HomeMy WebLinkAbout20050508.tiff RESOLUTION RE: APPROVE AGREEMENT CONCERNING PURCHASE OF RIGHT-OF-WAY FOR CERTAIN IMPROVEMENTS TO WELD COUNTY ROAD 13 AND TEMPORARY CONSTRUCTION EASEMENT AND AUTHORIZE CHAIR TO SIGN ANY NECESSARY DOCUMENTS - DUANE AND BERNICE KIRKMEYER WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with an Agreement Concerning Purchase of Right-of-Way for Certain Improvements to Weld County Road 13 and Temporary Construction Easement between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Public Works, and Duane and Bernice Kirkmeyer, 1595 Weld County Road 13, Brighton, Colorado 80603, with terms and conditions being as stated in said agreement and easement, and WHEREAS, after review, the Board deems it advisable to approve said agreement and easement, copies of which are attached hereto and incorporated herein by reference. NOW,THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Agreement Concerning Purchase of Right-of-Way for Certain Improvements to Weld County Road 13 and Temporary Construction Easement between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Public Works, andDuane and Bernice Kirkmeyer, be, and hereby are, approved. Duane Kirkmeyer and Bernice K. County agrees to compensate the Owner the sum of Seventy Nine Thousand Nine Hundred Five and no/100($79,905.00)dollars for the relocation of the existing irrigation lateral and reconstruction of the existing pond per the Estimate of Quantities prepared by Jehn Engineering and attached hereto as Exhibit C and construction plan prepared by Jehn Engineering and attached hereto as Exhibit D and made part of this agreement. 9. County will reimburse the Owner the Sum of Forty Three ($43.00) dollars for the execution of the Temporary Construction Easement form as attached hereto. 10. County will reimburse the Owner the sum of Three Thousand Nine Hundred Twenty and no/100 ($3920.00) dollars for the value of trees being removed due to the new road construction.The trees being removed are described as all trees lying within the new mad -2 - �k • • • right-of-way.
