ORDINANCE NO. 61
IN THE MATTER OF AN ORDINANCE ESTABLISHING THE AUTHORITY OF THE
BOARD IN REGARD TO LEGAL HOLIDAYS FOR COUNTY OFFICES, AND HOURS
OF THE DAY FOR OPERATION.
BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF WELD COUNTY,
COLORADO:
WHEREAS, pursuant to Article 14 , Section 6 of the Colorado
Constitution and Section 30-11-501, et seq. , CRS 1973 , as amended,
Weld County is a Home Rule County, and
CI
WHEREAS, Section 3-8 of the Weld County Home Rule Charter
expressly provides that the Board of County Commissioners (here-
inafter Board) shall exercise all powers of the County to determine
policy, and
WHEREAS, Section 30-11-109 , CRS 1973, expressly provides
that the Board shall determine on what days and during what
hours County offices shall be open, and
BE IT ORDAINED by the Board of County Commissioners of Weld
County, Colorado that the following powers and duties are hereby
reserved to the Board:
SECTION I . HOURS OF DAY
That pursuant to the above authority, the Board of County
Commissioners hereby reserves to itself the authority to deter-
mine the hours of the day during which County offices will be
open.
SECTION II . LEGAL HOLIDAYS
That pursuant to the above-cited authority, the Board of
County Commissioners hereby reserves to itself the authority to
establish legal holidays for all County offices.
SECTION III . IMPLEMENTATION
By Resolution, the Board shall implement its authority as
to the above matters from time to time as it deems appropriate.
SECTION IV. AMENDMENT TO THE WELD COUNTY
PERSONNEL POLICY MANUAL
Anything to the contrary notwithstanding, the Weld County
Personnel Policy Manual is hereby amended so that employees who

are required to work on a national holiday for which another
vacation day is substituted therefore, shall be paid at the
regular compensation rate for work on said holidy. Further,
the Personnel Policy Manual is hereby amended so that the holi-
days observed by the County are those designated by the Board
pursuant to this Ordinance.
SECTION V. EFFECTIVE DATE
This Ordinance shall take effect five (5) days after its
final public notice pursuant to Section 3-14 of the Weld County
Home Rule Charter.
SECTION VI. VALIDITY OF ORDINANCE
If any section, subsection, paragraph, sentence, clause
or phrase of this Ordinance is, for any reasons , held or decided
to be invalid or unconstitutional , such decisions shall not affect
the validity of the remaining portions . The Board of County Com-
missioners of Weld County, Colorado, hereby declare that it would
have passed this Ordinance and each and every section, subsection,
paragraph, sentence, clause and phrase thereof irrespective of
the fact that any one or more sections, subsections , paragraphs ,
sentences , clauses, or phrases might be declared to be unconsti-
tutional or invalid.
The above and foregoing Ordinance No. 61 was, on motion duly
made and seconded, adopted by the following vote on the 7th day
of January , A.D. , 1980 .
