Home My WebLink About800506.tiff RESOLUTION RE: APPROVAL TO ISSUE BUILDING PERMIT TO DALE AND MARIETTA THOMAS FOR A PARCEL OF LAND LOCATED IN PART OF SECTION 30 , TOWNSHIP 9 NORTH, RANGE 66 WEST OF THE 6TH P.M. , WELD COUNTY, COLORADO WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners finds that Dale and Marietta Thomas are the owners of a tract of land located in the Northeast Quarter Northeast Quarter Northwest Quarter of Section 30, Township 9 North, Range 66 West of the 6th P.M. , Weld County, Colorado, and WHEREAS, the Board of County Commissioners further finds that the above described tract of land was divided in an ille- gal manner, and WHEREAS, Mr. and Mrs. Thomas have applied for a building permit for said tract of land to remodel the existing residence on the property, and WHEREAS, Section 13 .C. (1) of the Weld County Subdivision Regulations states as follows : " (1) Building permits, for construction on land divided in an illegal man- ner subsequent to the adoption of this Resolution, shall not be issued unless reviewed and approved by the Weld County Planning Commission and the Board of County Commissioners. " WHEREAS, the Board of County Commissioners has considered the information presented by those present concerning this mat- ter and desires to allow the issuance of a building permit on said tract of land. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that the issuance of a building permit to Dale and Marietta Thomas for the above described tract of land be, and hereby is, approved. At that time, the Department of Planning Services staff discovered that an illegal parcel had been created in March of 1974 when Christ conveyed 10 acres to Row. Weld County Subd. Regs. require that any division of land subsequent to August 30, 1972 apply for a subdivision; either as a recorded exemption or full subdivision application. Under these circumstances the Christ's should have applied for a recorded exemption to divide the property into two parcels prior to deeding the 10 acre parcel to the Rows. Mr. and Mrs. Thomas are now appealing to the Planning Commission and Board of County Commissioners to grant the building permit for remodeling their house without having to make application for a recorded exemption. We have two directions we can use to get this situation corrected. I would recommend we go the Recorded Exemption route, if possible. We would need you and the present owner of the blanace of the NW%, to apply for the Recorded Exemption. Christ's have sold to a Gary E. DeVries, 115 1st Avenue in Ault, Colorado - Phone 834-1515. This route will make each parcel legal. As things are now I could not approve a building per- mit for either parcel. The other alternative would be to appeal to the County Commissioners to issue a building permit for an illegal lot: Several of these have been approved, but is usually for this particular party for this type of building permit. Should the pracel be sold the new owner would have to go through the same type of hearing. I have called several time, but have not been able to contact you.
