WHEREAS,the Board of County Commissioners of Weld County, Colorado, convened as
the Board of Equalization for the purpose of adjusting, equalizing, raising or lowering the
assessment and valuation of real and personal property within Weld County,fixed and made by the
County Assessor for the year 2005, and
WHEREAS, said petition has been heard before the County Assessor and due Notice of
Determination thereon has been given to the taxpayer(s), and
WHEREAS, the taxpayer(s) presented a petition of appeal of the County Assessor's
valuation for the year2005,claiming that the property described in such petition was assessed too
high, as more specifically stated in said petition, and
WHEREAS, in lieu of the hearing scheduled before the Board of Equalization a Stipulation
was agreed upon by the Assessor and said petitioner(s), and
WHEREAS,the petitioner(s)and the Weld County Assessor agree that the assessment and
valuation of the Weld County Assessor shall be, and hereby is, stipulated as follows:

property (land and buildings) and personal property (furnishings, machinery, and equipment). § 39-8-104 and § 39-

APPEAL PROCEDURES:
If you choose to appeal the Assessor' s decision, mail or deliver one copy of this completed form to the County
Board of Equalization. To preserve your right to appeal, your appeal must be POSTMARKED OR DELIVERED

Reasons for Appeal of Assessor's "Notice of Adjustment" dated June 23, 2005
Thanks to a conversation I had with Judith Hoyt of the Assessor's Office on July 13, 2005,
I --for the first time-- understand what specific numbers were used to calculate the
Assessor's Valuation of Parcel 080518000048. Consequently, I am now making the
following appeals which I regard as correcting out-of-date information that is presently
incorporated in the"actual value after review" assessment.
1. The acres (presently 12.5, but I believe the right acreage is 11.19) that are presently
classified as irrigated type 3 crop land are, in fact, dry pastureland. These acres were, at
the time Louise Walker Shands and I became owners of this parcel in 1999, already well
established as pastureland that is not irrigated. Consequently, I believe that the valuation
for those acres needs to be reduced from the current$369.19 per acre to the appropriate
per acre valuation that applies to dry pastureland. I do not know the exact value, but I
understand it to be between $10 and 20 an acre.
2. The other problem I have with the calculation of the $36,846 is the amount of acreage
that is assigned to various land types. I base my appeals for revised acreage distribution
on a Land Survey Plat dated (and, I believe, recorded with the County on) March 13,
1998, by King Surveyors, Inc. (project#95240). Staying at the current County assessed /

acreage of 91.74 and using the 1998 plat which contains surveyed acreage for each of four
fields, I believe that the 91.74 acres should be distributed as follows: kA°
11.19 to dry pastureland (see #1. above) Cv
30.34 as type 4 land -- two fields that are very difficult to irrigate due to their land lie
50.21 as type 2 land -- land that is not flat, but that is relatively easy to irrigate
91.74 total acreage currently used by Weld County Assessor and by me for this appeal
In summary, I believe the "actual valuation" of Parcel 080518000048 should be:

112 - 224 for 11.19 acres of dry pastureland (I am using a $10-20 range of value)
7,109 for 30.34 acres of type 4 land (two hard-to irrigate fields) @ $234.32 acre
22,877 for 50.21 acres of type 2 land @ $455.63 an acre
30,098 - 30,210 This is our OPINION of VALUE and our appeal. I have stated it as a
range only because I do not know specifically the per acre value of dry�,g(�� � pastureland� on Parcel 080518000048.
