This is concerning a case to change a agriculture farmground area to a commercial race track. My name is Kevin
Brunson and I have the property adjacent to the property to be changed. About 150+ individuals are against the
change for several reasons. There was already some of the "racing"that happened last summer and it got out of
control with loose horses tearing through 3 of our fences being chased by 4 weelers and also trash blowing over
to our property and also loud blaring music playing into the late hours. This will be amplified 100 times if the
application were to go through. About 1 year ago the sheriffs office camped at our place to break up one of the
biggest Meth labs on that property so we are also concerned about them disturbing the Ennvironment with the
moving of the contaminated soils that exist on that property. Please keep all this in mind as you assess this case,

I have been dismayed and discouraged over the years to see the massive, unhampered growth
of Colorado and it ' s former farm/prairie lands. Each year when I come to visit
Platteville. . .more prime agriculture ground has been gobbled up in the name of progress
and the almighty dollar. ENOUGH! ! Wise up, before it is too late. Don' t turn 80
beautiful prairie acres into another public dumping ground of excessive and glutinous ways
to burn up people' s hard-earned money on so-called "recreational" activities. Since when
did segregated race tracks, drag strips, beer gardens and recreational activities become
necessary? Are the Weld County Commissioners single-handedly sending a message to the
world that the "Hispanic"
population needs 80 acres out in the middle of the prairie to recreate on?
-What about the residents already living on WCR 39? They purchased their land parcels to
void the over-crowded towns, cities and villages and resume their agricultural endeavors
where the neighbors don' t live by covenants that say "You cannot park your boat in your
own driveway for more than two days in a row" and other such over-zealous ordinances.
These folks bought into the rural Weld County life. They are happy and content with their
horses, cows, goats, sheep or whatever. They get to listen to the planes overhead from
DIA, but that is a small price to pay to NOT have garbage blowing from the beer garden
onto their property from the latest "horse race" and have the horses get loose to be run
down with four-wheelers, destroying private property in the process. Totally bazaar and
out-of-control activities in an area with little or no law enforcement, paramedics or fire
trucks to control the excess. That took some real forthought on your part. (duh) .
If you choose to live in town - good for you. Do you want to have the city government
change the zoning and put a dairy (with a little methane odor) right next door? If you
choose to live a rural life - good for you, too!
Remember, America is about the freedom to choose those life styles without the fear of a
small-time, power-hungry bunch of commissioners or city councils arbitrarily deciding to
stick the "unwanted" recreational activities in someone else' s backyard - not theirs!
Shame on you all! I guess it is time for all the lawyers to get involved, again, and they
will be the only winners in the long run to settle this.

The Planning Commission resolution provided the following changes from Staff
Comments.
Staff Comments Condition of Approval "Prior to Scheduling a Board of County
Commissioner's Hearing" items 1B and C request a Landscape Plan and a Lighting Plan.
These two conditions were dropped at the Planning Conunission hearing as they were
provided to you prior to the hearing.

We are seriously against the passing of this Special Use permit.
This is a two faced proposal with serious implications to
the future of South West Weld County.
At first the proposal looks like a great idea and will allow
"families' to enjoy a time honored tradition of "Mexican Rodeos"
and paired horse racing. But the impact of 1100 people
traveling the two lane county road 39 and 41 can only lead
to accidents, damage to property and possibly death. Can
Weld County Sheriff's department handle the impact in this
remote area that only has one Sheriff's Deputy assigned to it?
Can the Platteville fire department respond to any problems
that may arise? Are we so blind to think that a
Beer Garden is a wholesome family environmen

Dear Sirs:
The Loya Horse Racing Facility has been proposed for the area in which I have
lived for 71 years. This is to present to you some of the problems that I am aware of
should you approve this proposal.
Law Enforcement:
1. The site of this proposal is far from sheriff's offices. Because of the distance,
when a problem occurs, the length of time of response is such that the
problem can escalate before law enforcement can arrive.
2. The enforcement of speed on the roads serving this area is practically non-
__ existent. These roads are heavily used by trucks using these back roads to
bypass the port on Highway 85 and with the limited staffing in the sheriff s
office and highway patrol, they may check it for an hour or two a month but
have not slowed the speeding, many over 75 MPH. Adding this public
entertainment facility to an already overstressed law enforcement is a negative
impact.
3. The proposal cites that horse track management would provide the security.
This would be for their security, not for the involved public affected by this
facility.
4. This same property was the site of a meth drug bust recently. Due to the area
being isolated from law enforcement, this went on for a long period before
being discovered. The same could be true of enforcement of regulations for
underage drinking, gambling, etc. There are already places that have horse
racing and are under close regulation. The isolation from law enforcement of
this site could be a hazard to this agricultural community.
Alcohol on Premises:
1. With alcohol being served by the establishment, or the bringing on site by the
participants, there would be the problem of disorderly conduct and also
drunken driving, endangering everyone else using the roads in the area.
Use of Underground Water:
I. There is a shortage of water in this area. I have lived in this area for 71 years.
We have been able to use the well used by my grandparents longer ago than I
am old until three years ago. That well is 50 feet deep. At that time the water
table from so many wells being drilled dropped and we had to drill a new well

that is 70 feet deep. In June 2005 it was discovered that the 70 foot deep well
was contaminated with benzene. This lasted only a short time but as a result
of this, that well is contaminated with coliform and gas coming into the water
well, which we have been told by the Colorado Gas & Oil Commission that it
is either natural gas, Methane gas, or CO2. Since we need household water,
we are in the process of drilling a deep well at about 640 feet. This morning,
they are starting on the third time to drill this deep as the gas in the area keeps
collapsing the well. We realize that all of the oil and gas drilling and the
population growth with new water wells drilled is affecting the underground
water. Our complaint regarding the proposed horse racing facility is that a
facility that provides for up to 2000 people three days a week is MUCH more
than a well for a single family. My property is included in the taxation for a
water district that provides Hudson with a public water supply, but that water
is not available to my home, yet the well water under my property is so
contaminated and scarce because of all of the wells drilled that we have not
been able to complete a well to provide water for our home.
Safety:
1. Traffic. When the illegal horse races were held in May, the traffic during that
period of time was so heavy that it was impossible for us to get out of our
driveway. Also, as farmers, movement of machinery was not possible.
2. People stopping at our house for directions was an added problem. During the
period of time of the illegal horse races, people repeatedly stopped to ask
directions. We have had one elderly woman near Gilcrest murdered in her
rural home. This interaction with the public in a situation such as this is
unsafe for my family.
3. The accident rate on Road 41 is already high. In one, three-week period, there
were three accidents that were either with the vehicle landing on our property
or across the road. Also, at the intersection of Road 22 and 41, I can recall at
least 3 fatalities in recent time. The added infusion of traffic attending an
event starting at a specific time and dismissing at a specified time compacts
the traffic into a more hazardous situation than general traffic that flows over
extended time.
4. School buses discharging children on roads in area, as is currently being done,
would put children at greater risk at being hit by a vehicle, especially at the
time of afternoon when returning home. In many cases, it is necessary for
students to walk along roadside to their homes. The roads in the area are
narrow and there is no shoulder along side. There is presently some problem
with vehicles not stopping when the school bus turns on its red light to let
students off of the bus.
5. Roads are poorly maintained. Maintenance is especially a factor in regard to
no shoulder. Along most of the roads that are paved, the drop-off from the
pavement to the dirt alongside is as much as six to eight inches. Often when
vehicles drop-off the pavement, the driver over-reacts and comes back onto
the pavement and this causes the vehicle to roll. Also, because of the already
heavy traffic, the roads are in need of resurfacing now and with added traffic,
poor road conditions would be increased.
Environment:
1. Fragile ecology. With sandy soil and a shortage of rainfall in the area, the use
of this land for entertainment in which the fragile grassland would be
destroyed, never to be recovered, would be a disaster. It was the devegetation
and drought conditions of the 1930's that caused the"Dust Bowl".
Meteorologists have predicted continuing dry weather conditions for the area.
As a farmer, I am deeply troubled by the ecological disaster this proposal
could cause for the area.
Noise Problem:
1. When the illegal races were held in May at the proposed site, it was almost
universal for the vehicles to have loud boom-box music that actually shook
the ground as it passed our house.
2. For those who live close to this proposed site, it would be an absolute
nightmare for them to have any peace as a family. I am thankful that our
residence is not that close.

People for the Ethical Treatment of Animals is an international nonprofit
organization with more than 850,000 members and supporters dedicated to the
protection of animals. We have received numerous calls and e-mails from area
residents who are very concerned about the proposed rodeo arena and horse
racing facility in Weld County. We respectfully request that the Board of
Commissioners give careful consideration to the cruelty associated with such
facilities, and make the humane and progressive decision to keep rodeos and
horse racing out of Weld County by denying the request for a Use for Special
Review Permit for the proposed venues.
Often misleadingly defended under the banner of tradition, rodeos are a cruel
form of"entertainment."Normally gentle animals such as horses, steer and calves
are provoked into "wild"behavior with the use of spurs, tail-twisting, electric
prods, and straps cinched tightly around the animals' abdomens. Even when
animals aren't injured and they often are—they still suffer from fear and pain
during rodeo events. Please see enclosed PETA's Rodeo Incidents factsheet for
more details. I have also enclosed a short video that depicts the abuse and torture
that is commonly experienced by animals at rodeos. Every national animal-
protection organization is opposed to rodeos because of the events' inherent
cruelty. When too old, tired, or injured to continue on the circuit, most of these
animals end up in the slaughterhouse.
Dr. C.U. Haber, a veterinarian who worked for 30 years as a meat inspector in
slaughterhouses, saw scores of animals who had been discarded from rodeos and
sent to slaughter. Toughened as he was when it came to animal suffering, the
condition of animals from rodeos sickened him. He described them as so
extensively bruised that the only areas in which the skin was attached to the flesh
were the head, neck, leg, and belly and said that he had seen animals "with 6-8
ribs broken from the spine, and at times puncturing the lungs" and "as much as 2-
3 gallons of free blood accumulated under the detached skin."
The horse racing industry, too, is fraught with cruelty horses suffer terribly on
the racing circuit. Young horses are forced to begin training even before their
bones are fully developed, are raced too often, are run on hard surfaces, and are
given pain-masking and performance-enhancing drugs. Every year, tens of

thousands of horses who are no longer profitable—including winning thoroughbreds—are sold
for slaughter. Their flesh is used in dog and cat food, and even sold for human consumption in
Europe and Asia.
We support your efforts to maintain a fun, strong community, but we hope you won't do so at the

Rodeos are promoted as rough and tough exercises of human skill and courage in conquering the fierce, untamed
beasts of the Wild West. In reality, rodeos are nothing more than manipulative displays of human domination over
animals,thinly disguised as entertainment. What began in the 1800s as a skill contest among cowboys has become a
show motivated by greed and big profits. (1)
The Stunts
Standard rodeo events include calf roping,steer wrestling, bareback horse and bull riding,saddle bronc riding,steer
wrestling,steer roping,and barrel racing. (2)The animals used in rodeos are captive performers. Most are relatively
tame but understandably distrustful of human beings because of the harsh treatment that they have received. Many of
these animals are not aggressive by nature;they are physically provoked into displaying "wild" behavior to make the
cowboys look brave.
The Tools That Cause Pain
Electric prods,spurs,and bucking straps are used to irritate and enrage animals used in rodeos.The flank or"bucking"
strap or rope used to make horses and bulls buck Is tightly cinched around their abdomens, which causes the animals to
"buck vigorously to try to rid themselves of the torment," (3)which is what the rodeo promoters want the animals to do
in order to put on a good show for the crowds.The flank strap,when paired with spurring,causes the animals to buck
even more violently,often resulting in serious injuries. (4) Former animal control officers have found burrs and other
irritants placed under the flank strap. (5) In addition,the flank strap can cause open wounds and burns from when the
hair is rubbed off and the skin is chafed raw. (6)
iws and horses are often prodded with an electrical"hotshot"while in the chute to rile them,causing intense pain to
the animals. Peggy Larson, D.V.M., a veterinarian who in her youth was a bareback bronc rider said, "Bovines are more
susceptible to electrical current than other animals. Perhaps because they have a huge'electrolyte'vat,the rumen [one
of their stomachs]." (7)
Veterinarian Perspective
The late Dr. C.G. Haber,a veterinarian who spent 30 years as a federal meat inspector,worked in slaughterhouses and
saw many animals discarded from rodeos and sold for slaughter. He described the animals as being so extensively
bruised that the only areas In which the skin was attached to the flesh were the head, neck, legs,and belly. He
described seeing animals"with 6-8 ribs broken from the spine,and at times puncturing the lungs." Haber saw animals
with "as much as 2-3 gallons of free blood accumulated under the detached skin."(8)These injuries are a result of
animals'being thrown in calf-roping events or being jumped on from atop horses during steer wrestling.
Rodeo promoters argue that they must treat their animals well in order to keep them healthy and usable. But this
assertion is belied by a statement that Dr.T.K. Hardy,a Texas veterinarian and sometime steer-roper, made to
Newsweek "I keep 30 head of cattle around for practice,at$200 a head.You can cripple 3 or 4 in an afternoon ... it
gets to be a pretty expensive hobby." (9) Unfortunately,there is a steady supply of newly discarded animals available to
rodeo producers when other animals have been worn out or fatally injured.
Injuries and Deaths
Although rodeo cowboys voluntarily risk injury by participating in events,the animals they use have no such choice.
Because speed is a factor in many rodeo events,the risk of accidents is high.
A terrified,screaming young horse burst from the chutes at the Can-Am Rodeo and,within five seconds,slammed into a
fence and broke her neck. Bystanders knew that she was dead when they heard her neck crack,yet the announcer told
the crowd that everything would "be all right" because a vet would see her. (10) Sadly, incidents such as this are not
:^uncommon at rodeos. For example, by the end of the 2001, nine-day Calgary Stampede in Alberta,Canada,six animals
ere dead, including a horse who died of an aneurism and another who suffered a broken leg and had to be
euthanized. (11)The following year, at the same event,six more animals died: five horses in the chuckwagon

competition and a calf in the roping event. (12)
.the "prestigious" National Finals Rodeo in Las Vegas,a bull fell and fractured his spine seconds after leaving the
chute. (13)The year before,a bucking horse was euthanized after he flipped over and broke his back. (14)An article in
Extra!magazine stated, "[TJhe TV audience had no clue about what happened:The camera cut just before the horse
flipped over, and none of the announcers said one word about the incident." (15)
During the National Western Stock Show,a horse crashed into a wall and broke his neck,while still another horse broke
his back after being forced to buck. (16) Dr. Cordell Leif told the Denver Post,"Bucking horses often develop back
problems from the repeated poundings they take from the cowboys. There's also a real leg injury where a tendon
breaks down. Horses don't normally jump up and down." (17)
Calves roped while running routinely have their necks snapped back by the lasso,often resulting in neck injuries. (18)
Even Bud Kerby, owner and operator of Bar T Rodeos Inc.,agrees that calf roping is inhumane. He told the St. George
Spectrum that he "wouldn't mind seeing calf roping phased out." (19)At the Connecticut Make-A-Wish Rodeo,one
steer's neck was forcefully twisted until it broke. (20)Sometimes animals break loose from their pens and escape, only
to be shot by police untrained in capturing livestock. (21,22)
Rodeo association rules are not effective in preventing injuries and are not strictly enforced, nor are penalties severe
enough to deter abusive treatment. For example, "[I]f a member abuses an animal by any unnecessary, non-
competitive or competitive action, he may be disqualified for the remainder of the rodeo and fined $250 for the first
offense,with that fine progressively doubling with each offense thereafter."These are small fines in comparison to the
large purses that are at stake. Rules allow the animals to be confined or transported in vehicles for up to 24 hours
without being properly fed,watered,or unloaded. (23)

If a rodeo comes to your town, protest to local authorities,write letters to sponsors, leaflet at the gate,or hold a
demonstration. Contact PETA for posters and fliers.
Check state and local laws to find out what types of activities involving animals are and are not legal In your area. For
----xample,after a spectator videotaped a bull breaking his leg during a rodeo event, a Pittsburgh law prohibiting bucking
:aps,electric prods,and sharpened or fixed spurs in effect banned rodeos altogether,since most rodeos currently
touring the country use the flank straps prohibited by the law. (24)Another successful means of banning rodeos is to
institute a state or local ban on calf roping,the event in which cruelty Is most easily documented. Since many rodeo
circuits require calf roping, its elimination can result in the overall elimination of rodeo shows.

They weigh at least 1,000 pounds,they have legs supported by ankles the size of a human's, and they're forced to run
over 30 miles per hour around a dirt track carrying a person on their back.(1) Racehorses are victims of a multibillion-
dollar industry rife with drug abuse, injuries, race fixing,and for many horses,their career ends in a slaughterhouse. A
New York Da*News reporter remarked,"The thoroughbred race horse is a genetic mistake. It runs too fast,Its frame
is too large,and its legs are far too small. As long as mankind demands that it run at high speeds under stressful
conditions, horses will die at racetracks."(2)
The Starting Gate
Racehorses can cost millions of dollars and are often purchased by syndicates,which may be composed of thousands of
members.(3,4)There are also trainers, handlers,veterinarians, and jockeys involved, so a horse is rarely able to
develop any kind of bond with one person or other horses.They travel from country to country,state to state, racetrack
to racetrack, so few horses are able to call one place"home."Most do not end up in the well-publicized races, but
instead are trucked, shipped,or flown to the thousands of other races that take place all over the country every year.
Racing to the Grave
Horses begin training or are already racing when their skeletal system is still growing and unprepared to handle the
pressures of running on a hard track at high speeds.(5) Improved medical treatment and technological advancements
have done little to remedy the plight of the racehorse. One study on Injuries at racetracks concluded that one horse in
every 22 races suffered an injury that prevented him or her from finishing a race,while another estimates that 800
thoroughbreds die a year in North America because of injuries.(6)Strained tendons or hairline fractures can be tough
-"-ir veterinarians to diagnose and the damage may go from minor to irrevocable at the next race or workout. Horses do
h handle surgery well,as they tend to be disoriented when coming out of anesthesia and may fight casts or slings,
possibly causing further injury. Many are euthanized in order to save the owners further veterinary fees and other
expenses on a horse who can't race again.Given the huge investment in a horse, reported one Kentucky paper,"simply
sending one to pasture, injured or not, Is not an option all owners are willing to consider."(7)Care for a single racehorse

earned any money yet and, unproven on the track,wasn't worth much as a stud,so he was euthanized.(9)
Trainers may take calculated risks by running a horse they know is Injured. War Emblem,the racehorse who won the
first two legs of the Triple Crown in 2001,suffered from bone chips in one ankle and both knees. In spite of veterinary
recommendations for surgery,which would have taken away from training and racing time,trainer Bob Baffert said,
"Let the chips fall where they may,"and continued to race the horse.(10)War Emblem lost the Belmont Stakes, no
longer races,and has changed hands twice.(11) Bone chips,which occur in up to 50 percent of racehorses by some
veterinary estimates,are"like taking two pieces of rock, rubbing them together and seeing pieces of sand rubbing off,"
explains one veterinary orthopedic surgeon.(12)The same trainer continued to race a 3-year-old thoroughbred after
knee surgery;the horse had to be euthanized after breaking his shoulder during a
workout.(13)
Drugs and Deception
"Finding an American racehorse trained on the traditional hay,oats,and water probably would be impossible,"
commented one racing reporter.(14) Many racehorses are turned into junkies by their trainers and sometimes by
veterinarians,who provide drugs to keep horses on the track when they shouldn't be racing.
Which drugs are legal and which are not varies from state to state,with Kentucky holding the reputation as most
lenient.(15)According to The Washington Post,every horse at the 2003 Kentucky Derby was given a shot of Lasix
(which controls bleeding in the lungs),and most were probably given phenylbutazone(an anti-Infammatory).(16)Those
drugs,although legal,can also mask pain or make a horse run faster. Labs cannot detect all of the illegal drugs out
-- here,of which there"could be thousands,"says the executive director of the Racing Medication and Testing
onsortium.(17) Morphine,which can keep a horse from feeling any pain from an injury,was suspected in the case of

and authorities determined her death had been caused by the injection of a"performance-enhancing drug."22

Even the Winners Lose
Few racehorses are retired to pastures for pampering and visits from caring individuals or are glamorized in movies.
An insurance scandal cost the life of Alydar,who came In second in all three races of the 1978 Triple Crown and
fathered many fast horses. After being retired to stud at a Kentucky farm, he was originally believed to have shattered
his leg by kicking a stall door and was euthanized when he wasn't able to maintain a spllnt.(24)Ten years later,an FBI
investigation revealed that his leg was broken deliberately with a rope tied to a pickup truck.(25)
The disappearance and suspected murder of candy heir Helen Voorhees Brach was traced to the Chicago horse"mafia,"
whose leader was known for burning barns and killing horses for insurance money.(26)
Ferdinand,a Derby winner and Horse of the Year in 1987,was retired to Claiborne Farms,then changed hands at least
twice before being"disposed of"in Japan; a reporter covering the story concluded,"No one can say for sure when and
where Ferdinand met his end, but it would seem clear he met it In a slaughterhouse."(27)

food,and injuries are common: A University of California, Davis,study of 306 horses destined for slaughter found that
60 of them sustained injuries during transport.(32)Some must travel in double-decker trailers designed for cattle or
sheep;these vehicles are are not tall enough for horses.The United States Department of Agriculture has banned the
use of these trailers for horse transport as of 2006.(33) Horses are subject to the same method of slaughter as cattle,
but since horses are generally not used to being herded,they tend to thrash about to avoid the pneumatic gun that
should render them unconscious before their throat is
cut. (34)
What You Can Do
Tracks are trying to revive interest in horseracing by Introducing slot machines at dog and horse tracks; in Arizona,
though,voters recently rejected a proposition to allow such an expansion of gambling at tracks.(35)To quote comedian
Bill Maher,"Horses were not meant to serve as gambling icons."(36)
Help phase out this exploitative"sport": Refuse to patronize existing tracks,work to reform and enforce racing
regulations, lobby against the construction of new tracks,and educate your friends and family about the tragic lives of
racehorses. If you have the money,acreage,and time,consider adopting a rescued racehorse from an organization that
rehabilitates them,such as Redwings Horse Sanctuary In California and the Equine Rescue League.

This letter is written on the behalf of the residents of the Pelican I like Ranch Community
located at Weld County Road 39 and Weld County Road 32.
If the proposed facility is approved,our community is very concerned about the impact it
would have on the land.neighboring developments and roads. Specifically, we are
concerned about the potential severe increase in traffic this facility would bring to our
small county roads, the possible sale of alcoholic beverages,the potential for illegal
gambling, the erosion of the soils(dust),noise and destruction of adjacent landowners
property. We're also concerned about the ability of the Weld County Sheriff's
Department to adequately serve a new venue of over 1.000 people gathering 3 times per
week.
Numerous Pelican Lake Ranch Owners are planning on being present at the Weld County

A commercial horse racing track is not an appropriate commercial venture for the rural
residential neighborhood within which the site is located. We oppose the development of
a commercial horse racing track and requests that the Board of County Commissioners
take the following into consideration in making their decision to approve or deny the Site
Specific Development Plan.
1. The lack of traffic control signs in the area poses a significant safety hazard to the
residents, their pets, property, and livestock; and the racing spectators and
participants.
2. The traffic will create significant clouds of dust.
3. Unwanted traffic and traffic noise prior to and during the events.
4. The parking facilities as described are not adequate for the volume of anticipated
participants.
5. Unwanted influx of people into the area disrupting the quiet, safety, and privacy of the
residents.
6. Unwanted noise from the public address system.
7. Unwanted accumulation of improperly discarded trash.
8. There are environmental concerns, as the land will not support vegetation when
subjected to the expected volume of pedestrian and automotive traffic at both the
racing site and the parking site. Unprotected land is subject to wind erosion and
creates a dust hazard.
I believe the proposed use is incompatible with the desires and life style of the
neighboring residents, and respectfully request a denial of the Site Specific Development
Plan.

We would like to respectfully express our opposition to"Loya Horse Racing Facility, USR-1522,"
proposed for Weld County Roads 28 and 39.
Our home is at the intersection of Roads 28 and 31, where we have resided for 32 years. Therefore,our
specific objection to this proposed facility relates to increased traffic on Road 28 and to the continued
availability of high quality water in the Laramie-Fox Hills formation.
I. Road 28
A. Dust. When the oil and gas drilling was at its peak in this immediate area,the dust from
Roads 28 and 31 was bad enough to cause our daughter's horse to develop a persistent cough
that the veterinarian could only diagnose as"dust related". We had to treat her with benadryl
cough syrup daily. The dust also permeates our house and negatively impacts our quality of
life.
B. Raptors. There are several Cottonwood trees along Road 28 between Highway 85 and the dead-
end at Road 35 in which both Golden and Bald Eagles perch and roost during the winter. Both
Great Homed Owls and Swainson's Hawks nest in the trees in our shelter belt. Increased traffic
and dust would negatively impact these birds as welt as the song birds,doves,and magpies that
nest and winter here. Excel Energy was required to complete a survey of nesting and roosting
sites prior to selecting a route for a new power line. Why isn't a similar survey required prior to a
proposed racetrack being allowed to bring dramatically increased traffic and dust to these roads
and neighborhoods?
C. Dead-end. Road 28 does end at what would be Road 35. However. Road 35 doesn't exist at
that location, either. Therefore, any traffic that tries to get from Highway 85 to Road 39 on
Road 28 turns around and comes back to Road 31. That increases traffic even further. The
gate at the end of Road 28 is usually locked. That does not mean that people will not cut the
lock in order to create a route through to the racing facility. For example,the gate at Roads
31 and 26 is also locked.but that lock has been routinely cut for several years. We have
observed that on many occasions because our daily walk takes us to that intersection. Road
28 is not a good candidate for extension through to Road 39,because it dead-ends again a
mile farther east and does not provide a viable route from Highway 85 to Road 49.
II. Water
A. How does one get a commercial well permit on an agricultural parcel? If this racetrack is
actually a commercial venture,shouldn't it be taxed at the commercial rate?
B. What assurances do those of us who also have wells in the Laramie-Fox Hills formation have
that our wells will continue to flow and that the water quality will remain high?
Mr. Loya did conduct races at the Roads 28 and 39 site in May without permits. Those events caused a
great deal of aggravation for the neighbors who live nearby. This included traffic congestion,dust,noise,
and trash. An 80 acre parcel is not a large enough site to support the type of facility that is being proposed
viithout a huge negative impact on the quality of life of everyone who lives in the area. �

I am writing to register my opposition to"Loya Horse Racing Facility,USR-1522". I have lived at the
above address for 30 years and am in no hurry to move. However,this horse racing facility may just be the
last straw.
My house is set back 700 feet from Rd. 28. When there is car or truck traffic, dust from the road drifts all
the way back to my house. Even though I keep the doors and windows closed,the dust still comes in and
settles all over the house. Sometimes the dust gets thick enough inside the house that I declare"Dust in the
house is called 'seed planting time—. Whenever I go outside I take dust masks with me in case there is a
lot of traffic or fast traffic. If I breathe in that road dust.my lungs fill with mucus. I do have a lot of trees,
but they do not help much to filter out the dust.
There are deer,coyotes, foxes, and rabbits that live here and travel through the fields,crossing Rd. 28 at
will. Additionally, our trees and outbuildings are home to several species of birds and bats. If the racetrack
is approved for Rds. 28 and 39,the traffic on Rd. 28 is likely to increase and have a negative impact on all
of this wildlife,as well on my own quality of life and that of my neighbors.
I am also concerned about my water. My well is in the Laramie-Fox Hills formation.drilled to 400 feet. I
do have an adequate supply of good, soft drinking water. I have a sample of water tested every two years
to make sure that the quality is maintained. Mr. Loya has been granted a commercial well permit for that
property at Rds. 28 and 39 in the same formation. What assurances do we have that our pre-existing wells
will maintain their good quality and adequate supply of water?
There is a dog track at Byers, CO,that is no longer used for dog racing. It is for sale. It already has
parking lots,grand stands,rest rooms,and concession facilities. It also has exits off of I-70,both east and
west bound. It is about three miles from the town of Byers. If Mr. Loya were to invest in that property,he
could easily develop a straight horse racing track and a Mexican rodeo arena at an existing facility. He
would not need to take more land out of Ag production,nor would he cause so much dust and traffic
problems for nearby neighbors.

Dear Gentlemen,
This letter is being written to voice our opposition to the approval of USR-1522, Below are
just a few of the reasons and negative impacts we have already witnessed when this event was
running illegally in May of 2005.
1. Twice we had cars come into our driveway asking for directions to the rodeo (as they
ca!!cd it). On one of these occasions, the 3 adults in the car had already been drinking
extensively and there was also a child, of about 8 or 9 years of age, in the car with
them.
2. Traffic on our dirt road increased dramatically which increases our already horrible
dust factor.
3. Increased trash and empty beer cans all along the road.
4. The lock on the west gate of Road 28 (where Road 28 ends) was cut off so traffic could
go through.
5. When the wind was blowing in the right direction, we could hear the noise (music and
cheering) from the event.
6. Car tracks going off the road into the ditch.
If USR-1522 is approved, the chances of seeing 4 times the problems we lave already seen are a
great possibility since Mr. Loya is asking for approval of up to 12.00 people.
We also don't understand how this can be promoted as "a day of total fun, adventure, great food
and entertainment for the whole family" when alcoholic beverages will be served which means there
could (and probably would be) drinking and driving which is dangerous to everybody.
In closing, we also would like to say that we find it very unfair (should U512-1522 he approved) to
jeopardize the existing rural way of life and safety of the many residents of this area, for the
profit of another person. Many of us have lived here most if not all of our lives.

My family's ranch on which I have my cattle business, Wardell Angus, has as its
southwest corner the land immediately across road 39 from the proposed racetrack site.
At the Weld County Planning Committee hearing, I gave testimony of some serious
concerns about this application but did not take a"for" or "against" stand. After more
consideration I want to formally oppose this application for the following reasons.
1. The applicants have already caused significant damage to the land surface which has
resulted in serious wind erosion and which they have done nothing to mitigate. Before
the Planning hearing, I met with Alberto Loya for over an hour at the proposed site and
showed him the wind erosion that had already begun and gave him some suggestions as
to how he might get it under control. Several times, including today, I revisited the site.
There has been no attempt made to control that problem and, with recent winds, it is now
quite serious. This unresolved situation causes me to question Mr. Loya's "good faith".
It is at the point now, whether or not the application is approved, that Loya or the land
owner should be required by the Commissioners to control the on going wind erosion. If
it is not controlled, it will cause damage to the adjoining lands and cause dust storms that
will hamper vision of drivers on roads 39 and 28. I believe if this racetrack facility is
built, chronic wind erosion will cause on going problems for neighbors and county road
safety.
2. I believe that the number of people the applicants are suggesting will attend
races/rodeos will cause a very significant nuisance problem for those of us that live and
work nearby. This will happen in several different ways and other people will
specifically give testimony about those problems.
I will be out of state on December 7, the day of the Commissioners hearing, so will be
unable to attend in person.

The department of Planning Services would like to request the following changes to the Staff
comments.
Add:
1 .K No parking signs shall be placed on both sides of the main access and on
the road between the two parking lots. The signs shall read `no parking — fire
lane' and have a minimum dimension of 12 inches wide by 18 inches height and
have red letters on a white reflective background. (Department of Planning

1.L Both the main and emergency access roads need to be able to support the
imposed load of fire apparatus weighting at least 75,000 pounds. (Department of

Approximately three years ago the Weld County Drug Task Force received
information regarding illegal drugs at a residence near county roads 39 and 28. The
Headquarters Task Force contacted the person living at the residence and interviewed him

Kerr-McGee Rocky Mountain Corporation ("KMRMC") is the owner of valid oil
and gas leases underlying all or part of Loya Rodeo, for which Alberto Loya, is seeking a
development plan/use by special permit approval. KMRMC and Alberto Loya have been
negotiating a Surface Use Agreement, the terms of which will govern the parties'
simultaneous use of the subject prop:rty. KMRMC does not object to the plat for which
Alberto Loya is applying. I-Iowever. the parties have not yet concluded an agreement,
and KMRMC therefore requests than. the Weld County Planning Department withhold

3n 08-15-03 at approximately 7:15 a.m. the Platteville Police Department was requested to assist Weld County
Probation Officer Mimi Bernhardt to conduct a search of Isaias Loya's residence located at 314 Marion Avenue
which is in the Town of Platteville, County of Weld, State of Colorado. Officer Bernhardt briefed the Platteville
Police Department that she had received information that Loya was in possession of a .45 caliber handgun and it
would be a violation of his probation.
On scene Mimi knocked on the door and an Angela Lavarro answered the door. Angela stated that Isaias was in
Greeley at probation giving his breath analysis. Mimi contacted her supervisor and was advised that Iasias was
to be present during the search in case a gun was found so he could be taken into custody.
While waiting Isaias's arrival I observed a ball of foil approximately the size of a tennis ball on the ground next
to a stainless steal cooler by the patio in plain view. Based on my training and experience I knew that it was a
common practice to conceal narcotics in balls of foil and place them in inconspicuous areas. I observed no other
balls of foil on the premises.
.aside the foil I observed a plastic baggy wrapped in Kleenex. Inside the baggy was a white rocky/powder
substance which weighed 11 grams and tested presumptive positive for of cocaine.
Based on information gathered and previous arrest of Isaias for possession of schedule II narcotics WCDTF was
contacted and a search warrant was drawn up for the 314 Marion residence and property.
The search revealed no other narcotics in or on the premises.

On 11-27-03 at approximately 1:42 a.m., I responded to the El Vergel Cantina, located at 314 Marion Avenue,
which is in the Town of Platteville, County of Weld, and State of Colorado, on a fight in progress.
Upon arrival on scene I contacted Sandy CAMPOS. CAMPOS stated that a fight had broke out in the bar.
CAMPOS stated that Alberto LOYA had been hit over the head with a beer bottle and punched in the face
several times. CAMPOS stated she did not know what the fight was about. CAMPOS stated that a Miko
BRAVO was the instigator of the fight. CAMPOS stated that BRAVO was the one who hit LOYA with the
beer bottle and punched LOYA in the face. CAMPOS stated that outside the bar BRAVO also repeatedly
slammed another guys head into the concrete sidewalk. CAMPOS described BRAVO as being 5'10"tall with a
thick build, dark black hair and a goatee. CAMPOS stated that BRAVO was wearing a white t-shirt with blue
jeans. CAMPOS estimated BRAVO's age to be approximately 28 years old. CAMPOS stated that BRAVO
possibly lived in the Ft. Lupton area. CAMPOS stated that BRAVO was with a friend of his by the name of
Robby SARABASCO. CAMPOS was unable to describe SARABASCO except that he was approximately 25
years old. CAMPOS stated that both BRAVO and SARABASCO left in a 1990's silver or grey Chrysler
possibly a Sebring. CAMPOS stated that BRAVO and SARABASCO might be headed toward the Ft. Lupton
area.
I had dispatch issue a BOLO (be on the look out) for the vehicle. I also had dispatch forward the BOLO to
Adams County with special attention to Ft. Lupton.
I then contacted Enrique HERNANDEZ. HERNANDEZ stated that he attempted to break up the fight.
...HERNANDEZ stated that he was hit in the mouth, but was unable to identify who hit him. HERNANDEZ
.ated that a guy named Miko BRAVO started the fight. HERNANDEZ described BRAVO as being 5'11" to
6'00" tall about 180 pounds, with a heavy build. HERNANDEZ stated BRAVO was wearing a white t-shirt
with no sleeves and blue jeans.
I then contacted Alberto LOYA. LOYA was being held up by two men. LOYA appeared to be very
unresponsive to questions and lethargic. I observed LOYA to have a cut above his right eye and bruising on
and around his right eye. LOYA stated that a disturbance started in the bar and him and a few other people
started the escort the person (BRAVO) who was starting the disturbance outside. LOYA stated that when he
started the escort BRAVO out of the bar BRAVO hit him with the beer bottle and punched him in the face
several times. LOYA stated that he wanted to pursue charges against BRAVO.
While LOYA was being attended to by paramedics I contacted Christine SANCHEZ. SANCHEZ stated that
LOYA is her boyfriend. SANCHEZ stated that she did not know what caused the fight to start. SANCHEZ
stated that she did not see the fight.
Medical arrived on scene and transported LOYA to the North Colorado Medical Center by ambulance.
I followed LOYA to the North Colorado Medical Center. At the North Colorado Medical Center LOYA stated
that he had never seen BRAVO before and did not know him. LYOA signed intent to prosecute form as well as
a medical release form.
I spoke with Dr. Moore regarding the injuries LOYA had sustained from the punches and from getting hit with
beer bottle. Dr. Moore stated that it was not serious bodily injury, but LOYA would need a few stitches to
close the cut over his eye. Dr. Moore stated that the x-ray performed on LOYA had come back negative with

.io injuries. Dr. Moore stated that they were waiting for a cat scan to be performed on LOYA. Dr. Moore
expected the results of the CAT scan to be negative as well. Dr. Moore stated that after the CAT scan and the
stitches LYOA would be released from the hospital.
On my way out of the hospital I spoke with SANCHEZ and CAMPOS again regarding the incident. Both of
them stated that they did not remember anything more than what they told me. I asked if they would be willing
to fill out a voluntary written statement form regarding the fight. Both SANCHEZ and CAMPOS stated that
they would come in to the Platteville Police Department either Thursday or Friday and fill out a voluntary
written statement form. I left my business card with SANCHEZ and CAMPOS and told them to call me if they
remembered anything else.
While I was back enroute to town dispatch advised me that the emergency room at the North Colorado Medical
Center needed me to call them. I spoke with "Mel" at the ER and she stated that LOYA had left the hospital
before the CAT scan could be performed and before the Doctor could stitch up LOYA's cut. Mel asked if I
could respond to LOYA residence and see if he would return to the hospital to finish the tests.
I contacted LOYA at his residence and told him that the ER wanted him to return to the hospital to finish the
CAT scan and get his cut stitched up. LOYA stated that he felt fine and did not want to return to the hospital. I
had LOYA call the ER. LOYA called the ER and told them that he did not want to respond back to the ER. I
also asked LOYA if I could come by tomorrow and take photographs of his injuries. LOYA stated yes, that
would be fine.
o further action taken at this time. This case will be inactivated pending further information regarding the
suspect Miko BRAVO.

On 01-19-03 at approximately 12:30 a.m. dispatch advised of a large fight with weapons at the El Vergal
Cantina located at 314 Marion which is in the Town of Platteville, County of Weld, State of Colorado.
On scene multiple suspect vehicles were fleeing the fight, one being associated as a white Ford Excursion. A
felony stop on the vehicle was done at the intersection of Hwy 66 and Division. During the investigation
dispatch advised and confirmed that a passenger in the vehicle, a Julio Cesar Felix, DOB 02/02/73 had an active
warrant for his arrest out of Boulder County, #CO872002M0007023J.
I placed Felix into custody and transported him to NJC and released him to staff without incident.

On 01-19-04 at approximately 12:30 a.m. dispatch advised of a large fight with weapons at the El Vergal
Cantina located at 314 Marion Avenue which is in the Town of Platteville, County of Weld, State of Colorado.
Dispatch advised that as many as 15 —20 people were fighting in the street with baseball bats.
On scene I observed several vehicles fleeing the area in multiple directions. I proceeded after a white car
southbound on Hwy 85 when I observed a Weld County Deputy already had a white Ford Excursion stopped at
the intersection of Hwy 66 and Division. I discontinued my attempt to contact and assisted the Deputy.
I requested several units to assist as many of the suspect vehicles were still in the area. Due to the heavy fog
conditions their response time was delayed. Deputy Mercer and I performed a felony stop on the Excursion
which eventually had six occupants.
During the course of the investigation it was revealed that one of the occupants, a Jose Alinese was injured in
the fight as he was struck with a bat on the left knee/leg area. Weld County Ambulance was requested and
transported Alinese to NCMC for further evaluation.
The other occupants all stated that they were not involved in the fight and picked up Alinese off the ground
because he could not walk as he was struck with a bat but was not associated with the fight either. None of the
occupants were injured, no weapons were located in the vehicle and they did not appear to have just been in a
fight as everyone's clothes were not disoriented.
One of the occupants in the vehicle had an active warrant for his arrest and was placed into custody and
transported to NJC. (See CR 04-00029)
Weld County Deputy Leger responded to the scene of the fight and interviewed a witness whom wanted to
remain anonymous. She stated that as many as 15 people were fighting, and she believed that one person may
have been knocked unconscious. She stated that she believed that three or four car loads were together and that
this fight may have been in retaliation from an earlier incident at the bar.
while transporting the warrant suspect to NJC dispatch advised that one of the individuals involved in the fight
was brought into the Emergency Room with head and facial wounds. I responded to NCMC and contacted a

Francisco Javier Lopez. Lopez stated he was involved in the fight because it started over a game of pool. Lopez
stated Isais Loya threw him out of the bar and then he was jumped by three other guys. Lopez stated he was
struck with baseball bats and belts with belt buckles. Lopez refused to cooperate with the investigation and give
any names of the parties involved and did not want to pursue charges. Lopez stated he and the "guys that
jumped me" were the only ones involved in the fight. I issued Lopez a disorderly conduct summons into Weld
County court. Lopez ripped his copy of the summons apart when it was issued to him.
Also in the room was Lopez's brother. I observed him to have a swollen upper and bottom lip. I asked him his
version of what had happened. He grinned and stated, "I don't know, I wasn't there".
No further action taken at this time.

On 12/15/05 at approximately 9:50pm I, Officer Onderlinde, was dispatched to a disturbance at El Vergal
Cantina at 314 Marion Avenue, which is located in the Town of Platteville, County of Weld, and State of
Colorado.
Dispatch advised that an anonymous caller stated there were two to three males fighting outside the bar (which
is the El Vergal Cantina). Upon arrival, the bar appeared to be closed and I saw no one fighting. I observed
three males getting into a Ford Ranger pickup (CO 047LBN). I contacted the three males, who identified
themselves as Esmundo Rodriguez (DOB 12/01/78), Victor Rodriguez (DOB 12/21/81) and Comacho
Rodriguez (DOB unknown).
Victor and Comacho got into the passenger side of the pickup while Esmundo got into the driver's seat. I
escorted Esmundo from the driver's seat of the pickup. Esmundo presented bloodshot and watery eyes and the
strong odor of an unknown alcoholic beverage. Esmundo had trouble keeping his balance and stated he had
three beers inside the bar.
I observed approximately 40 bottles of beer in the back seat of the pickup. Approximately half of the beer
bottles were empty. I also noted two open bottles of Bud Light beer in the front center console of the pickup.
One bottle was approximately half full and the other was approximately one quarter full.
Sergeant Boyle directed Victor and Comacho to the curb. Both Victor and Comacho had trouble keeping their
balance. Comacho could not remember his birthday. I observed an empty bottle of Bud Light beer in the gutter
next to the pickup. In broken Spanish, I asked who was fighting.
Victor and Comacho stated they were fighting with each other but could not state why. Victor and Comacho
also stated they were friends and both presented the strong odor of an unknown alcoholic beverage. Esmundo
stated he lives in Longmont. Esmundo stated the nearest person he could call to pick him and his friends up
lived in Longmont.
Dispatch advised that the pickup is registered to Esmundo. Since Esmundo, Victor and Comacho (who stated
had six beers inside the bar) each displayed several indicia of intoxication, it was not safe for any of them to

drive to Longmont. Due to Esmundo, Victor and Comacho's level of intoxication, I felt it was unsafe to leave
them outside the bar.
I transported Esmundo and Comacho to Detox in Greeley while Sergeant Boyle transported Victor. Detox
administered portable breath tests (PBT's) to Esmundo, Victor and Comacho. The results of the PBT's were
BrAC's of 0.124, 0.167 and 0.224, respectively.
I released Esmundo, Victor and Comacho to Detox staff.

On 04-30-05 at approximately 2:00 AM, I, Officer Boyle was advised by dispatch that there may be a stabbing
victim at North Colorado Medical Center that occurred in Platteville. Approximately 40 minutes later it was
confirmed that the assault did occur at the El Vergal Cantina, 314 Marion Avenue which is in the Town of
Platteville, County of Weld, and State of Colorado. I spoke with a nurse in the emergency room and was
advised that the victim was Spanish speaking only.
I contacted Detective Rodriguez and advised him of the assault and that I needed him to respond to the
emergency room for translation. On scene Detective Rodriguez interviewed the victim and a witness and I
assisted with taking photos of the stab wounds. The investigation was turned over to Detective Rodriguez.
Dr. Schwartz signed a Serious Bodily Injury form and the Victim signed a medical release form. All forms will
were released to Detective Rodriguez as well as the victim's clothes.

On Saturday, April 30, 2005, at approximately 2:40 AM, I, Detective Rodriguez received a
telephone call from Officer Boyle advising there was a stabbing at the El Vergal Bar in
Platteville. Officer Boyle stated the victim spoke Spanish only and was in the emergency room
of North Colorado Medical Center at this time.
I responded to North Colorado Medical Center and contacted Manuel Terraza-Beltran (DOB
101976) in a hospital bed. I identified myself to Beltran and asked him to tell me what happen.

Beltran stated he was at the El Vergal just having a good time. Beltran stated he was yelling
with the music and the guy must have not liked it. Beltran stated they had some words and the
guy told him to step outside. Beltran stated he told him no lets fight in here. Beltran stated the
guy walked outside, but he stayed inside the bar. Beltran stated around 1:00 AM him and his
-s—iend walked outside to leave the bar. Beltran stated the guy and some friends followed them
outside. They started fighting and the guy was on top of him when he felted something poking

nim in the back. Beltran stated the guy got off and went back inside the bar. Beltran stated his
friend got him into the car and took him to the hospital. Beltran stated he did not see the knife.
I asked Beltran to describe the male for me. Hispanic male, 20 years of age, slim, black hair,
med complexion, beard coming down to his mustache. Pants/Black, shirt/checkered-blue/short
sleeves.

Godinez stated they started fighting and he kept trying to stop it, but the guy's friends would not
let him. Godinez stated he tried stopping the fighting and the friend got him pulled him away.
Godinez stated the owner, Isaias Loya, walked outside and he told Loya to call the police. Loya
,..told him the police were on there way and everything was on camera. Godinez stated the parties
alked back into the bar and he saw his friend had been stabbed. Godinez stated he took
Beltran to the hospital. Godinez stated he did not see the knife.
I asked Godinez if he could write out a statement for me and he agreed too. The statement will
be entered into the file.
This concludes the interview.
I took pictures of four punctures wounds on Beltran's back and two on his left elbow.
I took a of pair pants, shirt and boots Beltran stated he was wearing this night and handed them
to Officer Boyle.
Officer Boyle transported the items to the police department.

Supplemental Report
On 04-30-05 at approximately 10:30am I, Officer Dwyer assisted Detective
Rodriguez with the above listed case. I responded to the El Vergel bar at 314
Marion Street. On scene, I observed blood droplets in front of the bar. I took
numerous pictures of the blood droplets where the assault took place. I took a total
of three swab samples of blood that was found on the ground. I used distilled water
and Q-tips to collect my blood samples. I later booked the blood samples into
evidence.
This concludes my involvement in this case.

told him what fight. Loya stated he walked around the bar area and found no one fighting.

Loya stated he walked outside and found two guys fighting. Loya stated there were fighting in
front of the neighbor's camera. Loya yelled at them, they were all on video tape and he had
called the cops. Loya stated they all left.
I asked Loya if he saw a guy with a thin beard that came down the side of his face into his
mustache. Loya stated he saw the guy talking to the mother of one of his waitress, Graciela.
Loya stated last night was Graciela's first night working there. Loya stated the guy was talking
to Graciela's mother at her table. Loya stated he had never seen the guy there before. Loya
stated he did not know Graciela's last name but he had her telephone number. Loya gave me
Graciela's telephone number. Loya stated Graciela would be coming in to work around 7:00
PM tonight.
,.I contacted Graciela by telephone and asked her about the incident. Graciela stated she did
Know the guy that was talking to her sister but did know one of the guys with him. Graciela
stated one of the guy's goes by the name of Pedro but did not know his last name. Graciela
stated she has seen him in the bars in Greeley. Graciela stated she would talk to her mother to
fine out the names.
I asked Graciela to describe the guys for me. Graciela stated the following:

On April 30, 2005, I, Detective Rodriguez, left a business card at the front door of 312 Marion
Avenue this is the place with the camera set up to view the front of the house. I received a
telephone call from the owner of the house with the camera.
I asked him if by some chance they had the camera on last night. I advised him there was a fight
out front of his house. Quinonez stated they were home and the camera was not set up last night
because they were home but they did not hear anything. Quinonez stated they installed the
cameras because their vehicles were getting vandalized. Quinonez stated they did not hear

Francis stated she did not know the guy that fought with Manuel. The guy walked up to her
table and asked her if she wanted to dance. Francis told him she was married and didn't want to
dance so he left. Francis stated he said his name was Jorge but no last name.
Francis stated she saw Manuel gabbing himself and yelling at the guy but did not know what it
was about. Francis stated Manuel was inside the bar when he was yelling at the guy and he was
gabbing himself
Francis stated that her mother walked outside to smoke and saw them fighting.
I asked Francis how she knows Manuel. Francis stated he was dating her mother's boyfriend's
daughter. Francis stated her mother was not here at the time.

who I was and asked her to tell me what happen.
Maria stated the following: Maria stated she could hear Manuel disrespecting the guy. Manuel
kept yelling at the guy and grabbing his private parts. Maria stated she walked outside to smoke
and saw them fighting. Maria stated there were about three or four guys out there. Maria stated
she saw Manuel kicking but hitting no one. Maria stated when Isaias, bar owner, walked out she
went back inside the bar. Maria stated it was around 1:30 AM when she left.

On 09-03-05 at approximately 12:30am I officer Dwyer was dispatched to a fight at 314 Marion
Avenue which is located in the Town of Platteville, County of Weld, and State of Colorado.
On scene, I contacted the owner of the establishment (El Vergal) identified as Loya, Isaias
(DOB 07-06-40). Loya stated that five males were involved in a fight inside the bar, and wanted
them all thrown out. Loya pointed out the five parties. The five parties were escorted outside of
the establishment and questioned.
The five subjects involved in the fight were identified as Rivera, Fausto (10-21-61), Chavira,
Ramon (DOB 04-10-72), Rodriguez, Juan (DOB 05-01-73), Marron, Maroileno (DOB 04-27-
63) and the victim Rivera, Andres (DOB 08-05-78). Rivera chose not to press any assault
charges against any of the subjects listed above. Rivera's left cheek and nose appeared to be cut
,—and swollen. All parties involved appeared to be intoxicated.
Loya stated that he was unsure how the altercation began and the five above listed subjects
ended up fighting. Loya stated that the five subjects were not welcome in his bar and stated that
if they returned he'd like to press trespassing charges.
All parties involved excluding the victim were issued summonses for disorderly conduct.

I am unaware that this has occurred on this property. I drive by there often and have not seen an excavation,
but I am aware of the history of this property. I am curious as to where the burial has occurred. If this did
occur, the following information needs to be provided to Weld County Environmental and Planning:
• Copies of all pertinent written documentation relative to the said waste management activities
• Documentation of cover thickness
• Sketch of placement of solid waste disposal site and site map
Additionally, potential purchasers must be notified that solid waste has been disposed of at the effected portion
of the property. This can be achieved by placing a note on the deed of the property with accompanying
map. It would also be prudent for Weld County to request documentation of what has been buried on the
property to properly asses environmental and public health risks.
As for concern about the "stuff" being stirred up and the potential for adverse environmental
or public health impacts - If this is a new property owner, it would be prudent to request
that the property owner establishes whether this dump site could cause adverse
environmental or public health impacts. This could be done through hiring a consulting
firm to conduct a site assessment.

Happy Thanksgiving!!
I have a question for you concerning USR-1522 (Loya Horse Racing Facility) . . . In April of 2003, a major drug
bust occurred on the referenced property. There were several trailer homes on the property in which meth labs
were discovered. The chemical aspects of the meth labs were apparently cleaned up by a professional
company.
However, the neighbors are concerned about the quality of the clean-up . . they said the equipment(vehicles,
etc.)of the clean-up company were in very poor condition, it appeared to be a"mom and pop"operation and
that the workers went to the restroom in the field . . . no ports john.
Also, after the clean-up was completed, a huge hole was dug and the trailer homes, several vehicles and
miscellaneous junk was thrown into the pile and covered up. Now that this horse racing facility is being
proposed, the neighbors are concerned about all the stuff being stirred up . . . coming to the surface, floating
into the air,filtering into the water, injuring the animals . . . no construction is being proposed in the area over
the big hole, but there is junk buried all over the property.
How is this okay? How can I put the fears of the neighbors to rest? If it is not okay and some type of testing or
dean-up is required, who is responsible . . . the current owner or the applicant(there is a contract to buy in
place, contingent upon the approval of the USR)?
The BOCC hearing for this is on Dec 7th, so if you can provide any helpful information, sooner would be better
--- than later. . . .

1 am bus driver for weld RE 3J. My route is W.C.R.#41 to W.C.R.#22 then all cross
roads 1 mile north and south from 22 till about W.R.#35. At this time 22 is always busy
with farm equipment, trucker trying to miss the weigh stations and people going to and
from work or another.There is not that many roads that go clear thru to the aria where the
horse race track is proposing to be that it will only add heavy traffic to the already busy
roads that I now deliver my young passengers to and from school. This will only cause us
a whole lot of more danger to my youth that ride my bus.
We also live in this area and ride our horses on these same side roads this will make it a
whole lot more risky for our kids.
Last summer when their people where running this track illegal we had a lot of people
stopping at our place to ask where the horse races where going on and the traffic of horse
trailer where a whole lot heaver..
We are definite against this racetrack and their beer garden as it is almost imposable to
regulate the consumption of alcohol at this type of facility and the traffic on the few
public roads in this area.

I was recently informed that an application was made for a horseracing track and beer
garden named Carril El Herradero to be located near Weld County Roads 28 and 39. 1 am
concerned that the numerous individuals driving to-and-from this site(especially those
driving under the influence of alcohol)will cause Weld County traffic accidents to rise
above their already alarming rate.
I understand that certain risks accompany the growth we are experiencing, but I also know
this is one risk that can be avoided with Soar assistance. Thank you for your ongoing
