RE: ACTION OF BOARD CONCERNING EXTENSION OF TEMPORARY CERTIFICATE OF
OCCUPANCY TO OWENS-BROCKWAY GLASS CONTAINER, INC.
WHEREAS,the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS,on September 15, 2005, the Weld County Building Inspection Department
issued to Owens-Brockway Glass Container, Inc. ("Owens-Brockway"),a Temporary Certificate
of Occupancy for its manufacturing plant located at 11133 WCR 64.75,which expired October 14,
2005, and
WHEREAS,the Temporary Certificate of Occupancy was renewed on October 14, 2005,
but expired on November 4, 2005, and
WHEREAS,at a public hearing on November 7,2005,the Board of County Commissioners
considered whether it should renew again the Temporary Certificate of Occupancy, and
WHEREAS, at said hearing, Jerry Ward, Fire Chief of the Windsor-Severance Fire
Protection District,stated that three of the District's four outstanding issues have been resolved,and
that the fourth issue may be appealed by the contractor for Owens-Brockway, with said appeal
taking approximately three weeks to complete, and
WHEREAS,the Board deems it advisable to renew the Temporary Certificate of Occupancy
for a term of six (6) months, and that any violation action started by the Building Inspection
Department against Owens-Brockway for the expiration of the Temporary Certificate of Occupancy
be dismissed.
NOW,THEREFORE,BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Temporary Certificate of Occupancy for Owens-Brockway Glass
Container, Inc.be extended for a term of six(6)months,and that any violation action started by the
Building Inspection Department against Owens-Brockway for the expiration of the Temporary
Certificate of Occupancy be, and hereby is, dismissed.

RE: Temporary Certificate of Occupancy for 11133 CR 64.75 ( BCN-040122)
Dear Mr. Wendles:
Final building and electrical inspections were requested for November 4,2005.The building and electrical code corrections of
November 4, 2005 need to be corrected. The temporary certificate of occupancy issued on September 15, 2005 expired on
October 14,2005. It was renewed on October 14,2005 and expired on November 4,2005. Sec.29-3-310 of the Weld County
code states: "The temporary certificate shall be valid for a certain period of time not to exceed ( 90 ) days and may be
renewed only once by the Building Official."The temporary certificate of occupancy was renewed the first time on October 14,
2005. A temporary certificate of occupancy with these corrections ,The issues with Windsor Fire Protection District remain to
be resolved. Sec. 29-9-10 (c ) of the Weld County Code states: "A final inspection and certificate of occupancy shall not be
issued by the Building Inspection Department until the fire suppression systems have been approved by the Fire Department
or District."
Sec. 29-3-280 of the Weld County Code requires that a Certificate of Occupancy be issued before a building is occupied.
Sec.29-11-30 states: "Whenever any structure is being used contrary to the provisions of this Building Code, the Building
Official may order such use discontinued and the structure or portion thereof vacated by notice served on any person causing
such use to be continued. Such person shall discontinue the use within (10) days of receipt of such notice, or make the
structure or portion thereof comply with the requirements of this building code."
Because I cannot extend the temporary certificate of occupancy and the building is in violation of Sec.29-3-280 and Sec.29-
11-30, I have scheduled a meeting with the Weld County Board of County Commissioners on November 7,2005,at 9:00 a.m.
to consider this violation.
This meeting will take place in the Commissioners', hearing room at 915 10th Street, Greeley, Colorado. It is recommended
that you or a representative attend this meeting to answer any questions the Board may have regarding the violation.

Dear Monica:
The Lathrop Company is hereby requesting an extension to the Temporary Certificate of
Occupancy for the above referenced. This request is due to the inability to resolve an
issue with the Windsor Severance Fire District relative to an interpretation of the IFC 203
910.4.4 regarding wiring of smoke evacuation systems. It is our interpretation that the
system installed at the above-mentioned facility meets this code. We plan to file an
appeal with Windsor Severance Fire Protection district regarding this ruling.
