RE: CHANGE OF ZONE, MZ#1025, FROM THE A (AGRICULTURAL) ZONE DISTRICT TO
THE E (ESTATE) ZONE DISTRICT FOR AN EIGHT (8) LOT MINOR SUBDIVISION -
ROBERT PARSONS
A public hearing was conducted on July 27, 2005, at 10:00 a.m., with the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated July 8,2005,and duly published July 13,2005,in the
Fort Lupton Press, a public hearing was conducted to consider the request of Robert Parsons for
Change of Zone, MZ#1025, from the A(Agricultural)Zone District to the E(Estate)Zone District
for an eight (8) lot Minor Subdivision - Peace Haven Estates. Lee Morrison, Assistant County
Attorney,made this a matter of record. Chair Pro-Tem Geile advised the applicant's representative,
Jeffrey Couch,TEAM Engineering,that he has the option of continuing this matter to a date when
the full Board will be present. However, if he decides to proceed today, it will require three
affirmative votes,or in the case of a tie vote,CommissionerJerke will listen to the record and make
the determining vote. Mr. Couch indicated he would like to proceed today.
Sheri Lockman, Department of Planning Services,presented a brief summary of the proposal and
entered the favorable recommendation of the Planning Commission into the record as written. She
gave a brief description of the location of the site and surrounding land uses. She stated 14 referral
agencies reviewed this proposal, 12 responded favorably or provided comments that have been
addressed in the Conditions of Approval and Development Standards, and staff has not received
any correspondence from surrounding property owners. Ms. Lockman displayed photographs of
the site and surrounding area, and responding to Chair Pro-Tem Geile, she stated there are large
wooden power poles located on the south side of Weld County Road 84, as well as large metal
poles on the north side of the road.
Char Davis, Department of Public Health and Environment, stated the lots will have conventional
septic systems and will be serviced by the North Weld County Water District.
Peter Schei, Department of Public Works, stated staff has no concerns at this time.

Mr. Couch stated this development will have eight lots with E (Estate) Zone uses, accessed by
a 1,300-foot cul-de-sac. He stated the applicant is working on an agreement with the Ditch
Company for the ditch that crosses the property;however,this is not an irrigated parcel. He further
stated there is a 75-foot easement along the northern property line for the power line, and the
applicant intends to situate the building envelopes away from the power line. Mr.Couch stated the
site will be serviced by an off-site water line from the North Weld County Water District,which will
supply water for fire and domestic uses. He stated an Off-site Improvement Agreement and the
associated costs are being reviewed, and the lots will have room for secondary leach fields. He
further stated there will be a designated area at the access for bus pickup/drop off,mail delivery,and
placement of an identification sign to assist the Sheriff's Office. Responding to Commissioner
Vaad, Mr.Couch stated the lots will have Ault addresses corresponding to Weld County Road 84.
In response to Chair Pro-Tem Geile, Ms. Lockman stated the Ditch Agreement is addressed as a
Condition of Approval for Final Plan.
No public testimony was offered concerning this matter. In response to Chair Pro-Tem Geile, Mr.
Couch stated he and the applicant have reviewed and concur with the Conditions of Approval as
proposed. Ms. Lockman corrected Mr. Couch's previous comment by stating the lots will have
addresses associated to Peace Haven Drive,which is the internal cul-de-sac extending from Weld
County Road 84.
Commissioner Vaad moved to approve the request of Robert Parsons for Change of Zone,
MZ#1025,from the A(Agricultural)Zone District to the E(Estate)Zone District for an eight(8)lot
Minor Subdivision-Peace Haven Estates,based on the recommendations of the Planning staff and
the Planning Commission,with the Conditions of Approval as entered into the record. The motion
was seconded by Commissioner Masden, and it carried unanimously. There being no further
discussion, the hearing was completed at 10:15 a.m.
This Certification was approved on the 1st day of August 2005.
