Comments Plans reviewed are stamped and dated January 12,2005,by Jasper Freese,P.E. (Colorado P.E.4392). ❑ Public Works finds the Appaloosa Acres Estates PUD Traffic Study, dated December 21, 2004, by Matthew J. This request is based on the seeming low estimated costs shown on Exhibit"A". Contractor estimates submitted to Pubic Works should be on the Contractor's letterhead with a contact person, telephone number and address. The improvements we are interested in include: site grading, street grading, street base, street paving, culverts, storm sewer facilities (weirs), and retention/detention ponds. o The applicant should also include costs associated with erosion control, lot access culverts, 10-inch PVC pipe, rip- rap,street signing, and detention pond flap gates. Recommendation ❑ The above comments are prerequisites and shall be fulfilled prior to recording the final plat. Department o Public • COLORADO Health and Environment CASE NO.: PF-1020 NAME: Clifford Clift/Appaloosa Acres The Weld County Health Department has reviewed this final plat application. The applicant proposes a 22 lot PUD on 61 acres. The minimum proposed lot size (1.0 acre) coupled with the overall density of one septic system per 2.77 acres does meet current Department policy. Two septic system envelopes have been located on each lot. Section 26 (page 9) of the Covenants states, in part..."any other activity which will interfere with the construction, maintenance or function of the leach fields shall be restricted over the absorption field areas while in use." This specific language implies that the unused septic envelope can be used for those activities until needed. The Departments requested that the covenant language state that the secondary envelope be preserved for future use. The Department requests that this language be amended. The application was approved with the following Department recommended conditions being placed as notes on the plat: 1. Water service shall be obtained from the North Weld County Water District. 2. This subdivision is not served by a municipal sanitary sewer system. Sewage disposal shall be by septic systems designed in accordance with the regulations of the Colorado Department of Public Health and Environment, Water Quality Control Division and the Weld County Code in effect at the time of construction, repair, replacement,or modification of the system. Septic systems shall be designed for site specific conditions including, but not limited to, shallow groundwater, bedrock, gravel and/or clay. 3. Primary and secondary septic envelopes shall be placed on each lot. All septic system envelopes must meet all setbacks, including the 100-foot setback to any irrigation ditch. 4. Language for the preservation and/or protection of the absorption field envelopes shall be placed in the development covenants. The covenants shall state that activities such as permanent landscaping, structures, dirt mounds, animal husbandry activities, or other activities that would interfere with the construction, maintenance, or function of the fields should be restricted over the absorption field areas while in use. 5. If required, the applicant shall obtain a storm water discharge permit from the Water Quality Control Division of the Colorado Department of Public Health and the Environment. Silt fences shall be maintained on the down gradient portion of the site during all parts of the construction phase of the project. 1 6. During development of the site, all land disturbances shall be conducted so that nuisance conditions are not created. If dust emissions create nuisance conditions,at the request of the Weld County Health Department, a fugitive dust control plan must be submitted. 7. In accordance with the Regulations of the Colorado Air Quality Control Commission any development that disturbs more than 5 acres of land must incorporate all available and practical methods that are technologically feasible and economically reasonable in order to minimize dust emissions. 8. If land development creates more than a 25-acre contiguous disturbance, or exceeds 6 months in duration, the responsible party shall prepare a fugitive dust control plan, submit an air pollution emissions notice, and apply for a permit from the Colorado Department of Public Health and Environment. 9. "Weld County's Right to Farm" as provided in Appendix 22-E of the Weld County Code shall be placed on any recorded plat. Water Division 1, Water District 1 Dear Mr. Ogle: We have reviewed the above referenced proposal to subdivide a 62-acre parcel into 22 single-family residential lots of approximately 1 acre in size, and 35 acres of open space that will be maintained by the homeowner's association. Our records show that the State Engineer's Office previously commented on this subdivision proposal by our letters dated September 18, 2002 and December 22, 2003. Information from this submittal indicates that this is the Final Plat for this subdivision. The proposed water supply is still listed as the North Weld County Water District (District), which will provide 23 taps; 22 of which will be for the residences and the 23rd will provide drip irrigation to the landscaped area. Each of the taps will provide 228,000 gallons per year (approximately 0.7 acre-feet per year). The District has agreed to serve the proposed site and information from a previous referral indicates that water requirements are conditionally met. Based on current records on file in this office, the District currently has an adequate uncommitted water supply to provide the water associated with this project. Additional information provided in this referral indicates that two shares of The Larimer & Weld Irrigation Company will provide irrigation water for the open space. However, no other information was provided on these water rights proposed for this use. Therefore, we cannot comment on the adequacy of the irrigation water. Pursuant to Section 30-28-136(1)(h)(II), C.R.S., the State Engineer's office offers the opinion that with the District as the water supplier for the 22 single-family residential lots, the proposed water supply can be provided without causing material injury to existing water rights and the supply is expected to be adequate. The Eaton School District has a process in place addressing growth within the District. The School District has adopted a methodology to determine a cash-in-lieu payment for residential development within the District in order to provide adequate educational opportunities as a result of that development. The cash-in-lieu payment per dwelling lot is $1,043 for a total of $22,946 for this 22-Lot PUD. Payment should be hand delivered or mailed to Eaton School District, 200 Park Avenue, Eaton, Colorado 80615. A receipt will be mailed to the applicant and a copy to the Weld County Planning Department. Payment will be required prior to final plat approval by Weld County. We are anticipating student enrollment from this residential development to attend school in the Town of Eaton. However, depending on growth from development within the District, this could be subject to change, with the potential of students from this development attending Galeton Elementary for grades kindergarten through fifth grade. In the final plat drawing dated November 29, 2004, the developer has met our requirements for a bus loading entrance of 15' wide x 80' in length as the District typically does not go into developments to pick up students. The developer also states that a covered bus shelter will be provided (similar to what is found at city bus stops)that blocks the wind on three sides with a roof to protect students while they are waiting for the bus. The size of the structure would be would be approximately 8'x 15' location placement on the final plat is acceptable. Please contact me if you have any questions. PF-1020 1. A separate building permit shall be obtained prior to the construction of any building. 2. A plan review is required for each building. Plans may be required to bear the wet stamp of a Colorado registered architect or engineer. Two complete sets of plans are required when applying r-. for each permit. 3. Buildings shall conform to the requirements of the codes adopted by Weld County at the time of permit application. Current adopted codes include the 2003 International Residential Code; 2003 International Building Code; 2003 International Mechanical Code; 2003 International Plumbing Code; 2003 International Fuel Gas Code; 2002 National Electrical Code and Chapter 29 of the Weld County Code. 4. Each building will require an engineered foundation based on a site-specific geotechnical report or an open hole inspection performed by a Colorado registered engineer. Engineered foundations shall be designed by a Colorado registered engineer. 5. Fire resistance of walls and openings, construction requirements, maximum building height and allowable areas will be reviewed at the plan review. Setback and offset distances shall be determined by the Zoning Ordinance. 6. When measuring buildings to determine offset and setback requirements, buildings are measured to the farthest projection from the building.
