WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home

Section 30-28-101 (10) , CRS 1973 , as amended, and Section 2-1A. (3)
of the Weld County Subdivision Regulations.
The above and foregoing Resolution was, on motion duly made

Dear. Mr. Allison:
The Windsor Planning Commission, at their regular meeting
November 3, 1983 considered the subdivision exemption request
from C.W. Kirby and Elaine Kirby and made the following recom-
mendation to the Weld County Commissioners:
As this property is contiguous to the Town of Windsor •
corporate limits and lies within the projected growth areas of
the adopted Comprehensive Plan, this Commission recommends to
the Weld County Commissioners that Mr. Kirby thoroughly invest-
igate the possibility of Windsor providing the water and sewer
service, as this will mitigate future service problems.

Re: Revised Subdivision Exemption
SE No. 203 (Kirby)
Gentlemen:
On or about November 7, 1983, the Board of County Commissioners of
Weld County approved a Subdivision Exemption on behalf of William Kirby,
Docket No. 203. Pursuant to said Subdivision Exemption one of the parcels
which was created was a 1.647 acre parcel, the survey plat of which is attached
to this letter as Exhibit "A".
Subsequent to the approval and recording of the plat, Mr. Kirby and the
owners of the property which adjoin Mr. Kirby on the north and east have agreed
to revise the 1.647 acre parcel by reducing the size to 1.092 acres. A new mylar
survey plat of this revised parcel as well as a copy of the mylar is attached as
• Exhibit "B". Please note that the revised 1.092 acre parcel is contained wholly
within the previously approved 1.647 acre parcel and is therefore, not a major
or significant change, but is rather a minor change of a boundary line.
All attached for your review and marked as Exhibit "C", is a survey plat
copy and legal description of the revised parcel which will be on the north and
east boundary of the 1.092 acre parcel.

Gentlemen:
Attached to this letter please find an Application for a Subdivision
Exemption, check in the amount of $35.00 for your fee, survey plats, copies of
Deeds showing current ownership and existing legal descriptions of the property,
and coies of legal descriptions for new parcels being created.
Specifically, the purpose of this Subdivision Exemption is to modify
boundaries to end 60 years of confusion. There are five existing parcels of
property all varying in size, and the proposed arrangement will result in four
parcels, therefore there is a reduction of one parcel. Additionally, the four
proposed parcels total acreage is less than the existing five parcels.
The existing five parcels were created over a number of years being
created both when the property was part of the County (prior to 1971) and after
the property was annexed to the Town of Windsor. The entire properties were
recently disconnected from the Town of Windsor and are, therefore, again part
of the County, but due to certain overlapping boundary lines and the shape of
certain lots their use is impractical and illogical.
The four proposed parcels can be served either by the Town of Windsor or
the City of Greeley or North Weld County Water District as far as water service
is concerned, and at this time the parcels are currently served by the City of
Greeley.
This Subdivision Exemption should be granted as it does not result in the
creation of a new residential or permanent building site but does adjust property
lines in an intelligent and logical fashion and should therefore be granted.
