This project falls primarily under the purview of the Use by Special Review Standards, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Our comments and requirements are as follows: COMMENTS: WCR 25 is utilized as a portion of the designated haul route for the landfill directly north of State Highway 14. The remaining portion of WCR 25 is presently a local gravel road. There is presently a 60-foot right-of-way, and this stretch is maintained by Weld County. Storm Water Drainage: The applicant has provided a storm water drainage study. The Public Works staff ..bas signed off on it as of August 29, 2005. The applicant has also provided roadway construction plans. The Public Works staff has signed off on the WCR 25 upgrading to pavement dated August 29, 2005. REQUIREMENTS: Improvements Agreement: The applicant shall enter into a Long-Term Road Maintenance and Improvements Agreement with the Weld County Public Works Department for the upgrade, paving, and future maintenance of WCR 25, which is associated with the existing landfill operation. Off-Site Parking: The off-site parking spaces at the main office/trucks/employees parking lots including the access shall be surfaced with asphalt, concrete, or the equivalent and shall be graded to prevent drainage problems. State Highway 14: The Colorado Department of Transportation (CDOT) has jurisdiction over all accesses to the state highways. Please contact Hice-Idler at the Greeley office to verify access permits or for any additional requirements that may be necessary to obtain or upgrade the permit. WHEREAS,WMC has acquired a Land Use Permit from the County for an administration facility,container repair facility,fueling station,truck wash,container storage,and truck storage in the A(Agricultural)Zone District on approximately 27 acres, located in part of the NW ''A of Section 7, Township 7 North,Range 66 West of the 6th P.M. Weld County, Colorado. WHEREAS, the operation facility generates an increase of heavy vehicle traffic, and WHEREAS,the existing County roads that serve the operation facility shall require increased maintenance and improvement due to the increase in heavy vehicle traffic, and WHEREAS, COUNTY and WMC have reviewed maintenance and improvements proposals put forth by ,}AMC and both parties agree that such maintenance and improvements will enhance the accessibility and safety of roads that serve said operation facility. NOW, THEREFORE, in consideration of the mutual covenants and conditions hereinafter set forth, COUNTY and WMC mutually agree as follows: Truck Traffic A. All waste trucks shall utilize Weld County Road(WCR)25,north of State Highway 14(truck route) for ingress/egress to the operation facility. Improvements B. WMC shall provide a pavement overlay design for the entire truck route within the Weld County Road maintenance area for review and approval by the Public Works Department. An overlay shall be required from the main entrance of the operation facility on to WCR 25 south to State Highway 14. C. WMC shall complete the Long-Term Maintenance and Improvements Agreement associated with the proposed operation facility and as outlined in this agreement prior to commencement of truck traffic. 1. WMC shall start working on truck route improvements within six (6) months of signed agreement and be completed in approximately six(6)months from the start of the road construction. The time period shall start when truck traffic is on the site. - 1 - D. WMC will provide testing services and inspection for the construction of the improvements. The COUNTY will only provide oversight. A registered professional engineer,registered in the State of Colorado, shall provide the COUNTY with a letter that certifies the proper installation of the improvements. E. WMC shall pay 100% of the improvements on WCR 25 from their main entrance south to State Highway 14. F. The safety improvements shall include: construction of adequate turning radii at the main entrance on to WCR 25; and asphalt overlay 24 feet wide with four foot gravel shoulders from the main entrance south to State Highway 14. G. The engineering design and construction plans shall be the responsibility of the WMC. The applicant shall provide the COUNTY with construction drawings that detail the required improvements. The plans shall consist of, at a minimum, main entrance intersection layout and grading, cross section, approach road, adequate turning radiuses, and a geometric recommendation on depth of additional asphalt overlay to accommodate heavy truck traffic. These plans will require approval by the Public Works Director/County Engineer or his representative. A registered professional engineer,registered in the State of Colorado,must prepare the construction plans. The plans, when reviewed and approved, will constitute a section of this agreement. They will be attached hereto and referenced as Exhibit "A." H. The applicant shall warrant and guarantee all improvements for a period of one year from completion. Maintenance I. WMC agrees to excavate,repair, or patch any damage on said road that has been created by heavy truck traffic from WMC operation facility. The type and method of repair will be determined by the Public Works Director/County Engineer or his representative. The repairs shall commence within thirty(30) days of receipt or our written notice. J. There will be an annual road inspection in the spring to determine actual conditions and what work is to be performed that summer if any repairs are needed. K. At any time in the future, if road damage has increased beyond the point that repair of damage can reasonably restore the road,WMC will pay a proportionate cost share based on truck traffic using the haul route in the reconstruction of those parts of said road. L. If reconstruction is required, WMC shall pay a proportional share of the cost to reconstruct. The share will be determined by dividing the volume of the site-generated trucks by the total volume of trucks. The COUNTY will provide the traffic volumes. - 2 - CDOT Improvements M. WMC shall address all the Colorado Department of Transportation (CDOT) access issues at the intersection of State Highway 14 and WCR 25. 2. Prior to the start of the operation facility, the COUNTY AND WMC will document the existing condition of the roadways. This effort will ensure that WMC will not be held responsible for existing roadway damage, if any. 3. Failure of either party to perform any of its respective obligations hereunder by reason of acts of God, strike, or acts of any governmental agency or authority having jurisdiction over matters set forth herein shall excuse timely performance of such obligations, but shall not excuse the performance of such obligations as soon as reasonably practical. The parties may,however,mutually consent to excuse a party from performing any obligation,in whole or in part,upon a showing that performance has been rendered impracticable by reason or FORCE MAJEURE. 4. This Agreement may not be assigned in whole or in part by either party hereto without the written consent of the other party. Such consent will not be reasonably withheld, conditioned, or delayed. 5. If any clause or provision of this Agreement is illegal,invalid,or unenforceable,then it is the intention of the parties that the remainder of this Agreement shall not be affected. 6. Should WMC sell its operation, cease operating, file bankruptcy, or in any way release ownership and responsibility of the permitted property, this Agreement as set forth herein, shall be terminated. If the aforementioned release should occur,WMC shall give a minimum notice of ninety (90) days to the COUNTY before the date of termination 7. All construction and material controls for a project will be in accordance with the current Standards Specifications for Road and Bridge Construction,as supplemented or revised,provided by the Colorado Department of Transportation. During construction, signage shall be posted in accordance with the most current Uniform Manual on Traffic Control Devices. 8. It is expressly understood and agreed that enforcement of the terms and conditions of this Agreement, and all rights of action relating to such enforcement, shall be strictly reserved to the undersigned parties, and nothing contained in this Agreement shall give or allow any claim or right of actions whatsoever by any other person not included in this Agreement. It is the express intention of the undersigned parties that any entity other than the undersigned parties receiving services or benefits under this Agreement shall be deemed an incidental beneficiary only. 9. Indemnification: To the extent authorized by law,WMC agrees to indemnify,save,and hold the COUNTY harmless from and against any and all claims,damages,losses, and judgments,which may be suffered or incurred by the COUNTY as a consequence of any breach by WMC of its obligations and duties set forth in this Agreement on those portions of the haul route described in this �^ Agreement. In the event that any dispute shall arise under this Agreement, the prevailing party in such dispute shall be entitled, in addition to any other relief to which such party may be granted,to _ 3 _ recover its reasonable attorney's fees and court costs incurred in connection with the resolution of such dispute. 10. By entering into this Agreement,the parties do not intend, either expressly or implicitly, to create a joint venture or partnership. Except as provided herein,neither party shall have the right or authority to act for, or on behalf of, or to enter into, any obligations which are binding on the other party to this Agreement. 11. All notices to be given under this Agreement shall be in writing and delivered in person, or mailed by certified or registered U.S. Mail, or sent by a nationally recognized overnight delivery service, to the party to receive such notice at the following addresses: Weld County Board of Commissioners (COUNTY) P.O. We have no objections to the proposal, however, we do recommend that the following conditions be part of any approval: We recommend that the following requirements be met prior to allowing the plat to be recorded: 1. Submit a dust abatement plan to the Environmental Health Services, Weld County Department of Public Health & Environment, for approval prior to operation. 2. The applicant shall submit evidence of an Air Pollution Emission Notice (A.P.E.N.) and Emissions Permit application from the Air Pollution Control Division (APCD), Colorado Department of Health and Environment. Alternately, the applicant can provide evidence from the APCD that they are not subject to these requirements. 3. The impoundment is subject to Regulation No. 61 of the Water Quality Control Commission of the Colorado Department of Public Health & Environment. The facility shall provide evidence to the Weld County Department of Public Health and Environment that it has either applied for a CDPS permit or a waiver. 4. The applicant shall submit evidence of an Aboveground Storage Tank permit from the Colorado Department of Labor and Employment (CDL&E), Oil Inspection Section for any aboveground storage tanks located on the site. Alternately, the applicant can provide evidence from the (CDL&E), Oil Inspection Section that they are not subject to these requirements. 5. A detailed design and operation plan for the truck wash and repair shop floor drain shall be submitted to the Environmental Health Services of the Weld County Department of Public Health & Environment for review and approval. The plan shall be reviewed and stamped by a registered professional engineer and demonstrate that construction of the truck wash and evaporation pond will limit discharges to the environment within the limits described in the rules and regulations of the Water Quality Control Division of the Colorado Department of Public Health & Environment. The plan should include, at a minimum, the following: a. A description of the materials used to construct the wash bay. b. The method of construction incorporated to prevent waste water from escaping the structure. c. A schematic of the flow of water through the wash bay, screen and sand/oil/water separator to the evaporation pond. d. A water balance or other demonstration that the evaporation pond is adequately sized to store and dispose the anticipated hydraulic load from the repair shop, truck wash and storm water runoff . 6. The applicant shall submit a waste handling plan, for approval, to the Environmental Health Services Division of the Weld County Department of Public Health & Environment. The plan shall include, at a minimum, the following: 1) A list of wastes which are expected to be generated on site (this should include expected volumes and types of waste generated). 2) A list of the type and volume of chemicals expected to be stored on site. 3) The waste handler and facility where the waste will be disposed (including the facility name, address, and phone number). We recommend that the following requirements be incorporated into the permit as conditions that must be met prior to the issuance of the Certificate of Occupancy: 1. An individual sewage disposal system is required for the administration and/or repair/wash bay building and shall be installed according to the Weld County Individual Sewage Disposal Regulations. An application for a septic permit for the office and shop has been applied for (SP-0500167). 2 2. The septic system is required to be designed by a Colorado Registered Professional Engineer according to the Weld County Individual Sewage Disposal Regulations. 3. In the event the septic system(s) requires a design capacity of over 2,000 gallons of sewage per day the applicants shall provide evidence that all requirements of the Water Quality Control Division of the Colorado Department of Public Health and Environment (specifically Policies WQSA-6 and WQSA-8 ) have been satisfied. Evidence of compliance shall be provided to the Weld County Department of Public Health and Environment. 4. The applicant shall submit evidence of an Underground Injection Control (UIC) Class V Injection Well permit from the Environmental Protection Agency (EPA) for any large-capacity septic system (a septic system with the capacity to serve 20 or more persons per day). Alternately, the applicant can provide evidence from the EPA that they are not subject to the EPA Class V requirements. We recommend that the following requirements be incorporated into the permit as development standards: 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. 4. The applicant shall operate in accordance with the approved "waste handling plan". 5. The truck wash shall be operated in accordance with the approved design and operations plan and in accordance with the Rules and Regulations of the Water Quality Control Commission, and the Environmental Protection Agency. 6. The facility shall have adequate equipment to dewater the retention structure, if necessary. 3 • 7. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The facility shall be operated in accordance with the approved dust abatement plan at all times. 8. This facility shall adhere to the maximum permissible noise levels allowed in the Industrial Zone as delineated in 25-12-103 C.R.S., as amended. 9. Adequate handwashing and toilet facilities shall be provided for employees and patrons of the facility. 10.Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to Individual Sewage Disposal Systems. 11.The facility shall utilize the existing public water supply. (North Weld County Water District) 12.All potentially hazardous chemicals must be stored and handled in a safe manner in accordance with product labeling and in a manner that minimizes the release of hazardous air pollutants (HAP's) and volatile organic compounds (VOC's). 13.The applicant shall comply with all provisions of the Underground and Above Ground Storage Tank Regulations (7 CCR 1101-14). 14.If applicable, the applicant shall obtain a stormwater discharge permit from the Colorado Department of Public Health & Environment, Water Quality Control Division. 15.The operation shall comply with all applicable rules and regulations of the State and Federal agencies and the Weld County Code. 4 „-`- 0 Weld County Referral August 15, 2005 C. A building permit is required for each structure on the site. Two complete sets of engineer stamped plans will be required at the time of the permit application. The administration building will most likely be classified as a B occupancy, and the repair facility will be classified as a S-1 occupancy. Actual building requirements will be determined at the plan review stage after building permits have been applied for. Approval from the local fire district must be submitted before permits can be finaled. 2. Buildings shall conform to the various codes adopted at the time of the permit application. Current codes adopted by Weld County include; 2003 International building code, 2003 International Mechanical code, 2003 International plumbing code, 2003 International fuel gas code, 2002 national electrical code, and chapter 29 of the Weld County code. 3. Fire resistance of walls and openings, construction requirements, maximum building height and allowable areas will be reviewed at the plan review. The following comments shall apply to this project. 1. There shall be a minimum of two points of access to this facility. 2. Each access shall be designed to carry a designed wheel load of 18000pounds (80000 pound gvw) (H2O loading). 3. The accesses shall be constructed of a permanent all weather road base. 4. Addresses shall be posted clearly on the road fronting the property. 5. Addresses shall be posted clearly on the structure. 6. If any of the gates to this site are to be automatic they shall be provided with a KNOX key override switch. 7. Both buildings shall be provided with an approved Fire Sprinkler System and the fire line shall be shown on the site utility drawings and labeled as such and approved by the Windsor-Severance Fire Protection District. 8. The minimum fire flows required for this project are 1500 gpm at a minimum of 20 psi and a flow duration of three (3) hours. 9. The minimum number of fire hydrants required shall be four(4). 10. The minimum water line sizes for the fire hydrants shall be 8". 11. The Windsor-Severance Fire Protection District shall be afforded the opportunity to review and approve all building drawings before a building permit is issued. 12. The Windsor-Severance Fire Protection District shall be afforded the opportunity to review and approve all construction drawings for the installation of any fuel tanks or associated appliances.
