RE: APPROVE MEMORANDUM OF UNDERSTANDING PURSUANT TO HOUSE BILL
04- 1451 WITH VARIOUS AGENCIES AND AUTHORIZE CHAIR TO SIGN
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS,the Board has been presented with a Memorandum of Understanding Pursuant
to House Bill 04-1451 between the County of Weld, State of Colorado, by and through the Board
of County Commissioners of Weld County, on behalf of the Department of Social Services, and
various agencies, commencing July 1, 2005, and ending June 30, 2006, with further terms and
conditions being as stated in said agreement, and
WHEREAS, after review,the Board deems it advisable to approve said agreement, a copy
of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, ex-officio Board of Social Services, that the Memorandum of Understanding
Pursuant to House Bill 04-1451 between the County of Weld, State of Colorado, by and through
the Board of County Commissioners of Weld County, on behalf of the Department of Social
Services, with various agencies, be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to
sign said agreement.
The above and foregoing Resolution was, on motion duly made and seconded, adopted by
the following vote on the 6th day of June, A.D., 2005.

Enclosed for Board approval is a Memorandum of Understanding (MOU)under HB04-1451.
HB04-1451, Collaborative Management of Multi-agency Services Provided to Children and
Families, is an optional planning process for counties and"shall be between interested county
departments of social services and local representatives" of local judicial districts, including
probation services, the health department, local school districts, community mental health center,
and each mental health assessment and service agency(now behavioral health organization). The
MOU was reviewed at the Board's Work Session of May 31, 2005.
The major provisions of the MOU are as follows:
1. The term of the MOU is July 1, 2005, through June 30, 2006.
2. The parties and voting members of the MOU number fourteen (14) and are:

(TIGHT)Program, and the Multi-Systemic Therapy (MST). These programs are
anticipated to service 940 youth and their families.
4. The parties to the MOU that have veto power, according to statute, are Mental Health
Center, Behavioral Health Organization, Weld County Public Health and Environment,
19th Judicial District including Probation, Weld County Commissioners including Weld
County Department of Social Services, School District 6, Centennial BOCES

MEMORANDUM OF UNDERSTANDING
PURSUANT TO HOUSE BILL 04-1451
This Agreement is made by and between the WELD COUNTY DEPARTMENT OF SOCIAL
SERVICES ("Social Services"), located at 315 N. 11th Avenue, Greeley, CO, 80631,the 19TH
JUDICIAL DISTRICT including PROBATION DEPARTMENT ("Probation"), located at
934 9th Avenue, Greeley, CO 80631, the WELD COUNTY DEPARTMENT OF PUBLIC
HEALTH& ENVIRONMENT ("Public Health"), located at 1555 N. 17th Avenue, Greeley,

CO 80631. Each signatory to this MOU is referred to as a"Party", and collectively as "Parties".
WHEREAS, the Colorado General Assembly has determined that a collaborative
approach to the delivery of services to children and families may lead to the provision of more
appropriate and effective delivery of services; and
WHEREAS, the Colorado General Assembly has determined that such collaboration may
ultimately allow the agencies providing treatment and services to provide appropriate services to
children and families within existing consolidated resources; and
WHEREAS,the Colorado General Assembly has determined that it is in the best interests •
of the State of Colorado to establish a collaborative management of multi-agency services
provided to children and families; and
WHEREAS, the undersigned desire to enter into an agreement for the collaboration of
services to families and children who would benefit from integrated multi-agency services; and
WHEREAS, the undersigned agencies include all the agencies' required by statute.
NOW THEREFORE, in consideration of the premises and mutual promises and
covenants herein contained, the Parties agree as follows:
The Agreement. This Memorandum of Understanding("MOU" or"Agreement") is contained in
this writing, which consists of 20 pages and Attachments A through D.
Term of this Agreement. This MOU shall be effective beginning July 1, 2005 and shall expire
June 30, 2006.

I. Renewal of MOU. The Parties may renew this MOU annually subject to mutual
agreement. Each Party reserves the right to elect not to renew the MOU after expiration of the
current term. If any Party intends not to renew the MOU, it should give notice of such intent at
least thirty(30) days prior to expiration of the Agreement.
II. Population to be Served. The persons who will be recipients of services under this
MOU shall be "children and families who would benefit from integrated multi-agency services",
("Recipients"). This population of persons is defined as all Program Area 4 youth as defined in
Volume 7.201.1 and 7.201.2, "Program Area 4 Services are provided to reduce or eliminate
conflicts between youth and their family members or the community when those conflicts affect
the youth's well-being, the normal functioning of the family or the well-being of the community.
The focus of services shall be on alleviating conflicts,protecting the youth and the community,
reestablishing family stability, or assisting the youth to emancipate successfully." Target Groups
consist of A) "Children and youth who are beyond the control of their parents or guardians" and
B) "Children and youth whose behavior is such that there is a likelihood they may cause harm to
themselves or to others or who have committed acts that could cause them to be adjudicated a
delinquent child by the court". The populations to be served include children and youth involved
in the juvenile justice system. The total youth, children and families anticipated to be served
under the MOU is 940.
III. Services and Funding Sources. The parties agree to provide the following specific
services and subject to available funds,hereby identify the following funding sources for the
provision of such services.
•
A. Social Services. Social Services will be responsible for providing the following services:
Multi-Disciplinary Youth Assessment Team (MYAT) as described in Appendix A of
this Agreement. MYAT is a collaborative effort to develop a system-wide approach to
address the needs of at-risk youth and their families by connecting or developing positive •
alternatives for youth and families, strengthening families, and preventing these youth
from entering the Child Welfare or Youth Corrections systems. MYAT partners include
many of the current partners of the MOU including North Range,Public Health, Human
Services, and Island Grove. Additional partners being added prior to July 1, 2005,
include Probation, the school districts of St. Vrain, Centennial BOCES, School District 6
and faith-based organizations of LifeBridge. Total Federal, State, and County money is
$382,000. The source of funds is Colorado Works. MYAT is expected to serve 900
families through contacts, follow-up and case management services. Each agency
participating in MYAT provides in-kind support through agency supervision, oversight,
and planning collaboration.
Teamwork,Innovation, Growth, Hope and Training (TIGHT) Program as described
in Appendix B of this Agreement. The TIGHT Program addresses the needs of at-risk
youth and their families in collaboration with Employment Services and Family Based
Services through a mental health contractor, to prevent or reduce their lengthy
participation in Residential Treatment Center care. Participating youth and their families
will average 24. Youth will participate in worthwhile community projects, allow them to
make reparations to their community and develop pro-social relationships. Total Federal,
State, and County money is $298,478 from Core Service funding.

Multi-Systemic Therapy(MST) as described in Appendix C of this Agreement. MST is
a collaborative effort with Larimer Center for Mental Health,North Range Behavioral
Health, and the Center for Effective Interventions. Meetings have been scheduled with
other collaborative agencies including Probation, School District 6, DYC, DA, and SB-94
in order to secure their support for the program's initiation on or about June 1, 2005, and
to determine whether other partners would purchase MST services for populations that
they serve. The number of youth and families to be served in MST intensive in-home
intervention on average is 16 families per year per MST therapist. MST is an evidence-
based treatment program that avoids or reduces lengthy placement in Residential
Treatment Center care. Total Federal, State, and County money is $60,000 in Core
Service funding.
Planning Facilitator and Staff Support for the Collaborative Management Process will
provide the financial resources for a facilitator to continue planning efforts for the period
of July 1, 2005 through June 30,2006, to help the IOG define programmatic and planning
goals/outcomes and to meet consensus whenever possible as an IOG. Staff support will
be requested through the Colorado State University,through its contract with the
Colorado Department of Human Services.
Families,Youth, and Children Commission for the Collaborative Management Process
and is the Placement Alternatives Commission for Weld County, as referred to in C.R.S.
§ 19-1-166 (2)(a), and prepares the plans required by C.R.S. § 19-1-116(2)(b) and the
Family Preservation Commission for Weld County, as referred to in C.R.S. § 26-5-.5-
106(1), and comply with the review and reporting requirements of C.R.S. § 255-5.5-
106(2). The Families, Youth, and Children Commission reviews and advises the Board
of County Commissioners regarding core service programs including the TIGHT
Program and the MST Program, other Residential Treatment Center prevention programs,
and MYAT. Representatives of the ten-member Commission include a physician or
licensed professional, an attorney, and representatives from local law enforcement
agency, probation department, mental health, local school district, foster parent/adoptive
parent, child protection team, an accountant, and a clinic nurse. The Families, Youth, and
Children Commission ByLaws are described in Appendix D of this Agreement. A
member of that Commission will participate on the Collaborative Management Process.
Faith Based Community Development for the Collaborative Management Process is an
initiative to expand the MYAT concept and system-wide development and collaborative
efforts with faith-based organizations, support continuing planning efforts under HB04-
1451, and develops a process for families involved in first-time minor incidents of child
abuse to access services, in part,through faith-based organizations, as referred to in
C.R.S. § 19-3-309.5.
B. Probation.
The first year of this MOU Probation will have less an active role, but will be in the
planning process. Probation will be responsible for MYAT participation. Probation
currently sees youth once a month by their Probation Officer for case management. This
case management may include random drug testing and tracking of the progress of youth
according to their court-order treatment.
C. Public Health.

Public Health will be responsible for attending all of the Weld County HB04-1451
meetings in order to become educated as to the programs within this MOU. Public
Health will be responsible for MYAT participation. Public Health offers relationship
counseling to youth and families through individual or in small groups, in homes,
churches through youth groups and Quinceanera ceremonies. Public Health offers a teen
counselor at their clinic. This counselor deals with abstinence, family planning, and
contraceptive, STD, and pregnancy issues.
D. North Range.
The North Range will be responsible for MYAT and Multi-Systemic Therapy
participation. The first year of this MOU North Range will be in the planning process
and will actively participate in the second year.
E. BRO.
Northeast Behavioral Health(NBH) is the Behavioral Healthcare Organization (BHO)
that holds the State contract to provide all medically necessary mental health services to
Medicaid enrollees in twelve counties in northeast Colorado, including Weld County.
Inpatient,residential, medication management, case management and a variety of
specialized outpatient services comprise the services provided.
Needed mental health services are provided by qualified agencies and individuals through
contractual agreements. The majority of Medicaid funded services for residents of Weld
County is provided through programs offered by North Range Behavioral Health.
Medicaid funding for mental health services through NBH for residents of Weld County
totaled$4,316,112 during the fiscal year that ended June 30, 2004. The number of
people served during that time period totaled 1,921.
As a part of the HB04-1451 MOU for Weld County,NBH commits to continued funding
of all medically necessary mental health services for Medicaid enrollees in Weld County.
In addition, to ensure that NBH funded services are provided in a manner that is
consistent with the overall aims of the MOU,NBH will assign a representative to serve as
a member of the Interagency Oversight Group to participate actively in the planning and
monitoring of the integrated service system.
F. BOCES.
The first year of this MOU the BOCES will have a less active role, but will be in the
planning process. BOCES will be responsible for MYAT participation. BOCES offers a
variety of suspension and expulsion programs, a drop-out retrieval process to get youth
back into school, truancy prevention and alternative high school programs, as developed
among member school districts.
G. District 6.
District 6 will be responsible for attending all of the Weld County HB04-1451 meetings
in order to become educated as to the programs within this MOU. The first year of this
MOU, District 6 will have a less active role,but will be in the planning process. District
6 will be responsible for MYAT participation. District 6 offers pre-expulsion

interventions and expulsion classes through the learning lab. The truancy prevention
specialist offers case management interventions to encourage school attendance.
H. DYC.
DYC will be responsible for attending all of the Weld County HB04-1451 meetings in
order to become educated as to the programs within this MOU. DYC's involvement in
this HB04-1451 process will include the following:
1. Work to build better service capacity(assessment, case planning, treatment, and
continuing care)at the local level.
2. Share expertise to provide for higher quality assessments throughout the
continuum.
3. Participate in the multi-disciplinary staffing teams at the local level to plan for
and deliver aftercare parole services that are evidence-based as available.
4. Support existing efforts to properly"sort"youth for purposes of sentencing
recommendations and pretrial release planning.
5. Continue to be involved at the local level through the collaborative management
of SB-94 services and resources.
6. Participate in Interagency Oversight Groups throughout the State, as we now do
with the SB-94 Juvenile Services Planning Committees.
7. Represent the public safety interests of communities, and not compromise on our
mandate to consider such interests.
Island Grove.
Island Grove will be responsible for MYAT participation. Island Grove will share its
expertise regarding substance misuse issues at bi-monthly child protection team meetings
and collaborate with other groups to provide training on substance misuse issues. The
first year of this MOU Island Grove will be in the planning process and will actively
participate in the second year.
J. Human Services.
Human Services will be responsible for MYAT and TIGHT participation. The first year
of this MOU Human Services will be in the planning process and will actively participate
in the second year. Human Services offers involvement in the learning lab and
employment training for youth.
K. District Attorney.
The District Attorney's Office is collaborating with the community to develop a Juvenile
Assessment Center. The District Attorney's Office is also committed to developing a
Juvenile Diversion program. These collaborative efforts will be operational on January 1,
2006. The District Attorney's Office, in collaboration with other participants in this
MOU and the community, will provide services to achieve the processes and goals listed
in sections V and VI.
IV. Oversight Group. The Parties agree that there is hereby created an Interagency
Oversight Group, "lOG", whose membership shall be comprised of a local representative of each
Party to this MOU, each such Party having voting member status.

A. Membership requirements are:
1. Designate a policy and decision-making representative or designee; and
2. Attend and actively participate in regularly scheduled meetings; and
3. Assume personal responsibility in oversight of the project by reading reports,
making recommendations and managing conflict in a professional problem-
solving manner; and
4. Assume solution focused responsibility for oversight of the financial status of the
project; and
5. Participating in both short and long-term planning, goal setting; and
6. Provide input and recommendations; and
7. Assume personal responsibility to help assure the project remains mission-driven.
B. The members of the IOG will elect officers to serve the Weld County Interagency
Oversight Group, one Chair,one Vice-Chair, a Treasurer, and one Secretary.
C. Procedures for resolving disputes by a majority of vote of those members authorized to
vote are:
1. The dispute must be submitted in writing to the Chair.
2. The Chair will attempt to resolve the conflict by facilitating discussion and
seeking solution through consensus agreement.
3. If consensus agreement is not achieved the membership will vote on the issue
and recommendations will be made to the executive director or department head
of each participating agency.
4. The executive director or department head of each party will have final authority
concerning personnel and fiscal matters related to their contribution and
participation on the project.
D. The IOG will be organized with a voting membership of fourteen (14) members.

Other voting members may be included in the IOG membership by a majority vote.
E. The IOG will establish their meeting schedule. Notice of meeting by posting will be
accomplished by an agenda.

F. In the event that the IOG identifies a need for a subcommittee group, the following
process shall be followed for creation of such committee:
1. IOG members will be asked to voluntarily participate on sub-committees.
2. Nonvoting members from other community representatives will be included in
the IOG for purposes of input, evaluation, and recommendations to the IOG.
V. Collaborative Management Processes. The IOG shall establish a collaborative
management process to be utilized by individualized service and support teams described below.
The collaborative management process shall address risk-sharing,resource pooling,performance
expectations, outcome-monitoring, and staff training in order to do the following:
A. Reduce duplication and fragmentation of services provided to Recipients;
B. Increase the quality, appropriateness, and effectiveness of services provided to
Recipients;
C. Encourage cost sharing among Service Providers; and
D. Ultimately, achieve better outcomes and, when possible, cost reduction for the provided
to Recipients who would benefit from integrated multi-agency services.
The implementation plan for the collaboration process will include meeting with parties by July
15, 2005 and having an initial plan developed by August 15, 2005.
VI. Planning Goal. The IOG will continue to actively participate in a year-long planning
process, which will be conducted by a Facilitator,paid by Social Services. The IOG's planning
goal is to: "intervene successfully with families before they enter the judicial system through
child welfare and juvenile justice systems; and upon their entry into the child welfare and juvenile
justice systems, to expedite the positive resolution of their treatment or case plans." The IOG will
continue to address this planning goal, at a minimum,by:
A. Exploring a balanced continuum of care including assessment and levels of care;
B. Exploring case management protocols to improve family services;
C. Defining roles and responsibilities of all paraprofessionals and professionals involved in
dependency & neglect and delinquency cases;
D. Developing a flow chart or training curriculum for use by all paraprofessionals and
professionals regarding the progression of a child or family through the court process and
the laws associated with the progression;
E. Developing evidence-based practice guidelines;
F. Developing a formal structure of the IOG by June 30,2006; and
G. Identifying the primary data collection sources to document and validate evidence-based
practice.
Other populations may be added to Section II as developed and defined by the IOG under the
planning goal.
VII. Individualized Service and Support Teams. The IOG is authorized to create
individualized service and support teams, (hereinafter"ISST") to develop a service and support
plan and provide services to Recipients. The IOG will authorize the executive members of
MYAT to be the ISST for MYAT. As the planning process progresses, the IOG will authorize

individuals fro m the different party agencies to act as the ISST for the various programs
developed and determine the population to be served by particular programs.
VIII. Authorization to Contribute Resources and Funding. Each Party to this MOU
represents that it has the authority to approve the contribution of time,resources, and funding to
solve problems identified by the IOG in order to create a seamless, collaborative system of
services to Recipients. The resources and funding to be contributed are identified on page 3,
Section III.
IX. Reinvestment of Moneys Saved. The IOG will create a procedure, subject to the
approval of the head or director of each Party agency,to allow any moneys resulting from
waivers granted by the federal government and any state general fund savings realized as a result
of the implementation of services provided to Recipients pursuant to this MOU to be reinvested
by the Parties of this agreement in order to provide appropriate services to Recipients.
Savings as a result of the efficacy performance of MYAT, TIGHT Program, and MST will be
reinvested according to its performance in the maintenance or continued expansion of these
programs and as direct services to the youth and families participating in these programs.
X. Performance-Based Measures. The Parties hereby determine that they will attempt to
meet performance measures specified by the Colorado Department of Human Services ("DHS")
and elements of collaborative management as defined by rule of the State Board of Human
Services ("State Board").
Upon Agreement to attempt to meet such performance measures as specified by DHS and
elements of collaborative management as defined by State Board rule, the IOG will create a
procedure, subject to the approval of the head or director of each Party agency, to allow incentive
moneys received by the DHS, and allocated pursuant to Section 24-1.9-104, C.R.S. to be
reinvested by the Parties to provide appropriate services to Recipients.
A. MYAT
1. Reduce numbers of youth residing in out of home placement with 91% of youth
participating in MYAT will continue to reside at home or in kinship care.
2. Reduce numbers of youth who penetrate the Juvenile Justice system with less
than 14%of MYAT cases will terminate due to the youth becoming involved
with juvenile justice system.
3. Increase referred families' successful participation with collaborating community
resources as follows:
a. 84% of families referred to MYAT will remained involved in
recommended community services at the time of the case termination.
b. 58% of families referred to MYAT will remained involved in
recommended services three months after case termination.
4. Increase youth participation in public education programs with 79% of youth in
MYAT will participate in public school on a regular and consistent basis.
B. TIGHT
1. Reduce numbers of youth residing in Residential Treatment Programs by
ensuring that all or 100% of youth participating in the program would qualify for
a residential treatment level of care.

2. Interventions with family will prevent out of home placement with 83.7% of
youth participating in the program from entering residential treatment of the
Division of Youth Corrections.
3. Increase successful participation with community resources by referred families
with 87.3%of families who participate in the program will successfully
participate in recommended community resources.
4. 85% of youth will earn a GED,high school equivalent diploma or will have
demonstrated a 91.7% increase in grade level.
5. Reduce criminal recidivism, through this restorative justice model, by 83.6%
after a year measured every three months.
C. MST
1. Reduce numbers of youth residing in Residential Treatment Programs.
a. 79%youth participating will be prevented from entering residential
treatment.
b. 9% or less of youth who participated in the program will re-enter the
Social Services within 12 months.
2. Reduce criminal recidivism by 64% through the reduction of criminal behaviors
resulting in arrest measured six months after participation in the program.
3. Increase successful participation with community resources by 84%of referred
families by remaining involved in recommended community services at the time
of the case termination.
4. Increase youth participation by in public education programs with 86.7% of
participating youth continuing to participate in the public school system six
months after intervention.
XI. Confidentiality Compliance. Parties agree that the Parties and IOG shall follow State
and Federal laws concerning confidentiality. Any records used or developed by the IOG or its
members or by ISST that relate to a particular person are to be kept confidential and may not be
released to any other person or agency, except as provided by law.
XII. Reports. Commencing January 1, 2007 and each January 1 thereafter, pursuant to
Section 24-1.9-103, C.R.S., the IO6 shall provide a report to the executive director or head of
each Party agency that includes:
A. The number of children and families served through the ISST and the outcomes of the
services provided;
B. A description of any reduction in duplication or fragmentation of services provided;
C. A description of any significant improvement in outcomes for children and families;
D. A description of estimated costs of implementing the collaborative management
approach;
E. A description of cost-savings or cost-shifting that may have occurred by collaboratively
management multi-agency services provided through ISST;
F. An accounting of moneys that were reinvested in additional services provided to
Recipients, due to cost savings that may have resulted or due to meeting or exceeding the
performance measures specified by DHS and elements of collaborative management
established by the rule of the State Board;
G. A description of any identified barriers to the ability of the state and county to provide
effective services to Recipients; and
H. Any other information relevant to improving the delivery of services to recipients.

XIII. Termination of MOU. The Parties acknowledge that withdrawal from this MOU of any
statutorily required Party will result in the automatic termination of this Agreement and
termination of the collaborative system of delivery of services developed hereunder. The
withdrawing Party shall assist the other Parties to achieve an orderly dissolution of the
collaborative system with as little disruption as possible in the delivery of services provided to
Recipients.
A. WithdrawaUTermination. Any Party may withdraw from this Agreement at any time
by providing 30 days written notice to all Parties.
B. For Loss of Funds. Any Party may withdraw from this Agreement, or modify the level
of its commitment of services and resources hereunder,effective immediately, in the event of loss
or reduction of resources from its funding source identified herein. Any Party withdrawing due to
loss of funds will provide notice of withdrawal, in writing within 30 days.
IX. Miscellaneous Provisions.
A. This writing constitutes the entire MOU between the parties hereto with respect to the
subject matter herein, and shall be binding upon said parties, their officers, employees,
agents and assigns and shall inure to the benefit of the respective survivors, heirs,
personal representatives, successors and assigns of said parties.
B. No portion of this MOU shall be deemed to constitute a waiver of any immunities the
parties or their officers or employees may possess, nor shall any portion of this MOU be
deemed to have created a duty of care, which did not previously exist with respect to any
person not a party to this MOU.
C. It is expressly understood and agreed that the enforcement of the terms and conditions of
this MOU, and all rights of action relating to such enforcement, shall be strictly reserved
to the undersigned parties and nothing in this MOU shall give or allow any claim or right
of action whatsoever by any other person not included in this MOU. It is the express
intention of the undersigned parties that any entity other than the undersigned parties
receiving services or benefits under this MOU shall be an incidental beneficiary only.
IN WITNESS WHEREOF,the Parties hereto,through their authorized representatives
have executed this Memorandum of Understanding effective for the dates written above.
