner's association. In accordance with Section 23-2-790.a., the homeowner's association will be established before any residences are sold. ENVIORNMENT CRITERIA In accordance with the referral response from the Weld County Department of Public Health and Environment,primary and secondary leachfield envelopes will be delineated on the plat and language restricting building on the leachfield envelopes will be included in the homeowner's association covenants. Since the applicant is submitting a specific development guide and to utilize the staff review option for final platting, the applicant has purchased the necessary water taps from North Weld Water District to ensure water service will be provided. The necessary paper work was submitted to Planning Staff with the Change of Zone application. DESIGN STANDARDS/IMPROVEMENTS AGREEMENT/SUBDIVISION IMPROVEMENTS The bus pull-off and mailbox cluster boxes have been reviewed by both the school district and the post office. Neither the School District nor the Post Office provided any comments regarding the proposed location/design. The Colorado and Southern Railway Company now owned by Burlington Northern has been notified of the subdivision. The Railroad Company has provided no comments regarding the proposed subdivision. The railroad right-of-way adjacent to the proposed project is approximately 50'from centerline of the tracks for a total of a 100'right-of-way. The Town of Severance was also notified of the proposed application. They have not provided any comments regarding the subdivision. SUMMARY The responses to the Sketch Plan comments are intended to address the concerns that Weld County staff and the referral agencies expressed Minor changes to the design of the subdivision are delineated on the new drawings and all the reports should address the concerns that were identified This PUD application is consistent with the goals and policies of the Weld County Comprehensive Plan as it proposes an urban scale development, which meets and exceeds the established requirements of the Weld County Subdivision, Zoning, and Planned Unit Development Ordinances. SPECIFIC DEVELOPMENT GUIDE On Estates PUD Introduction The concept of this subdivision is to create a Planned Unit Development(PUD) that consists of nine PUD Estate zoned lots and common open space. It is the intent of the applicant to create an urban scale subdivision that provides single-family estate residential lots while preserving distance buffers to the north and south of the project. Orr Estates Planned Unit Development(PUD) is located north of WCR 64 'h and east of WCR 25, and contains approximately 24.45 acres. All nine lots would measure approximately 20 acres. The proposal is compatible with the surrounding land uses, architectural style, character, and zoning. It is the applicant's intent to establish a small neighborhood that will co-exist in harmony with the surrounding land uses. According to maps recognized by the Weld County Department of Planning Services, the site is located outside the Urban Growth Boundaries for the communities of Windsor, Severance, and Greeley. Agricultural activities have been occurring on and around the subject parcel. The Right to Farm Covenant, as it appears in Chapter 22 of the Weld County Code will be placed on all recorded plats, by doing so,future residents of the subdivision will be aware of long-standing agricultural practices in the area. In accordance with Section 27-6-20.B., the following submittal entails a specific development guide. Section 27-4-20.E Initial impact plan addressing all impacts this use will have on the proposed site and surrounding land uses. A listing of potential impacts is cited in Section 27-6-30 of this Chapter. (SPECIFIC DEVELOPMENT GUIDE) Section 27-6-40 Component One—environmental impacts 1. Noise and vibration 2. Smoke, dust and odors 3. Heat, light and glare 4. Visual/aesthetic impacts 5. Electrical interference 6 Water pollution Development of this proposal should not result in any adverse environmental impacts, including the above listed environmental concerns. Negative impacts from noise and vibration, smoke, odors, heat, glare,visual impacts, electrical interference and water pollution will not occur on the site. Since farming can be a more intensive use than residential, some of these factors will be significantly mitigated with the development of residential housing, such as smoke, dust and odors. Visual and aesthetic impacts will be enhanced by entrance landscaping treatments and landscaping within the subdivision. 7. Wastewater disposal This proposal addresses the wastewater disposal on this site through the use of individual septic systems. In accordance with the Weld County Department of Public Health and Environment, the request for secondary envelopes will be depicted on the plat and language restricting building on the leachfield envelopes will be included in the homeowner's association covenants. r 8. Wetland removal There are no wetlands on this parcel. 9. Erosion and sediments 10. Excavating,filling and grading 11. Drilling, ditching and dredging Due to the relatively flat topography, the design of the proposed PUD requires minimal grading on site. There is an existing plugged and abandoned oil&gas well located on the property. Information regarding the capped well will be forwarded to the Fire District for their review. A final drainage plan has been submitted with the application. 12. Air pollution 13. Solid waste 14. Wildlife removal 15. Natural vegetation removal This proposal will not result in negative impacts to the above listed concerns. The residential uses should not create any adverse impacts to air pollution or contribute to solid waste concerns. Landscape improvements proposed on the site may also provide additional cover for wildlife or increase nesting in the area. 16 Radiation/radioactive material To the applicant's knowledge, there are no radioactive materials located on the subject parcel. 17. Drinking water source ^ The applicant has provided evidence of a water service agreement with North Weld County Water District for this subdivision. 18. Traffic impacts Due to the low-density nature of this proposal(nine estate residential lots), there should be minimal impact to traffic in the area. The April 22, 2005 Sketch Plan referral comments from the Weld County Public Works Department indicate that a Traffic Impact Analysis is not required for this subdivision. Section 27-6-50 Component Two—service provision impacts 1. Schools 2. Law enforcement 3. Fire protection 4. Ambulance Service providers for this PUD include the Windsor RE-4 School District, Weld County law enforcement, and the Windsor/Severance Fire District. This proposal should have a minimal impact to the local service providers. The applicant will pay the cash-in-lieu fee amount identified by the Windsor School District. The post office has reviewed the mailbox cluster location. The issues identified by the Windsor-Severance Fire Protection District have been address and included on the plat map. 5. Transportation (including circulation and roadways) r According to Weld County urban scale road standards,this project would be required to provide curb and gutter. Since the intent of this nine-lot subdivision is to remain rural in nature, the developer is requesting a waiver to the installation of curb and gutter as required by the development guidelines. 6. Traffic impact analysis by registered professional engineer The internal roadway in the PUD is designed to meet the requirements of Chapters 24 and 26 of the Weld County Code. Only one road access off WCR 64 '/z is identified. In accordance with Weld County street designs,the road will be constructed of asphalt and meet all emergency service loading requirements, as well as the Weld County Public Works standards and regulations. No additional road accesses will be created. No off-street parking areas have been identified as the large lot sizes should provide adequate off-street parking needs for the residential properties. 7. Storm drainage Storm drainage will be handled on-site. A final storm drainage report has been submitted with the application. g Utility provisions 9. Water provisions 10. Sewage disposal provisions North Weld County Water District has provided a water service agreement to the developer for the proposed nine lots. A copy of that agreement is included with the application. The proposed lot sizes comply with the requirements of the Weld County Department of Health and Environment, and the Geotechnical Engineering Report prepared by Terracon indicates that soils are feasible for Individual Sewage Disposal Systems. Section 27-6-60 Component Three—landscaping elements 1. Landscape plan 2. Treatment, buffering or screening and perimeter treatment A preliminary landscape plan has been submitted with the application and depicts the general location of the vegetation and lists the plant materials. The proposed landscaping is placed to enhance the aesthetic value of the property, and to buffer the north and southern property boundaries. The species selected will be drought tolerant and most suitable to the area's climate and soil types. The location of the open space is clearly delineated on the landscape conceptual plan. 3. Maintenance schedule for landscaping elements 4. On-site improvements agreement 5. Evidence of adequate water The maintenance for all the landscape improvements in the common open space areas, as well as the bus pull-off and mail boxes will be performed by the homeowner's association. To ensure all plant material will be maintained in a healthy state an irrigation tap has been applied for from NWCWD. Any dead or dying plant material will be replaced at the earliest planting opportunity possible. Section 27-6-70 Component Four—site design 1. Unique features There are no features unique to only this property. 2. PUD rezoning consistent with Chapter 22 of the Weld County Code In accordance with Section 22-2-60.C. "Provide mechanisms for the division of land which is agriculturally zoned." There are many single-family dwellings within close proximity to the property and since the parcel is relatively small in comparison to the average farm size,the residential uses will be extremely compatible. This PUD application is consistent with the goals and policies of the Weld County Comprehensive Plan as it proposes urban scale development that meets and exceeds the established requirements of the Weld County Subdivision, Zoning, and Planned Unit Development Ordinances. It is the intent of the property owner to comply with the Weld County Comprehensive Plan, Weld County Zoning Ordinance, Weld County Subdivision Ordinance, and Planned Unit Development Ordinance#197. 3. Compatibility within PUD zone district 4. Compatibility with surrounding land uses The proposed design of the subdivision takes into careful consideration the uses of the surrounding properties. The proposed subdivision will be consistent with the Estate zone district and will be compatible with the surrounding agricultural and residential parcels. Compatibility will be further ensured by including Weld County's Right to Farm Covenant on the plat. There will be no oil&gas operations occurring on the subdivision. There is an existing capped well on the property. Please refer to Blue Chip Oil Companies attached letter. 5. Overlay districts The site is not located within any overlay districts, including airport or flood. Section 27-6-80 Component Five—common open space usage 1-6 Open Space Regulations This proposal is consistent with Weld County's open space regulations. 7- 15% Common Open Space Minimum This project has been identified as urban scale and therefore is complying with providing the required 15% open space. The open space will be utilized as distance buffers. The open space will provide a buffer on the northern end of the property from the existing railroad tracks and along the southern boundary from CR 64 %2. The detention ponds are not calculated with the 15% open space requirement. Ownership of Common Open Space Construction of Open Space On-site Improvements Agreement The common usable open space will be owned and maintained by the homeowner's association. Section 27-6-90 Component Six—sign age This proposal shall comply with the sign standards, as set forth in the Weld County Code. The applicant understands that a monument sign for the entrance of the subdivision will require a building permit. Section 27-6-100 Component Seven—MUD impact There is no MUD impact because this proposal is not located within the MUD Boundary as delineated in the MUD Ordinance or Comprehensive Plan. Section 27-6-110 Component Eight—intergovernmental agreement impacts This component is not applicable to the subject parcel since this proposal is not located within any adjacent communities urban growth boundaries as identified by Weld County.
