Weld County Public Works Department has reviewed this change of zone request. Comments made during this phase
of the subdivision process may not be all-inclusive, as other concerns or issues may arise during the remaining
application process.
Comments
External Roadways:
❑ This development will introduce additional vehicle trips to the roadway system from the 9 proposed additional lots
(approximately 85 vehicle trips to the roadway system). According to the Gold Stone Creek Traffic Analyses(File: 0515ME01)
by Matt Delich (PE 15263) dated March 18, 2005, from Traffic & Transportation Engineering, "with the Gold Stone Creek
Development, the future average daily traffic will be well below the minimum threshold of 200 VPD to require paving or
treatment of WCR 29." Public Works is in agreement with the findings of the report and no off-site improvements are required.
❑ CR 29 is classified by the County(Weld County Roadway Classification Plan, June 2002) as a local gravel road(adjacent to the
proposed development) and requires a 60-foot right-of-way. The applicant has verified the existing right-of-way and the
documents creating the right-of-way have been noted on the change of zone plat. CR 29 is under the jurisdiction and maintenance
of Weld County.
1 CR 94 does not exist adjacent to this development on the section line. The applicant has submitted evidence of vacation of right-
of-way recorded with the Weld County Clerk&Recorder.
Internal Roadways:
❑ The applicant shall provide a pavement design prepared by a professional engineer along with the final plan submittal.
❑ Public Works has reviewed the revised cul-de-sac design and deemed it acceptable with regards projected floodways and
drainage.
❑ The Joint Access, Utility and Drainage Easement Typical Section (Lots 5 and 6) shown on Sheet 2 of 2 of the Intermill Land
Surveying, Inc. drawings and Sheet 9 of 10 on the Shear Engineering Corporation drawings must be classified as internal
roadway right-of-way and dedicated to the public.
o The internal roadway right-of-way shall be 60-feet in width and dedicated to the public.
o The typical cross-section of interior road shall be two 13-foot gravel lanes shown on the change of zone plat.
o The HOA covenants shall be responsible for maintenance of this segment of the internal roadway.
❑ Stop signs and street name sign locations to be shown on the final roadway construction plans have been included and duly noted
with zone change submittal.
❑ Easements to be shown on the final plat (in accordance with County standards (Sec.24-7-60) and / or Utility Board
recommendations)have been shown and duly noted with zone change submittal.
❑ Intersection sight distance triangles at the development entrance will be required. All landscaping within the triangles must be
less than 3'h feet in height at maturity,and noted on the final roadway plans.
o Sight triangles should be shown in reference to lanes of on-coming traffic (see northbound lane of WCR 29). The
applicant will be required to follow AASHTO - A Policy on Geometric Design of Highways and Streets 2004,
labeling site triangle geometry on the roadway plans.
❑ The applicant shall submit to Public Works stamped, signed and dated final plat drawings and roadway/construction& grading
plan drawings for review(with the final plan application) and approval. Construction details to be shown on final plat submittal
have been included and duly noted with zone change submittal package.
❑ The applicant shall submit Improvements Agreements According to Policy Regarding Collateral for Improvements with the final
plan application. These agreements must be reviewed by Public Works and shall be approved by the Board of County
Commissioners(BOCC)prior to recording any final plan.

Drainage:
❑ The Preliminary Drainage, Erosion Control and Water Quality Report for Gold Stone Creek Minor Subdivision,dated June 2005,
by Brian Shear, P.E.(Colorado PE#20262)with Shear Engineering Corporation(Project No: 2136-01-04)is satisfactory.
o The report notes a flood zone(Spring Creek drainage)passing through the proposed development site.
o The report shows calculated drainage and channel cross-sections using HEC-RAS models
o The report outlines design alternatives and analysis concluding on a levee system solution
❑ The applicant shall address building envelope locations (for Lot#4, Lot #5, Lot #7, and Lot #6) with the final plan application
materials. "In no case shall a one-hundred-year design storm frequency cause inundation to any structure or pose a hazard." It is
the Public Works recommendation to locate all building structures out of the known flood zone. Any structures located in close
proximity to a flood zone may consider standard flood protection measures,which may include raising the main floor elevation.
o Proposed building footprint locations have been shown to be compliant; however minimum building envelope
locations should also be included on final plat submittal.
❑ The applicant shall amend the required dimensions for the box culvert under the interior gravel roadway.
❑ A final drainage report stamped, signed and dated by a professional engineer licensed in the State of Colorado shall be submitted
with the final plan application,since a flood zone is noted as passing through the proposed site.
o The final drainage report shall include a flood hazard review documenting any FEMA defined floodplains or
floodways. The engineer shall reference the specific map panel number, including date. The development site shall
be located on the copy of the FEMA map.
o Stormwater runoff shall not adversely impact downstream storm drainage facilities.
o The report must include discussion of the flood zone and the impacts / implications with-respect-to the proposed
development, building structures, roadway, developed stormwater drainage, and HOA covenants /restrictions for a
major drainage way.
❑ The applicant shall prepare a construction detail for typical lot grading with respect to drainage for the final plan application.
Front, rear and side slopes around building envelopes must be addressed. In addition, drainage for rear and side lot line swales
shall be considered. Building envelopes must be planned to avoid storm water flows, while taking into account adjacent drainage
mitigation.
❑ Final drainage construction and erosion control plans (conforming to the drainage report) stamped, signed and dated by a
professional engineer licensed in the State of Colorado shall be submitted with each final plan (phase) application. These plans
(stormwater management plans) may be based on Urban Drainage methodology.
Recommendation
❑ The Public Works Department recommends approval of this change of zone.
The alpplicant shall address the comments listed above at the specific step of the review process stated. The review
process will continue only when all appropriate elements have been submitted. Issues of concern must be resolved
with the Public Works Department prior to recording the change of zone and final plates.'

The Department has reviewed this application. The applicant proposed a 9 lot minor subdivision on
74.11 acres. The minimum proposed lot size, 3.9 acres, and coupled with an overall density of one
septic system per 8.2 acres does meet current Department policy.
The application has satisfied Chapter 24 of the Weld County Code in regard to water and sewer
service. A letter of intent from North Weld County Water District was submitted with the Sketch Plan
application materials. A draft Agreement was submitted in the Change of Zone application materials.
Sewer will be provided by individual sewage disposal systems.
No new percolation data was submitted in the Change of Zone application. Therefore, the Sketch Plan
comments will be repeated:
Preliminary percolation data submitted in the application materials from Terra Logics
Consulting, dated October 11, 2004 indicates that most of the site is suitable for conventional
septic systems. Portions of Lots 4, 5, 6, and 7 are located within the boundary of the 100 year
flood plain, with significant portions of Lots 4 and 7 being within this boundary. Spring Creek
also lies within this flood plain boundary.
No septic systems are permitted to be installed within the flood way as stated in Colorado
Department of Public Health and Environment ISDS Guidelines Section VIII (17). The flood
way has not been delineated on the plat map; therefore, the Department recommends two
options for the applicant: place primary and secondary septic envelopes on Lots 4, 5, 6, and 7
that are located outside the boundary of the 100 year flood plain, or 2) determine and delineate
the flood way boundary on the plat map and locate the primary and secondary septic
envelopes outside the designated flood way boundary. The Department further recommends
that language for the preservation and/or protection of the second absorption field envelope be
placed in the development covenants. The covenants should state that activities such as
landscaping (i.e. planting of trees and shrubs) and construction (i.e. auxiliary structures, dirt
mounds, etc.) activities are expressly prohibited in the designated absorption field envelope.
The applicant has delineated the Floodway (Flood Zone A) boundary on the Change of Zone plat.
The applicant has also added a General Note#5 that is misleading and should be amended. The
wording implies that a lot owner could install a septic system in a Flood Zone A provided that they
apply for a Flood Hazard Development Permit through the Department of Planning Services. As
stated above: No septic systems are permitted to be installed within the flood way (Flood Zone A) as
stated in Colorado Department of Public Health and Environment ISDS Guidelines Section VIII (17).
There is no exception to this prohibition.

The Department recommends approval with the following conditions:
i
1. Water service shall be obtained from North Weld County Water District
2. This subdivision is in rural Weld County and is not served by a municipal sanitary sewer
system. Sewage disposal shall be by septic systems designed in accordance with the
regulations of the Colorado Department of Public Health and Environment, Water Quality
Control Division and the Weld County Code in effect at the time of construction, repair,
replacement, or modification of the system.
'3. General Note #5 on the Rezoning Plat, Vicinity, and Land Use map must be reworded to
exclude any inferred or implied language that septic systems can be installed in Flood Zone
A at any time.
3. Primary and secondary septic envelopes shall be placed on each lot. All septic system
envelopes must meet all setbacks, including the 100-foot setback to any well.
Language for the preservation and/or protection of the absorption field envelopes shall be
placed in the development covenants. The covenants shall state that activities such as
permanent landscaping, structures, dirt mounds or other items are expressly prohibited in
the absorption field site.
6. A stormwater discharge permit may be required for a development/redevelopment
/construction site where a contiguous or non-contiguous land disturbance is greater than or
equal to one acre in area. Contact the Water Quality Control Division of the Colorado
Department of Public Health and the Environment at
www.cdphe.state.co.us/wq/PermitsUnit for more information.
7. During development of the site, all land disturbances shall be conducted so that nuisance
conditions are not created. If dust emissions create nuisance conditions, at the request of
the Weld County Health Department, a fugitive dust control plan must be submitted.
8. In accordance with the Regulations of the Colorado Air Quality Control Commission any
development that disturbs more than 5 acres of land must incorporate all available and
practical methods that are technologically feasible and economically reasonable in order to
minimize dust emissions.
If land development creates more than a 25-acre contiguous disturbance, or exceeds 6
months in duration, the responsible party shall prepare a fugitive dust control plan, submit
an air pollution emissions notice, and apply for a permit from the Colorado Department of
Public Health and Environment.
10. "Weld County's Right to Farm"as provided in Appendix 22-E of the Weld County Code shall
be placed on any recorded plat.

4. Building permits shall be obtained prior to the construction of any building. Building permits are
required for the principle dwelling and for buildings accessory to the principle dwelling.
'2. A plan review is required for each building. Two complete sets of plans are required when applying
for each permit. Each building may be required to be designed by a Colorado registered engineer.
-3. Buildings shall conform to the requirements of the codes adopted by Weld County at the time of
permit application. Current adopted codes include the 2003 International Building Code; 2003
International Mechanical Code; 2003 International Plumbing Code; 2003 International Fuel Gas Code;
2002 National Electrical Code and Chapter 29 of the Weld County Code.
4. Each building will require an engineered foundation based on a site-specific geotechnical report or
an open hole inspection performed by a Colorado registered engineer. Engineered foundations shall be
designed by a Colorado registered engineer.
''5. Fire resistance of walls and openings, construction requirements, maximum building height and
allowable areas will be reviewed at the plan review. Setback and offset distances shall be determined
by the Zoning Ordinance.
6. Building height shall be measured in accordance with the 2003 International Building Code for the
purpose of determining the maximum building size and height for various uses and types of construction
and to determine compliance with the Bulk Requirements from Chapter 23 of the Weld County Code.

Dear Mr. Gathman: -
We have reviewed the above referenced proposal to subdivide a 74.11-acre parcel into
9 single-family residential lots ranging in size from 3.9 acres to 11.5 acres. The Water Supply
Information Summary Form included in the referral material indicates that the water
requirements for the subdivision are 9 acre-feet. The water use estimate appears to be high
compared to a typical estimate based on an average of 3.5 persons per dwelling and 80 gallons
per person per day. No outside uses were identified for any of the 9 residential lots.
The proposed water source for this subdivision is identified as the North Weld County
Water District ("District"). A letter of commitment for service from the District was not provided.
Based on current information on file in this office, the District will typically furnish 70% of an
acre-foot (228,000 gallons) of water per tap per annual water year if the allotment for the
Colorado-Big Thompson (CBT) project water, as determined by the Northern Colorado Water
Conservancy District, is 50% or greater. The District will restrict the delivery as necessary when
the CBT allotment is less than 50%.
In addition, according to our records, well permit no. 254251 was issued on November
26, 2003 as the only well on tract of land of 40 acres described as the S1/2 of the N1/2 of the
NW 1/4 of Section 16, Township 8 North, Range 66 West of the 6th P.M. The use of ground
water from this well is limited to fire protection, ordinary household use inside three (3) single-
family dwellings, the watering of poultry, domestic animals and livestock on a farm or ranch and
the irrigation of not more than one acre of home garden and lawns. Our records show that well
permit no. 254251 has not been constructed, and the permit is due to expire on November 26,
2005, if the well is not constructed, or an extension is not obtained. Please note that 40 acres of
the 74.11-acre parcel proposed to be subdivided is presently encumbered by well permit no.
254251 (copy enclosed), therefore the applicant needs to provide information if well permit no.
254251 (if constructed)will be used to supply water to any of the lots in the subdivision.
Since insufficient information was provided, we cannot comment on the potential for
injury to existing water rights under the provisions of CRS 30-28-136(1)(h)(II).

To Whom It May Concern,
The Weld Re-9 School district has reviewed the plans and information for
the Gold Stone Creek subdivision as referenced in MZ-1081. The District
requests a cul-de-sac turn around with a 45 foot turning radius. The plan for
this subdivision does meet this requirement. In addition to the transportation
requirements, the district would require an in-lieu of fee for the nine lots
being created.
The total in-lieu payment per parcel of land separated from the original unit
with the intent of future residential development is $759. The plan for the
property described in MZ-1081 will result in nine new residential lots being
created; therefore, your total in-lieu payment will be $6,831.00.
Payment should be hand delivered to the Weld RE-9 School District
Administration Office, 210 West First Street, Ault, or mailed to Weld RE-9
School District, P.O. Box 68, Ault, Colorado 80610. Please include your
Recorded Exemption (RE) number for reference. A receipt will be mailed
