HomeMy WebLinkAbout20050917.tiff RESOLUTION RE: APPROVE DISMISSAL OF PETITION FOR THE ANNEXATION OF PORTIONS OF WELD COUNTY ROADS 27.5 AND 52 TO THE CITY OF EVANS AND AUTHORIZE CHAIR TO SIGN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with a Petition for the Annexation of Portions of Weld County Roads 27.5 and 52 to the City of Evans, to provide contiguity enabling the City of Evans, Colorado, to complete the "Green Lake Annexation 6," and WHEREAS,a hearing before the Board was held on the 10th day of January,2005,at which time the Board deemed it advisable to continue said matter to March 14, 2005, at 9:00 a.m., and WHEREAS, at said hearing on the 14th day of March, after review, the Board deems it advisable to dismiss said Petition. NOW,THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County,Colorado,that the Petition for the Annexation of Portions of Weld County Roads 27.5 and 52 to the City of Evans, Colorado, be, and hereby is, dismissed. Telep Turner, on behalf of Telep Family Limited Partnership, LLLP, and as requested by my mother, Myrtle A. Telep, general partner of our family partnership. Our family vehemently OPPOSES this Petition by the City of Evans on your agenda Monday morning. Please vote "No." As you may know, we are an "interested landowner" since we own four(4) eighty-acre farms which would be negatively impacted (1) along the East side of our properties due to a strategic 140' ROW which is being planned and needs consideration for pedestrian access thru or under a super-2 or 4-lane road; and (2) along WCR 52 which would give the City of Evans ownership of the gravel road and bi- sect our farms with an entity other than Milliken as we are currently planning. We look to our engineers to determine most cost-effective utilities line extensions. WCR 27.5 (Two Rivers Pkwy) & 49th Street Intersection issues. There are numerous serious design and engineering issues with the intersection of Two Rivers Parkway and 49th Street and along WCR 27.5 north of the intersection for safety, access and impact on remainder of properties. We have been working with our neighbors in the Ashton Community and with engineering staff of Milliken to address and alleviate possible design problems in ways that will be agreeable with Weld County and C- DOT. Among other things, sight distances, oil and gas suprastructures, underground lines, pedestrian crossings, underpass locations, and safe and sensible traffic flow and access points on WCR 27.5 need excellent engineering. This intersection and the overall Ashton Community is currently being studied by the University of Colorado graduate students in the School of Architecture and Land Planning, our land surveyor, Milliken land use planners and architects, and Milliken staff for coordinating optimum solutions with Weld County and C-DOT. Lack of communication. Evans provided us with a possible way to connect to water and sewer to the north. We appreciate this information and it may be that our engineers will agree with part or all of this concept. This has been the most helpful communication and map to date. However, the officials of the Town of Milliken have been far more helpful and communicative regarding our plans and inquiries for long-term development of the overall Ashton Community properties during this past year. For example, I requested assistance from engineering staff at the City of Evans regarding Two Rivers - 1/10/2005 Page 2 of 3 Parkway and Telep access points including improved sight distances for Telep Family WMX easement access so that it is usable in fact, but have not received an answer yet from Evans engineering. Milliken, on the other hand, provided us with preliminary information and assistance for Telep access points so that they can be made safe and usable onto Two Rivers Parkway across Waste Management property which is of vital concern to us. Evans did not answer. Milliken did. We will look forward to more information from Evans. We as the Telep family are amenable to comprehensive discussions with the City of Evans regarding all these issues affecting our land. If we can encourage and participate in cooperative development of service lines and community identifiers as well as possible development which might yield attractive tax revenues to one or both municipalities, we want to be included in such meetings and sensible engineering and design. Telep farms bisected along WCR 52. This Petition by Evans bisects our four 80-acre farms using WCR 52, currently a gravel road, which deadends into Gerald and Jan Mossberg's property and pivot West of our property at 83rd Avenue. The neighbors East of this intersection signed polls and have indicated desire to remain in Weld County and to develop their properties with Milliken engineers with a view toward consulting us and our engineers. Our plans to save our farm improvements depend upon ownership and control of both sides of this roadway with engineering redesign of a gentle curve and line of sight road ROW for WCR 52 which will not take off the granary, mature trees and front door of our house. Gerrymandering a flagpole annexation. This Petition is unnecessary at this time for anything but awkward gerrymandered flagpole annexation purposes. It appears that Evans may seek to make a land grab or "stake a claim" to the intersection of 49th Street and Two Rivers Parkway to our corners and our land trying to use this Petition. This Petition should be withdrawn and/or voted down. We like cooperative effort to municipal services and extensions of lines and roadways and proper sizing and engineering of them. We cannot help but remark upon the lack of communication from Evans in attempting this ROW land grab using this Petition to annex roads adjacent and including our existing farmland and improvements. Most of the surrounding properties will be annexing into Milliken instead of Evans and much of this may be because of lack of trust. Better communication can dispel these possible misconceptions. Notice of hearing at Christmas and New Year's Holiday Season is interesting: I actually learned of this Petition and Monday January 10 hearing from Dr. Duane Flack when I attended his mother's funeral on Thursday January 6 (yesterday). I then went to Myrt's and found our Telep Family letter from Mr. Barker. My mother Myrtle Telep is irate that Evans would find it necessary to bisect our farms to attempt a flagpole annexation using the roadway when the neighbors of the Ashton Community associate themselves in spirit with Milliken. I believe that our neighbors in the Ashton Community such as Jerry and Jan Mossberg and David Bernhardt oppose this Petition whether they are able to attend the hearing on Monday, January 10, 2005, or not due to prior commitments. I am cancelling my physical therapy appointment to be able to attend on Monday. I could have been reached by telephone at any time by Evans officials while recuperating from my back surgeries so I would have had knowledge that this request was coming. Due to the holidays and vacations scheduled for Christmas and New Year's of our consultants, medical appointments, deaths and funerals, and our own year-end family activities, unfortunately our December 30 letter was in a stack of mail at Myrtle's. 1/10/2005 Page 3 of 3 Myrtle Telep is angry to think that the timing of this Petition has been done by Evans hoping to fly under our radar so that we would not be likely to realize what was happening and we would not be able to respond in a timely manner to this Evans Petition. Christmas and New Year's Holidays have meant that we have not been here. Also, Milliken staff took holiday and vacation weeks off at this time. Our own surveyors and engineers have been on holiday. What an opportune time for a municipality that has not telephoned us, has not written to us, has not spoken with us about this whatsoever to claim straightline rights-of-way which will and do negatively impact our house, granary, mature trees, ditches, oil and gas lines, underground lines, general farm improvements, pivots, and ultimately our own plans for long-term development of our farms and those of our neighbors in the Ashton Community. No communication regarding this matter from Evans: Regarding notice of impact on adjacent property, the map sent with the Evans Petition is such that it conveys virtually no true information about impact of this Evans Petition on our farms. Use of this scale means that none of the true negative impact of this ROW transfer is shown on this map. My mother used to teach geography and she calls it the tool of an apparent land-grab so that as little information as possible is given to the landowner. Summary: The Telep family is negatively impacted by this Petition. We vehemently oppose it for all the reasons stated above. This Petition by the City of Evans is ill-considered and inappropriate at this time for anything except gerrymandering an awkward flagpole annexation. Please do not table this matter and do not "continue" this matter. We ask each of you to vote "NO" on this Petition by the City of Evans for Weld County to transfer its ownership to the City of Evans to own and control part of Two Rivers Pkwy (WCR 27.5 along the East side of the Telep farms and part of WCR 52 as it bisects the Telep farms. This appears to us to be a thinly disguised attempt to grab the intersection of Two Rivers Parkway and 49th Street and to prevent us from being able to continue our plans with the Town of Milliken. This agreement will help encourage compact development patterns, stop urban sprawl, provide for the efficient provision of services and help prevent leapfrog development patterns. All of these goals are supported in both the Weld County Comprehensive Plan and the Milliken Comprehensive Plan. Milliken has based much of our planning efforts on the intent of the CPA and we believe that the area will suffer economic and environmental losses if our planning area is not recognized. We agree that the CPA will not be effective if adjacent municipalities are annexing into each other's primary growth areas. Your assistance with establishing a CPA is critical for the smaller communities, and in this matter, we are asking your help. Mayor Measner and Mayor Weisburg have spoken about this issue several times and have agreed to bring the communities'boards together to discuss this matter in January. We are vehemently opposed to the Green Lake annexation into the City of Evans, as it is in the heart of Milliken's Primary Planning Area. In addition to being within Milliken's 208 boundary, we have planned for the "Green Lake" property in the Milliken Comprehensive Plan, the Johnstown/Milliken Parks, Trails, Recreation and Open Space Master Plan as well as our master utility plans. Initial evaluation for the master utility plan indicates that the Town requires an additional feed to the water system for the east side of town. The Town's current outside water providers are City of Greeley and Central Weld County Water,both of their connection points are located on the west side of Town. If we are cut off on the north from the City of Greeley by the proposed annexation—the Town loses the chance for this vital connection to Greeley's water system, and the most cost effective loop for our current water system. This annexation will significantly impact our ability to service other properties within our service area, and it may have serious financial implications not only to our water system but to our community as well.
