RE: APPROVE PETITIONS FOR ANNEXATION FOR PORTIONS OF WELD COUNTY
ROADS 4 AND 6,AND ROAD RIGHT-OF-WAY FOR WELD COUNTY ROAD 35 TO THE
TOWN OF LOCHBUIE AND AUTHORIZE CHAIR TO SIGN
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS,the Board has been presented with a Petition for the Annexation for Portions of
Weld County Roads 4 and 6, and Road Right-of-Way for Weld County Road 35, being more
particularly described in Exhibit A to said Petition, to the Town of Lochbuie, Colorado and
WHEREAS,after review,the Board deems it advisable to approve said petitions,a copy of
which is attached hereto and incorporated herein by reference.
NOW,THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado,that the Petition for the Annexation for Portions of Weld County Roads 4 and 6,
and Road Right-of-Way for Weld County Road 35 to the Town of Lochbuie be, and hereby is,
approved, upon the following conditions:
a. No accesses currently in place to adjacent properties from said roadways shall be
denied or removed by the Town of Lochbuie following annexation without the consent
of the owners of said adjacent properties, or upon emergency basis.
b. No unreasonable restrictions on the use of said roadways by farm implements shall
be imposed by the Town of Lochbuie following annexation.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to
sign said petitions.

PETITION FOR ANNEXATION
PORTIONS OF WELD COUNTY ROAD NOS. 4, 6 AND 35
TO: THE TOWN CLERK AND THE BOARD OF TRUSTEES OF THE TOWN OF
LOCHBUIE, COLORADO
The undersigned, in compliance with the "Municipal Annexation Act of 1965," C.R.S.
§31-12-101 et seq., as amended, hereby petition the Board of Trustees of the Town of
Lochbuie, Colorado, for annexation to the Town of Lochbuie, of the following described
unincorporated territory located in the County of Weld, State of Colorado, and more
particularly described in Paragraph 5 below. In support of said Petition for Annexation, the
undersigned submit the attached annexation map, and state and allege as follows:
1. It is desirable and necessary that the property described in Exhibit A be annexed to
the Town of Lochbuie, Colorado.
2. The requirements of C.R.S. §§ 31-12-104 and 31-12-105, as amended, exist and
have been met as follows:
a. Not less than one-sixth (1/6) of the perimeter of the area proposed to be annexed is
contiguous with the Town of Lochbuie, Colorado.
b. A community of interest exists between the Town and the area proposed to be
annexed to the Town of Lochbuie, Colorado.
c. The area proposed to be annexed is urban or will be urbanized in the near future.
d. The area proposed to be annexed is integrated or is capable of being integrated with
the Town of Lochbuie, Colorado.
e. In establishing the boundaries of the area proposed to be annexed, no real property
held in identical ownership, whether consisting of one tract or parcel of real estate or
two or more contiguous tracts or parcels of real estate, will be divided into separate
parts or parcels without the written consent of the landowners.
f. In establishing the boundaries of the area proposed to be annexed, no real property
held in identical ownership, whether consisting of one tract or parcel of real estate or
two or more contiguous tracts or parcels of real estate, comprising twenty (20) acres
or more (which together with the buildings and improvements situated thereon has a
valuation for assessment in excess of $200,000.00 for ad valorem tax purposes for
the year next preceding the annexation) shall be included without the written consent
of the landowners.
g. The property proposed for annexation is not presently part of any incorporated city or
town, nor have annexation proceedings been commenced for the annexation of part
of all of such property to another municipality.
h. The proposed annexation will not result in the detachment of real property from any
school district and the attachment of same to another school district.

i. The proposed annexation will not have the effect of extending the municipal
boundary more than three (3) miles in any direction in one (1) year.
3. The undersigned are the owners of 100% of the real property proposed to be
annexed and hereby consent to the establishment of the boundaries of this property as
shown on the annexation map submitted herewith.
4. No election for annexation to the Town of Lochbuie, Colorado, has been initiated for
the real property to be annexed hereunder within the preceding twelve (12) months.
5. The legal description of area to be annexed is attached hereto as Exhibit A and
incorporated herein by this reference.
WHEREFORE, the undersigned request that the Town approve the annexation of
the property described in this Petition.

Attached is the Weld County Road annexation petition with legal descriptions inserted as Exhibit A. The one
funny thing here (there always has to be something...) is that our engineers have woven two PSCO parcels into
the order of the road annexations. They believe that is the easiest way to achieve contiguity.
You will see that"Annexation No. 15" is missing from this Exhibit A. Annexation No. 15 is described in PSCO's
annexation petition. I reference it in a footnote, however, to try to explain the number jump. If you have received
plats of Annexation No. 15, you may discard them or use for illustrative purposes.
Despite our efforts, it does not look like PSCO will have all its ducks in a row to submit its annexation petition this
week. Since the County's annexation petition and PSCO's must be considered at the same time,we will hold on
to the County's petition until we get PSCO's and then submit both to the Board at the same time.
If you have any hesitation about doing things this way, certainly let me know. Another option is to hold off
presenting this to the BOCC until PSCO's petition is ready to go. Whatever you are more comfortable with is fine
with me.
