Re: Front Range Toll Road
Dear Mr. and Mrs. Green:
This letter is in response to your e-mail regarding the Front Range Toll Road project that has been of
concern to many over the last several months.
To date, representatives of the toll road have not contacted Weld County.
Concerning the issue of eminent domain, State Statutes require a very specific process laden procedure in
dealing with property acquisitions from landowners. In part, that procedure requires negotiations with the
affected landowner and an offer for the property based on fair market valued developed by a land appraiser.
If the property owner does not agree with the appraisal, they have a right to obtain their own appraisal and
the acquiring agency is required to reimburse the property owner for the cost of that work. Only after these
procedures have taken place and the negotiations are at an impasse, can the acquiring agency file an
eminent domain action.
If you have not been contacted by an agent of the Front Range Toll Road and activities similar to those
described above have not taken place, you may assume there is no eminent domain action underway.
The Board of County Commissioners has had general discussions regarding toll road issues. At this time they
are exploring the use of powers granted to counties in State Statues(C.R.S. 24-65.1-101) that would require
a permit, from the county, to undertake construction of a private toll road. Additionally, the State Statute
requiring the toll road agency to obtain approval for proposed tolls from each county is still in effect. Both of
these requirements will require a public hearing process and allow input from property owners impacted. The
Weld County Board of County Commissioners will be sensitive to property owner concerns during these
hearings.

We have recently aquired some information about this supper highway. Some time back a Tribune article
stated this road would be 12 miles East of highway 85. Having aquired a map, we are in this area. We also
understand that there has been an eminent domaine claim put on all property within the 12 miles, but has not
been registered with the state until the legislture masses a bill giving this group exclusive buying rights, at their
price and not fair market value. What information do you have about this matter? This property is our
livelyhood, as we are retired and do not belive this kind of eminent domaine should not be allowed to pass. Do
you intend to stand for us as property holders in this county?? Where do the county comissioners stand???
