The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity
with the laws of the State of Colorado at the regular place of meeting in the Weld County Centennial Center,
Greeley, Colorado, April 11, 2005, at the hour of 9:00 a.m.
ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were
present, constituting a quorum of the members thereof:
Commissioner William H. Jerke, Chair
Commissioner M. J. Geile, Pro-Tem
Commissioner David E. Long - EXCUSED
Commissioner Robert D. Masden - EXCUSED
Commissioner Glenn Vaad

MINUTES: Commissioner Geile moved to approve the minutes of the Board of County Commissioners
meeting of April 6,2005,as printed. Commissioner Vaad seconded the motion,and it carried unanimously.
CERTIFICATION OF HEARINGS: Commissioner Vaad moved to approve the Certification of Hearings
conducted on April 6, 2005, as follows: 1) RS#1086, Darrell and Nelva Bearson, c/o The Bell 5 Land
Company,Attn: Kirk or Meredith Goble; 2) MZ#1069, David and Susanne Schwind; and 3) Show Cause
Hearing regarding USR#1456, Barbara Schottelkotte. Commissioner Geile seconded the motion,which
carried unanimously.
AMENDMENTS TO AGENDA: There were no amendments to the agenda.
PUBLIC INPUT: No public input was given.
CONSENT AGENDA: Commissioner Geile moved to approve the consent agenda as printed.
Commissioner Vaad seconded the motion, and it carried unanimously.
PROCLAMATIONS:
WELD COUNTY VICTIMS' RIGHTS WEEK - APRIL 10 TO 16, 2005: Chair Jerke read the certificate
proclaiming April 10-16,2005,as Weld County Victims'Rights Week. Ken Buck, District Attorney,stated
the goal is to assist victims from many different angles, and the private sector is a huge part of that effort.
He stated the volunteers are passionate about helping victims of crime,and their help provides a savings
for taxpayers. Representatives from various agencies were present, including JoAnn Holden and Carol

Patch from the District Attorney's Office; Raegan Maldonado and Marcia Jorgensen from the Human
Services Ombudsmen Program; Naomi Kettinger from Partners, and Cecil Ferrill and others from the
Greeley Police Department.
PRESENTATIONS:
RECOGNITION OF SERVICES, ROBERT FRENCH: Chair Jerke read the certificate recognizing Robert
French for fifteen years of service to Weld County.
WARRANTS: Donald Warden, Director of Finance and Administration,presented the following warrants
for approval by the Board:
All Funds $715,998.02
Commissioner Geile moved to approve the warrants as presented by Mr.Warden. Commissioner Vaad
seconded the motion, which carried unanimously.
NEW BUSINESS:
CONSIDER RENEWAL APPLICATION FOR HOTEL AND RESTAURANT LIQUOR LICENSE AND
AUTHORIZE CHAIR TO SIGN-YE'O JR., INC., DBA BOLDT IN GRILL: Bruce Barker, County Attorney,
stated Deputy Wagner, Sheriff's Office, had no concerns with this renewal. Commissioner Geile moved
to approve said renewal application and authorize the Chair to sign. Seconded by Commissioner Vaad,the
motion carried unanimously.
CONSIDER RENEWAL APPLICATION FOR TAVERN LIQUOR LICENSE AND AUTHORIZE CHAIR TO
SIGN-DEWEY'S BAR AND GRILL, LLC, DBA DEWEY'S BAR AND GRILL: Mr. Barker stated there were
no concerns stated by the Sheriff's Office regarding this application. Commissioner Geile moved to
approve said renewal application and authorize the Chair to sign. The motion was seconded by
Commissioner Vaad , and it carried unanimously.
CONSIDER AGREEMENT CONCERNING PURCHASE OF RIGHT-OF-WAY FOR CERTAIN
IMPROVEMENTS TO WELD COUNTY ROAD 126,TEMPORARY CONSTRUCTION EASEMENT,AND
DEED OF DEDICATION AND AUTHORIZE CHAIR TO SIGN ANY NECESSARY DOCUMENTS-GARY
WILSON AND CHARLOTTA WILSON: Mr. Barker stated this purchase of right-of-way is a result of over
a year of negotiation. He stated Mr. and Mrs. Wilson finally agreed to an amount, with the County also
paying for an appraisal. Frank Hempen, Jr., Director of Department of Public Works, responded to Chair
Jerke that this is the final stage of Weld County Road 126 improvements west of Carr, and there is one
additional purchase to be approved by the Board. When completed, Road 126 will be paved from
Highway 85 to 1-25. Commissioner Vaad moved to approve said agreement and temporary construction
easement, accept the Deed of Dedication, and authorize the Chair to sign. The motion, which was
seconded by Commissioner Geile, carried unanimously.
PLANNING:
CONSIDER VACATION OF USE BY SPECIAL REVIEW PERMIT#944-WENDY ENDY DYER:Jacqueline Hatch,
Department of Planning Services,stated Steve Stencil, Highland Properties, requested this vacation as a
requirement of Recorded Exemption#3973. Responding to Chair Jerke, Ms. Hatch stated there are 41
acres included in the permit,and a single family home is on the property;however,the Recorded Exemption
makes the Use By Special Review Permit unnecessary. Commissioner Geile moved to vacate Use by
Special Review Permit#944. Commissioner Vaad seconded the motion, which carried unanimously.
RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the
consent agenda. No Ordinances were approved.
