RESOLUTION
RE: APPROVE VACATION OF USE BY SPECIAL REVIEW PERMIT #727 - GARTRELL
ENTERPRISES, INC.
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS,by Resolution dated April 23, 1986,the Board approved Use by Special Review
Permit#727 for a Dry Gravel Pit Mining Operation for Gartrell Enterprises, Inc., on the following
described real estate, to-wit:
Part of the SE1/4 of Section 25, Township 1 North,
Range 67 West of the 6th P.M., Weld County,
Colorado
WHEREAS, the Board has received a request from the current property owner, City of
Westminster, 4800 West 92nd Avenue, Westminster, Colorado 80031, to vacate said Use by
Special Review Permit#727, and
WHEREAS,the Board of County Commissioners heard all of the testimony and statements
of those present,studied the request of the applicant and the recommendations of the Department
of Planning Services staff and all of the exhibits and evidence presented in this matter and, having
been fully informed, deems it advisable to approve said vacation.
NOW,THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that Use by Special Review Permit#727 be, and hereby is, vacated.

SUBJECT: Request for Vacation of USR-727
Gartell Enterprises
The City of Westminister submitted a letter dated February 28, 2005 requesting the vacation of
USR-727 for Gartell Enterprises. This previously permitted mineral resource permit lies within
the boundary of the proposed Aggregate Industries mineral resource development permit
boundary, USR-1350.
Condition of Approval item 3.K•of USR-1350 states:
"The applicant shall submit a letter seeking to vacate USR 727 for Gartell
Enterprises, for a dry gravel pit." (Department of Planning Services)
The Department of Planning Services recommends that the letter requesting vacation of USR-
727 for Gartell Enterprises be approved.

FAX 303-650-1643 The City of Westminster owns parcels of land contained in Aggregate Industries
proposed sand and gravel mining operation under USR-1350. We have been
advised that another sand and gravel operation was previously permitted on one of
these parcels and that the County is requiring that the old permit be vacated as a
condition under the new permit. The City of Westminster, as owner of the subject
parcel No. 14692500006, therefore submits this letter as its request that USR-727—
Gartrell Enterprises be vacated.
