This site p/an review is approved with the attached conditions:
1. The Site Plan Review Map shall be prepared in accordance with Section 23-2-160.V of
the Weld County Code. The applicant shall submit a paper copy of the plat for
preliminary approval to the Weld County Department of Planning Services. Upon
approval of the paper copy the applicant shall submit a Mylar plat along with all other
documentation required as Conditions of Approval. The Mylar plat shall be recorded in
the office of the Weld County Clerk and Recorder by Department of Planning Services'
staff within 3Q days of the approval and with payment of eleven ($11.00) dollars for the
first sheet and ten ($10.00) per additional sheet. (Department of Planning Services)
2. Prior to recording the Site Plan Review plat, the applicant shall address the following to
the Department of Planning Services' satisfaction:
/Y The applicant shall provide written evidence to the Department of Planning
Services that the Mountain View Fire Protection District has reviewed the access

Services that the trash collection company can physically maneuver a vehicle to
the dumpster location and successfully unload and replace the trash container.

H. The applicant shall submit evidence to the Department of Planning Services that
all conditions and requirements as indicated in the Department of Public Works

I. The applicant shall submit evidence to the Department of Planning Services that
a water tap request form and utility plan have been submitted and approved by
Left Hand Water District as outlined in their referral dated August 5, 2005.

an application for service with the St. Vrain Sanitation District has been submitted

K. The applicant shall enter into an Improvements Agreement according to policy
regarding collateral for improvements and post adequate collateral for all
transportation (access drive, parking areas, etcetera) and non-transportation
(plant materials, fencing, screening, etcetera). The agreement and form of
collateral shall be reviewed by County Staff and accepted by the Board of County
Commissioners prior to recording the plat. (Department of Planning Services)
L. The plat shall be amended to delineate the following:
1. The Site Plan Review Plat shall be prepared in accordance with Section
23-2-16O.V of the Weld County Code. (Department of Planning Services)
2. The initial parking required for this facility is 31 parking spaces of which
two must meet the requirements of the Americans with Disabilities Act.
Parking spaces shall be delineated on future plats, with specific call-outs
for employee parking and for customer parking. The parking stalls shall
adhere to Section 23-4-3O.B, Appendix 23-A of the Weld County Code.

3. This site will be required to meet all requirements of the American
Disability Act (ADA). ADA parking spaces are twenty (20) feet by eight
(8) feet with five (5) foot aisles. A minimum of two spaces must be van
accessible with an eight (8) foot aisle. An accessible path shall be
required from the building to the public right-of-way. Further, the ramps
from the parking area shall identify a landing area for non-ambulatory
users of this facility. (Department of Planning Services)
4. Section 26-2-70.C.1 of the Weld County Code states that at least ten
percent of the area of a parking lot must be landscaped if the lot contains
ten or more spaces. Trees planted in parking areas should be either in
bays or planting islands of at least five feet by five feet. (Department of

5. The applicant shall delineate the location of all curb stops in the parking
areas per Section 23-4-30.D of the Weld County Code. (Department of

6. The width of the parking stalls shall be delineated on the plat.

7. Section 23-3-350.F of the Weld County Code states that off-street parking
areas may be permitted in the required setback/offset when the area is
screened from adjacent properties. The parking lot shall either be
relocated outside the 10' offset or shall be screened. (Department of

8. The applicant shall submit a signage plan in compliance with Section 26-
2-90 of the Weld County Code. (Department of Planning Services)
9. The applicant shall adhere to the lighting standards, in accordance with
Section 23-4-30.E, Section 23-2-250 and Section 23-3-250.6.6 of the
Weld County Code. (Department of Planning Services)
10. Should outside storage of vehicles, equipment or materials be utilized on
this property, the materials shall be screened from public rights-of-way
and all adjacent properties. (Department of Planning Services)
11. The applicant shall require all manufacturing and warehouse tenants to
submit a waste handling plan, for approval, to the Environmental Health
Services Division of the Weld County Department of Public Health and
Environment. Evidence of approval shall be submitted to the Department
of Planning Services. The plan shall include at a minimum, the following:
a. A list of wastes which are expected to be generated on site (this
should include expected volumes and types of waste generated).
b. A list of the type and volume of chemicals expected to be stored
on site.
c. The waste handler and facility where the waste will be disposed
(including the facility name, address, and phone number).

M. The following notes shall be placed on the plat:
1. In accordance with the Weld County Code, no land, building or structure
shall be changed in use or type of occupancy, developed, erected,
constructed, reconstructed, moved or structurally altered or operated in
the Commercial/Industrial Zone District until a Site Plan Review has been
approved by the Department of Planning Services. (Department of

2. The application does not propose any portion of the site to be leased to
another party. In the event that a portion of the building or lot is proposed
to be leased to another party in the future, the applicant shall submit a
copy of the lease agreement and information regarding the proposed use
of the leased portion to the Weld County Attorney's office, Weld County
Building Inspection Department, Mountain View Fire Protection District

and the Department of Planning Services for review. Based upon the
proposed use and/or impacts of the leased portion, the Department of
Planning Services may require a new Site Plan Review application and/or
a Final Plat Resubdivision. (Department of Planning Services)
3. The facility shall utilize the internal road access Vista View Drive. There
will be no staging or parking of vehicles on Vista View Drive. On-site
parking shall be utilized at all times. (Departments of Planning Services)
4. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites
and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and
removed for final disposal in a manner that protects against surface and
groundwater contamination. (Department of Public Health and

5. No permanent disposal of wastes shall be permitted at this site. This is
not meant to include those wastes specifically excluded from the
definition of a solid waste in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended. (Department of Public

6. Waste materials shall be handled, stored, and disposed in a manner that
controls fugitive dust, fugitive particulate emissions, blowing debris, and
other potential nuisance conditions. (Department of Public Health and

7. The manufacturing and warehouse tenants shall operate in accordance
with approved "waste handling plan". (Department of Public Health and
Environment)
8. Fugitive dust and fugitive particulate emissions shall be controlled on this
site. (Department of Public Health and Environment)
9. This facility shall adhere to the maximum permissible noise levels allowed
in the Commercial Zone as delineated in 25-12-103 C.R.S., as amended.

10. Adequate handwashing and toilet facilities shall be provided for
employees and patrons of the facility. (Department of Public Health and

11. The facility shall utilize the existing municipal sewage treatment system.

12. The facility shall utilize the existing public water supply. (Left Hand Water

13. All potentially hazardous chemicals must be stored and handled in a safe
manner in accordance with product labeling and in a manner that
minimized the release of hazardous air pollutants (HAP's) and volatile

organic compounds (VOC's). (Department of Public Health and

14. The operation shall comply with all applicable rules and regulations of the
State and Federal agencies and the Weld County Code. (Department of

15. The historic stormwater flow patterns and run-off amounts will be
maintained on site in such a manner that it will reasonably preserve the
natural character of the area and prevent property damage of the type
generally attributed to run-off rate and velocity increases, diversions,
concentration and/or unplanned ponding of storm run-off. (Department

16. Landscaping materials as indicated in the approved Landscape Plan shall
be maintained at all times. Dead or diseased plant materials shall be
• replaced with materials of similar quantity and quality at the earliest
possible time. (Department of Planning Services)
17. All structures, including signs, on site must obtain the appropriate building
permits. (Departments of Planning Services and Building Inspection)
18. Effective January 1, 2003, Building Permits issued on the proposed lots
will be required to adhere to the fee structure of the County Road Impact
Program. (Ordinance 2002-11)
19. Effective August 1, 2005, Building permits issued on the subject site will
be required to adhere to the fee structure of the Capital Expansion Impact
Fee and the Stormwater/Drainage Impact Fee. (Ordinance 2005-8
Section 5-8-40)
20. Buildings shall conform to the requirements of the various codes adopted
at the time of permit application. Currently the following has been
adopted by Weld County: 2003 International Building Code; 2003
International Mechanical Code; 2003 International Plumbing Code; 2003
International Fuel Gas Code; and the 2002 National Electrical Code and
Chapter 29 of the Weld County Code. (Building Department)
3. Prior to the release of building permits:
A. A Final Site Plan and building construction plans must be submitted to the
Mountain View Fire Protection District for review and approval. The applicant
shall submit written evidence of approval to the Department of Building
Inspection. (Mountain View Fire Protection District)
B. Upon approval by the Department of Planning Services, the Site Plan Review
shall be prepared per Section 23-2-260.D of the Weld County Code and
submitted to the Department of Planning Services to be recorded. (Department of

C. A plan review is required for each building for which a building permit is required.
Plans shall include a floor plan. Plans shall bear the wet stamp of a Colorado
registered architect or engineer. Two complete sets of plans are required when
applying for each permit. Provide a Code Analysis Data sheet provided by the
Weld County Building Department with each Building permit application.

D. The building will probably be classified as a mixed use type B (office) and S or H
(storage/warehouse) occupancy. Fire resistance of walls and openings,
construction requirements, maximum building height, automatic sprinkler
requirements and allowable areas will be reviewed at the plan review. Setback
and offset distances shall be determined by the Weld County Code. Mountain
View Fire Protection District requirements for automatic sprinklers may be
different than the requirements of the 2003 International Building Code. (Building

E. Building height shall be measured in accordance with the 2003 International
Building Code for the purpose of determining the maximum building size and
height for various uses and types of construction and to determine compliance
with the Bulk Requirements from Chapter 26 and Chapter 23 of the Weld County
Code. Building height shall be measured in accordance with Chapter 23 of the
Weld County Code in order to determine compliance with offset and setback
requirements. Offset and setback requirements are measured to the farthest
projection from the building. (Building Department)
F. A stormwater discharge permit may be required for a development /
redevelopment / construction site where a contiguous or non-contiguous land
disturbance is greater than or equal to one acre in area. The applicant shall
inquire with the Water Quality Control Division (WQCD) of the Colorado
Department of Public Health and Environment if they are required to obtain a
stormwater discharge permit as delineated in 5 CCR-1002-61. Alternately, the
applicant can provide evidence from WQCD that they are not subject to these

G. The Architectural Control Committee shall provide a letter to the Department of
Planning Services indicating its approval of the proposed structure. (Department

4. Prior to the release of the Certificate of Occupancy:
A. A final inspection of the occupancy will be required by a member of the Mountain

Dear Jacqueline;
Regarding the Site Plan Review Comments,for the above referenced Project, I offer the following:
1. A Site Plan Review "Plat", per Section 23-2-160.V of the Weld County Code, is attached hereto for your
final review. I trust you will find everything in order.
2 A. The letter from Mountain View Fire Protection District, dated 17 August and received by your office
on 19 August, states in the second paragraph: "Fire apparatus access to the building appears to be
adequate as indicated on the plans." This letter and accompanying statement appears to adequately
indicate that the District has reviewed access and has no concerns.
2B. Please see attached letter, from Western Disposal Services, Co., indicating "approval" of the proposed
trash container location.
2C. The Site Plan Plat has been revised to reflect a proposed sign in conformance with §23-4-100,
"Signs in C and I Zone Districts". (1 presume this was the intended section rather than 23-4-90, A
zone district signs, noted in the comments.) Please note that any signs will be designed by others and
will apply for a separate building permit other than obtained for the building.
2D. Attached hereto is a lighting plan indicating fixture types and the resultant site photometrics from
this design. All lights are shielded and, as can be seen from the photometric analysis, does not
adversely effect adjacent properties or the street,thereby complying with §23-4-30E; 26-2-90 and
23-3-250.B.6 of the Weld County Code.
2E. As noted in your email to me of 19 October,the boxed note on the Landscape Plan, indicating that
landscaping will be maintained by the Owners, is an acceptable alternative to the Property
Maintenance Plan. No further action is required.
2F. Regarding Mountain View Fire's"concern"that fire access lanes are designed to meet their loading
standards for a 70,000 pound fire truck, we are aware of that concern and our past projects, within
the district boundaries, have fully complied with their requirements. Attached hereto is a letter from

a Soils Engineer indicating the pavement design necessary for the fire truck loading. These
requirements will be included on the construction site plan, submitted with the building permit
package. Since Mountain View Fire reviews the construction plans and a permit will not be issued
until they sign off on it,this should be satisfactory evidence, at this time, that the drives will be
properly constructed for thier loading requirements.
2G. As noted in earlier correspondence, per their response of 22 August, it does not appear to us that the
Sheriff's Department has any concerns or issues to address. The Owner is aware of the Sheriff's Dept.
Offer to assist in the development of a security plan for the site and has not expressed an interest in
doing so at this time. They may be interested in the future but, since this is a speculative building,
feel it is premature to do so know. Since this is not a mandatory requirement, I believe this should
adequately addresses your concern.
It may also be appropriate to note that I am a graduate of a continuing education course in "Crime
Prevention Through Environmental Design" (CPTED) given by the Florida Regional Community
Policing Institute. I try, where allowed by other codes and regulations, to apply CPTED principals to
all my designs, this project included.
2H. Again, as noted in earlier correspondence, we received a copy of an updated referral from Public
Works, dated 21 September, indicating that all of their concerns have been met and that they "sign
off" on this site plan review.
21. There is an existing 5/8" water tap and line stubbed into the property and paid for with the purchase
of the land and thought this would be adequate proof that there was water available. However,
attached hereto is a copy of a letter from Left Hand Water District regarding an upgrade to the 1"
service the project will require. The balance of information they require, mechanical drawings, etc.
will be submitted prior to filing for building permit, once we are assured the project has received
planning approval.
2J. Attached hereto is a letter from St. Vrain Sanitation District indicating that they will serve the
property, subject to some technical concerns currently being worked on. This should provide
sufficient proof to alleviate any concerns. We will furnish them with their requested information
once we are assured the project has received planning approval.
2K. As you know, we have submitted a proposed agreement and have responded to your concerns so,
hopefully, this is on track and can be approved in a timely manner.
2L. The Site Plan Review Drawing has been amended to address the following:
1. It has been prepared in accordance with Section 23-2-160.V of the Weld County Code.
2. Parking stalls have been sized in accordance with Weld County standards and are adequately
dimensioned on the Site Plan. An accessible path is provided from the building to the street.

Generally speaking, parking on the west side of the building is for"customers" while parking on the
east side of the building is for"employees". However, since this is a speculative building, and tenants
are unknown at this time, designation of specific parking areas for customers and employees is
premature and, in our opinion, unnecessary. For example, it may be that a business moves into the
building that doesn't have customers coining to their place of business. There are several in the
Wynja's existing buildings that do not have customer visitation to their sites.
3. Parking complies with the Americans with Disabilities Act, specifically with the "Universal"
Handicapped Space per ADAAG specifications. Per ADA and County standards, for the 4lspaces
provided,two (2) spaces are required to be handicapped. Of those two, one (1) is required to be van
accessible. The use of universal spaces allows both vans and cars to use the space without the
limitation of special signage. A handicapped ramp is designated at the front walk while rear entrances
are at grade level, so a ramp is not required.
4. Planting areas have been added within the parking rows to comply with Weld County requirements.
5. As stated in previous correspondence, parking areas are delineated by curb and gutter. This is an
acceptable alternative to curb stops. The curb and gutter has been called out on the site plan.
6. The width of parking stalls is, and was, delineated on the Site Plan. Standard nomenclature was used
i.e., "10 spaces @ 9'-0" = 90'-0". The 19'-0" depth is also dimensioned as"typical".
7. The site has been redeisgned to relocate parking areas outside of the required 10-foot side yard offset.
8. As noted above, the proposed sign location has been revised to comply with Weld County Standards.
It is anticipated that, other than address information and business names located on the doors to
individual suites, this will be the only free-standing sign on the site. All signage will be constructed
and/or installed under separate permit by the signage contractor(s). It is my opinion that this
information, coupled with the signage indicated on the Site Plan and applicable signage notes on the
Plan, satisfies the intent of Weld County requirements for a signage plan.
9. Please see the response to 2.D above.
10. It is not anticipated that there will be any outside storage of vehicles, equipment or supplies. If a
tenant requires said storage areas, they will be screened, by the tenant, at their expense.
11. It is doubtful that manufacturing or warehousing tenants that use hazardous wastes will be allowed
due to the increased liability, building code and insurance constraints. However, when warehousing
and/or manufacturing tenants commit to a lease, they will be required to submit the requested plan as
part of their tenant finish building permit application.

I have reviewed the submitted material and preliminary site plans for the proposed the Wynja
Vista Building proposed for Lot 7, Block 2 in Vista Commercial Center (Case Number: SPR-
390). The Fire District has the following comments with regard to the plans:
• The total building appears to be about 16,350 square feet of type V-B construction and
protected throughout with an automatic fire sprinkler system. In accordance with Appendix III-
A of the Uniform Fire Code,the required fire flow for the building is 1,750 gallons per minute,
measured at a residual pressure of 20 pounds per square inch. Based on flow tests conducted
in the area, the Fire District recognizes the required fire flow is available to the site from
existing hydrants located on Vista View Drive.
• Fire apparatus access to the building appears to be adequate as indicated on the plans. Fire
apparatus access roads must be designed and maintained to support the imposed loads of fire
apparatus(75,000 pounds).
• Building construction plans and the final site plan showing the gross square footage of the
building and building construction type must be submitted to the Fire District for review and
approval before building permits may be issued.
Nothing in this review is intended to authorize or approve of any aspect of this project that does
not comply with all applicable codes and standards. We appreciate being involved in the

Based on information provided he following Building Code comments are offered for SPR 390.
1 An Individual building permit application is required to include the following:
a Two complete sets of building plans to include site,storm drainage,foundation,structural
architectural, mechanical, plumbing &electrical.
b. A completed code analysis--Weld County Form—reflecting the intended usages within
the proposed structure to include: location of any fire areas, fire barrier walls,
occupancies and uses within the building,type of construction and sprinklering,as well as
a roof analysis sheet—Weld County Form.
c Application shall include a statement or description of the nature and type of intended
warehousing materials or commodities; any assembly, fabrication or manufacturing
operations intended and administrative functions or services.
2 All foundation work shall be engineered and based on a soils report to be included with permit
construction documents.
3 All uses within the building will be classed for there occupancy based upon chapter 3 of 2003 IBC
at the time of building permit submittal. The proposed office/warehouse is indicative of a B
occupancy use with warehousing classed in the S or H usage subject to hazard of storage
materials.
4 Based on proposed office/warehouse usage , building will be required to fully sprinklered for a
moderate hazard S-1 storage use and unseparated accessory B usage within a single fire area
exceeding 12,000 square feet. However, actual usage and granting of usage will be determined
at plan review and may or may not affect sprinklering requirements.
5 Building and site facility are required to be accessible in accordance with Chapter 11 of the IBC.
6 Issuance of building permit will be granted based on compliance with the building usage for the
type of construction and the allowable area in relation to location on property in conjunction with
all fire, life, safety and public well being codes of the 2003 ICC family of codes.
7 Prior to the issuance of any building permit approval must be granted from all appropriate

agencies involved in the development and building project to include: Planning, Public works,

The Department of Planning Services reviewed the above referenced Site Plan Review
documentation and drawings and offers the following comments:
The Site Plan Review Plat shall be prepared in accordance with Section 23-2-160.V of the Weld
County Code.
This application shall be in compliance with Section 23-3-250 A. and B, Section 23-3-350 and
Chapter 26 and is address in the following comments. The proposal is located in the Vista
Commercial Business Park PUD. Zoning within this PUD is C-3 (Business Commercial) and I-1
(Industrial).
Section 23-3-250.A.1
Stormwater Management. All users of land shall provide and maintain stormwater retention
facilities designed to retain the stormwater runoff in excess of historic flow from the
undeveloped site. The stormwater retention facility on a developed site shall be designed for a
one-hundred-year storm. The stormwater retention facility shall be designed and operated to
release the retained water at a quantity and rate not to exceed the quantity and rate of a five-
year storm falling on the undeveloped site. The application materials did include written
comment on Stormwater drainage. The applicant shall contact the Weld County Department of
Public Works to further discuss this issue, including supplemental information as warranted.
Section 23-3-250.A.2
Parking. Sufficient screened, off-street, paved parking areas shall be provided to meet the
requirements of employees, company vehicles, visitors and customers of the Uses Allowed by
Right and Accessory Uses. Appendix 23-A describes the design requirements for parking
spaces and Appendix 23-B delineates the number of parking spaces required by use for this
property.
The proposed facility has Office and Warehouse uses. The parking requirement for Office
uses are one space for every two employees plus one space per 500 SF and the warehouse
area requires one space for every 1000 SF of area. Per Code, the total parking required for
this facility determined by the information submitted in the application, is thirty-one spaces.
Three parking spaces are delineated on the submitted plat, however the access to points of
ingress and egress remain unresolved. Future correspondence shall address this issue.
Section 23-3-250.A.3
Street Access. Lots shall have safe access to an approved public or private street. The design
designation of any street or highway as to type shall be in conformance with that shown on the
county thoroughfare plan and/or the master plan of the affected municipality. The existing
access is off of Vista View Drive within the Vista Commercial Business Park PUD. The
applicant shall provide written evidence of approval of the points of ingress and egress to this
facility from the Mountain View Fire Protection District. Access shall comply with Section 27-2-
20 of the County Code which states " all PUD developments will be served by an internally
paved road system according to County standards."
Section 23-3-250.A.4
Required Yards - Setback
No use or accessory use may be located closer than twenty-five (25) feet to the existing or
proposed (whichever represents the greater right-of-way width) highway or street right-of-way.
Off-street parking areas may be permitted in the required setback area when the area is
screened from direct view of persons on the public rights-of-way. Fences over six (6) feet in
height are not required to comply with the minimum setback and may be located on the
property line. Fences located on corner lots abutting public right-of-way shall not obstruct the
view of vehicular traffic at an intersection. Written evidence of compliance shall be submitted to
the Department of Planning Services.

Required Yards - Offset
No use or accessory use may be located closer than ten (10) feet to its lot line. Fences over six
(6) feet in height are not required to comply with the minimum offset and may be located on the
property line.
Section 23-3-250.A.5.A
Required Landscaped Areas
No more than eighty-five percent (85%) of the total area of a lot shall be covered. Land shall
not be deemed covered if it is used for growing grass, shrubs, trees, plants or flowers or if
covered by decorative gravel or wood chips, or if it is otherwise suitably Landscaped. There
was a schematic Landscape and Screening Plan submitted with the application materials. In
principle the plan is acceptable.
Section 23-3-250.A.5.B
That portion of a lot which abuts a public or private street right-of-way shall be landscaped for a
distance of ten (10) feet, measured at a right angle from the lot line towards the interior of the
lot. Sidewalks and driveways may pass through the required landscaped areas. The
Landscape and Screening Plan submitted with the application materials shall address this
issue. Further, the location of the earthen berm shall also be delineated. Additional information
is required prior to accepting the plat for recording.
Section 23-3-250.A.6
Areas used for trash collection shall be screened from public rights-of-way and all adjacent
properties. These areas shall be designed and used in a manner that will prevent wind- or
animal-scattered trash. The application materials do identify the location of the dumpster on
the plat. In principle the location is acceptable. Staff does question the ability of the trash
company to physically maneuver a vehicle to this location and successfully unload and replace
the trash container. Written evidence from the trash collection company to the Department of
Planning services is required prior to submitting the plat for redlines.

Water Supply. Uses shall have an adequate source of potable water. The application
materials state the service provider is Left hand Water District for water. Further, the applicant
shall meet the requirements of the Weld County Department of Public Health and Environment.
Section 23-3-250.A.8
Sewage Disposal. Uses shall have adequate sewage disposal facilities. The application
materials state the service provider is St. Vrain Sanitation District for sanitary sewer service
provider. Further, the applicant shall meet the requirements of the Weld County Department of
Public Health and Environment.
Section 23-3-250.A.9
Outside Storage. Uses involving outdoor storage of vehicles, equipment or materials when
permitted shall be screened from public rights-of-way and all adjacent properties. The
application materials and supporting drawings do not indicate if there will be exterior storage of
materials. Additional information is requested on the issue of outside storage, fence materials
and location of said storage.
Section 23-3-350.6.
Operation Standards. Uses shall demonstrate conformance with the following operation
standards to the extent that they are affected by location, layout and design prior to
construction and operation. Once operational, the operation of the Uses permitted shall
conform to these standards.
Section 23-3-350.B.1
Noise. Uses and structures shall be located, designed and operated in accordance with the
noise standards as established in Section 25-12-101 C.R.S. The applicant shall meet the
established standards set by the Weld County Department of Public Health and Environment.
Section 23-3-250.B-2
Air Quality. Uses shall be located, designed and operated in accordance with the air quality
standards established by the Colorado Air Pollution Control Commission. The applicant shall
meet the established standards set by the Weld County Department of Public Health and
Environment.
Section 23-2-250.B.3
Water Quality. Uses shall be located, designed and operated in accordance with the water
quality control standards established by the Colorado Water Quality Control Commission. If
applicable, the applicant shall provide additional information regarding the commerncial well if
required through the Weld County Department of Public Health and Environment referral.
Section 23-2-250.6.4
Radiation and Radioactive Materials. The handling, use, storage and processing of radioactive
materials shall be in accordance with the applicable regulations of the State and the United
States government The application materials do not indicate this is applicable, should this not
be the case, the applicant shall provide additional information to the Weld County Department
of Public Health and Environment.
Section 23-2-250.6.5
Heat. Uses shall not emit heat in such an amount sufficient to raise the temperature of the air
or of materials at or beyond the Lot line more than five (5) degrees Fahrenheit. The application
materials do not indicate this is applicable, should this not be the case, the applicant shall
provide additional information to the Weld County Department of Public Health and
Environment and the Department of Building Inspection. Further, the applicant shall obtain a
written approval from the Mountain View Fire Protection District stating that the facility is in
compliance with the Fire Code.
Section 23-2-250.B.6
Light. Any lighting, including light from high temperature processes such as welding or
combustion, shall be designed, located and operated in such as manner as to meet the
following standards: sources of light shall be shielded so that beams or rays of light will not
shine directly onto adjacent properties; neither the direct nor reflected light from any light
source may create a traffic hazard to operators of motor vehicles on public or private streets;
and no colored lights may be used which may be confused with or construed as traffic control
devices. The application materials did not include a Lighting Plan. Should exterior lighting be a
part of this facility, all light standards shall be delineated on the Site Plan Review Plat.
Section 23-2-250.B.7
Property Maintenance. Property shall be maintained in such a manner that grasses and weeds
are not permitted to grow taller than twelve (12) inches. In no event shall the property owners
allow the growth of noxious weeds. The application materials do not address property
maintenance. Future correspondence shall identify how the property will be in compliance with
this Section of the County Code.
Section 23-4-50.
Off Street Loading. The applicant shall delineate on the Site Plan Review plat the location of
the loading zone that is in compliance with Section of the Code. There shall be parking or
staging of trucks within the public right-of way. Further, the applicant shall meet all
requirements of the Department of Public works concerning access and circulation of vehicles
for this proposed facility.
Section 23-4-90
Signs. The application materials address the issue of on-site signs, however, the proposed
signs located on site shall be in compliance with the Mixed Use Development Area, (MUD).
Section 26 addresses the requirements of the Mixed Use Development Area, (MUD).
Additional requirements to be met, given that the project is located within the Mixed Use
Development Area Overlay:
Section 26-2-90 provides discussion on all signs, please refer to Section 26-2-90.D.3.e
regarding height of signs for this area. The proposed signs do not meet the requirements of
Section 26. The applicant shall provide further information and a new proposal for the signs
associated with this facility.
Section 26-2-40
Common Open Space. Appendix 26-E discusses common open space requirements. Per the
Code, twenty (20) percent of the parcel is required for open space in the MUD.
Section 26-2-50
Maximum Lot Coverage. All land use applications in the MUD area shall adhere to the
regulations governing the maximum percentage of lot coverage. The maximum lot coverage is
defined as the maximum percent of the total area of a lot in a zone district that shall be covered
by any structure. Land shall not be deemed covered if it is used for growing grass, shrubs,
trees, plants or flowers it is covered by decorative gravels or wood chips, or if it is otherwise
suitably landscaped. The percentage of coverage on a lot shall not include the area of the lot
or development designated as common open space as outlined in Appendix 26-E . The
percentages outlined in Table 26.1 shall be deemed the maximum lot coverage for each zone
district within the MUD area. In this instance, the maximum lot coverage is eight-five (85)
percent of the total allowable area.
Section 26-2-70.A
Landscaping Regulations, Intent.
Landscaping is extremely important for ensuring the quality of development in the MUD area.
Trees, shrubs and other plantings add greatly to the aesthetic appeal while controlling erosion,
reducing glare, lowering temperatures, buffering sounds and blocking or diverting wind. As no
single landscaping plan can be prescribed for all developments due to differing land features,
topology and soils, the County allows flexibility and encourages creativity in landscape designs.
Landscaping must be sensitive to the characteristics and maintenance requirements of the
planting selected. Species must be chosen that are hardy for the climate and soil conditions in
the MUD area, that can tolerate traffic, that are resistant to disease and insects, and whose
maintenance needs can be met.
Section 26-2-70.6
Design Criteria. Landscapes shall utilize the following principles for maximum use of water: (a)
well-planned and approved planting schemes; (b) appropriate selection of drought-tolerant turf
species to minimize water needs and the use of water-hungry species of turf; (c) mulch to
reduce evaporation; (d) zone plant groupings according to their microclimatic needs and water
requirements; (e) improvement of the soil with organic matter if needed; (f) efficient irrigation
design; and (g) proper maintenance and irrigation scheduling. The applicant shall provide
evidence, both graphically and written stipulating compliance with this Section of the Code.
The applicant shall submit to the Department of Planning Services a detailed Landscape Plan
delineating the existing and proposed trees, shrubs, ground covers, natural features such as
rock outcroppings and other landscaping elements. The plan shall show where landscaping
exists or will be located, along with planting and construction details. Where existing plantings
are to be retained, the applicant shall include in the plans proposed methods of protecting the
plantings during construction. The applicant has submitted such plan and it is generally
acceptable.
Section 26-2-70.C.1
Landscaping Requirements for Parking Lots. At least ten percent (10%) of the area of a
parking lot must be landscaped if the lot contains ten (10) or more spaces. The requirement
may be counted toward the maximum lot coverage requirement of each zone district. At least
seventy-five percent (75%) of the required landscape area shall include living plant material.
This Code requirement shall be addressed in future correspondence.
Section 26-2-70.C.2
Berming and shrub or tree planting shall be used to screen parking lots from view of the
roadway. Berms can vary in height depending on location and proximity of existing trees.
Berms shall have smooth transitions from the top of the curb to the setback line so as to not
create snow traps, with allowances made for placement of the sidewalk. Grading of berms shall
not be lumpy or abrupt. This Code requirement shall be addressed in future correspondence.
Section 26-2-70.C.3
Landscaping techniques shall be used to alleviate the harsh visual appearance that
accompanies parking lots. At least seventy-five percent (75%) of the length of the frontage of
the parking lot must be effectively screened. This Code requirement shall be addressed in
future correspondence.
Section 26-2-70.C.4
A minimum of five percent (5%) of the parking area shall be landscaped exclusive of setback
areas. Trees planted in parking areas should be either in bays or planting islands of at least
five (5) feet by five (5) feet. Trees should be distributed throughout the parking area, however,
they shall be placed so that they do not obstruct visibility for cars and pedestrians.This Code
requirement shall be addressed in future correspondence.
Section 26-2-70.C.5
Loading, service or storage areas must be screened with an opaque screen that is an integral
part of the building architecture. Chain link fencing with slats or pallets are not an acceptable
screening material. Plant material shall be used to soften the appearance of the screen. This
Code requirement shall be addressed in future correspondence.
Section 26-2-70.0.2
Landscaping Requirements Along Roadway Corridors - Design Intent.
The applicant shall provide evidence, both graphically and written stipulating compliance with
this Section of the Code. Of particular note are the following Sections:
Section 26-2-70.0.2.a.
Plantings along road rights-of-way shall be integrated with the rest of the site. This Code
requirement shall be addressed in future correspondence.
Section 26-2-70.D.2.b
That portion of a lot in any zone district which abuts a public or private road right-of-way shall
be landscaped with a minimum two-and-one-half-inch caliper shade tree or six-foot minimum
height coniferous tree at a distance of ten (10) feet, measured at a right angle from the lot line
towards the interior of the lot, for every forty (40) linear feet of street frontage. Trees may be
grouped with a maximum distance of one hundred (100) feet between trees or groupings, with
exceptions made at entrance drives.
Section 26-2-70.0.2.g
There shall be a minimum twenty-foot-wide landscape setback measured from the existing or
planned future right-of-way to any parking lot, fencing, storage area or structure. Required
landscaping and screening within the landscape setback and other portions of the property shall
be governed by the landscape standards contained within this Chapter (Chapter 26) and any
other more restrictive requirements contained in Chapter 23 of the Code. This Code
requirement shall be addressed in future correspondence.
Section 26-2-70.O.2.h
Appendices 26-M through 26-P contained within this Chapter (Chapter 26) illustrate the
proposed character, berming and landscape setbacks for the State Highway 119 corridors.
(Weld County Codification Ordinance 2000-1)
Section 26-2-80.C and Section 26-2-80.D addresses access and circulation. The applicant
shall contact the Department of Public Works to address all issues pertaining to this topic.
Further, the Mountain View Fire Protection District shall be consulted on this access and the
applicant shall provide written evidence that the concerns of the Mountain View Fire Protection
District have been addressed to their satisfaction and requirements.
Section 26-2-90
Sign District Requirements. The applicant shall provide evidence, both graphically and written
stipulating compliance with this Section of the Code. Specific attention shall be given to Section
26-2-90.D.2 of the Code.
The applicant shall enter into an Improvements Agreement according to policy regarding
collateral for improvements and post adequate collateral for all transportation (access drive,
parking areas, etcetera) and non-transportation (plant materials, fencing, screening, etcetera).
The agreement and form of collateral shall be reviewed by County Staff and accepted by the
Board of County Commissioners prior to recording the Site Plan Review plat.

and warehouse. We have no objections to the proposal, however, we do recommend
that the following conditions be part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1. The applicant shall provide current evidence that the facility has an adequate
water supply (i.e., well or community water system).
2. The applicant shall provide current evidence that the facility has adequate
sewage disposal.
We recommend that the following requirements be incorporated into the permit as
conditions that must be met prior to operation:
1. A stormwater discharge permit may be required for a
development/redevelopment/construction site where a contiguous or non-
contiguous land disturbance is greater than or equal to one acre in area. The
applicant shall inquire with the Water Quality Control Division (WQCD) of the
Colorado Department of Public Health and Environment at
www.cdphe.state.co.us/wq/PermitsUnit if they are required to obtain a
stormwater discharge permit. Alternately, the applicant can provide evidence
from WQCD that they are not subject to these requirements.
We recommend that the following requirements be incorporated into the permit as
conditions that must be met prior to the issuance of the Certificate of Occupancy:
1. The applicant shall require all manufacturing and warehouse tenants to submit a
waste handling plan, for approval, to the Environmental Health Services Division
of the Weld County Department of Public Health & Environment. The plan shall
include at a minimum, the following:
1) A list of wastes which are expected to be generated on site (this should
include expected volumes and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on site.
3) The waste handler and facility where the waste will be disposed (including
the facility name, address, and phone number).
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions.
4. The manufacturing and warehouse tenants shall operate in accordance with the
approved "waste handling plan".
5. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
6. This facility shall adhere to the maximum permissible noise levels allowed in the
Commercial Zone as delineated in 25-12-103 C.R.S., as amended.
7. Adequate handwashing and toilet facilities shall be provided.

8. The facility shall utilize the existing municipal sewage treatment system.
9. The facility shall utilize the existing public water supply.
10.All potentially hazardous chemicals must be stored and handled in a safe manner
in accordance with product labeling and in a manner that minimizes the release
of hazardous air pollutants (HAP's) and volatile organic compounds (VOC's).
11.The property/operation shall comply with all applicable rules and regulations of
the State and Federal agencies and the Weld County Code.
