The Department has reviewed the Final Plat application. There are no plat notes on the final plat
(revision date 1/14/05).
The Change of Zone application was approved with the following conditions:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act,
30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner
that protects against surface and groundwater contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include
those wastes specifically excluded from the definition of a solid waste in the Solid Wastes
Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive
dust, blowing debris, and other potential nuisance conditions.
4. Fugitive dust shall be controlled on this site.
5. This facility shall adhere to the maximum permissible noise levels allowed in the Industrial
Zone as delineated in 25-12-103 C.R.S., as amended.
6. All septic systems located on the property shall be properly abandoned in accordance with
Section 30-4-20(D) of the Weld County Code.

I have reviewed the submitted material pertaining to the Final Plat for the Applied Films
Corporation (Case Number: PF-1059). The Fire District does not object to the final plat and any
subsequent development, provided the development is able to meet the requirements of the Fire
District. If at the time development occurs the property is still within the territorial boundaries of
the Fire District, all applicable District codes as they pertain to water supply, fire hydrant
locations, and fire department access must be met.
Nothing in this review is intended to authorize or approve of any aspect of this project that does
not comply with all applicable codes and standards. We appreciate being involved in the

COLORADO SUBJECT: PF-1059 Applied Films PUD(Final Plat) sign-off
Weld County Public Works Department has reviewed final plan materials and has the following development referral
comments.
Comments
❑ The east 1-25 frontage road is under the jurisdiction of the Colorado Department of Transportation (CDOT). The east I-25
frontage road serving this PUD is paved. A traffic study is not currently required.
❑ Normally Public Works has an understanding of the proposed development and potential impacts on surrounding infrastructure.
This proposed zone change to a commercial use may possibly contribute significant traffic to the surrounding area. The applicant
may be required to participate and contribute to improvements to the surrounding transportation infrastructure at the site plan
review application. The applicant will not be required to submit off-site roadway improvements agreements at this time.
❑ This development is within the MUD Area Structural Plan; therefore the applicant will be required to build the appropriate urban
roadway infrastructure specified(CODE Sec.26-2-80)as part of the site plan review process.
❑ Usually, the plan that Public Works reviews has an internal roadway system. The applicant has not indicated internal roadways on
the plan, and Public Works has no comment at this time. Transportation and roadway infrastructure will be reviewed at the time
specific development is proposed for this site.
❑ The applicant shall submit to Public Works stamped, signed and dated final roadway/ construction& grading plan drawings for
review(with the site plan review application)and approval. Construction details must be included.
❑ The applicant shall submit Improvements Agreements According to Policy Regarding Collateral For Improvements (with the site
plan review application). These agreements must be reviewed by Public Works and shall be approved by the Board of County
Commissioners(BOCC).
❑ The Drainage Report for Applied Films PUD,dated March 2004,by Messner Engineering, Inc. is acceptable.
❑ Final drainage construction and erosion control plans (conforming to the drainage report) stamped, signed and dated by a
professional engineer licensed in the State of Colorado must be submitted with the site plan review application.
Recommendation
❑ The Public Works Department effectively `signs-off on this development with no recognized issues.
The Planning Department may proceed with this case based upon the recommendation,with no restrictions by
Public Works.'

Jacqueline- We will be sending Applied Films our standard annexation agreement that we use for these
types of situations. The property is in the Firestone Urban Growth Boundary and we understand the
proposal is for urban development. The Town recognizes there may be a need to build contiguity and
address utility issues if the property were to annex. However, those types of issues have been dealt with
in prior agreements and if the project is to proceed in the County, the Town will require an agreement that
will give the Town the authority to annex the property upon request by the Town (unless otherwise
agreed). There may be some other specific provisions that specifically relate to this property as
established by the Town Board, and those will need to be in the agreement. Our view is that, per the IGA,
the agreement does need to be in place prior to recording of entitlements. Please contact me if you have

Good morning
Anne Best Johnson was in our office this morning trying to submit her application for Applied Films Final Plat application.
As a condition of the Change of Zone hearing at the time of submitting for Final "The applicant shall provide written
evidence of a request for an annexation agreement with the Town of Firestone". A representative is going to be sending
you a letter requesting annexation. I have asked that this letter is sent certified so we will know that you did receive the
letter. My question for you is, are you going to request an annexation agreement with Applied Films? Anne mentioned
that the Town of Firestone was requiring that Applied Films force annex other properties so they can be annexed.
Flagpole up the 1-25 frontage road? Any information etc that you may have on this or what you will be requiring would be
GREAT. Are you going to be requesting that at Prior to Recording the Final Plat the applicant enter into an annexation
agreement?
