RE: GRANT REQUEST TO PREADVERTISE SITE SPECIFIC DEVELOPMENT PLAN AND
USE BY SPECIAL REVIEW PERMIT #1495 - MARCELLE GEUDNER, C/O JESS
ARAGON
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS,the Board has received a request from Marcelle Geudner,7454 South Depew
Street, Littleton, Colorado 80128, do Jess Aragon, 1001 East Harmony Road#192, Fort Collins,
Colorado 80525,for preadvertisement of an application for a Site Specific Development Plan and
Use by Special Review Permit#1495 for a Use Permitted as a Use by Right or Accessory Use in
the Commercial Zone District(Landscape Materials Yard)in the A(Agricultural)Zone District,and
WHEREAS,said property is described as part of the NE1/4 of Section 8,Township 5 North,
Range 67 West of the 6th P.M., Weld County, Colorado, and
WHEREAS,after study and review the Board deems it advisable to grant said request,with
the hearing date to be set as February 16, 2005, at 10:00 a.m.
NOW,THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County,Colorado,that the request from Marcelle Geudner,do Jess Aragon, for preadvertisement
of an application for a Site Specific Development Plan and Use by Special Review Permit#1495 for
a Use Permitted as a Use by Right or Accessory Use in the Commercial Zone District(Landscape
Materials Yard) in the A (Agricultural) Zone District be, and hereby is, granted.
BE IT FURTHER RESOLVED by the Board that the hearing date to consider said request
be, and hereby is, set as February 16, 2005, at 10:00 a.m.

COLORADO SUBJECT: Request for Pre-advertisement
Marcelle Geudner,do Jess Aragon,has submitted a request that the application for Use by Special
Review Permit#1495, which will be heard by the Planning Commission on February 1, 2005, be
pre-advertised. If you wish to approve this request, a hearing before the Board on February 16,
2005, will allow adequate time for advertising.

SUBJECT: USR-1495
The applicant Marcelle Geudner is requesting a Pre-Advertisement for USR-1495. The
applicants have indicated that the reason for this request is primarily financial.
According to a letter dated December 10, 2004 the applicants business has been
closed since October 15, 2004 therefore they would like to re-open their landscaping
business before too much of the landscaping season is lost.
The Department of Planning Services does not feel this is adequate justification.
Should the Board of County Commissioners approve the Pre-Advertisement the hearing
would be scheduled for the middle of February if not approved the hearing would be
scheduled for the beginning of March. Staff has determined that the months of
February and March are considered winter months, therefore, the slow season for a
landscaping business. The Department of Planning Services is recommending denial
of the Pre-Advertisement for USR-1495.

Re: Request for Early Publication of Board of County Commissioners Hearing
USR-1495
Clerk to the Board:
This letter is being written to respectfully request an early publication of the Board of
County Commissioners hearing regarding our pending application USR-1495. We would
like to request that it be scheduled 3-4 weeks after the Weld County Planning hearing
date of February 1, 2005 if possible. We wish to request this early publication so that if
an approval is granted in our favor, we could open our landscape business in a timely
fashion before too much of the landscaping season is lost. We could have a
representative available at your December 22,2004 a.m. monthly business meeting in
case you have any questions or concerns. Since our business has been closed since
October 15,2004,the sooner we can schedule this hearing the better it will be for us and
for the survival of this business. Please let us know as soon as possible with an answer to
our request. Thank you.
