The applicants have submitted the attached e-mail dated February 7, 2005 showing that an adequate attempt has been made with the property's mineral owner/operators to obtain agreements. The applicants have also submitted the attached letter regarding the proposed signage on site. We have put a large amount of time and effort into this and have been unable to get responses back from the Mineral Owners. Please see the attached documentation of our efforts. Our Question: Can we move forward and schedule the Hearing with the County Commissioners with this much action taken to date? If so, we would not stop our efforts to get a written Agreement from the Mineral Owners; however, it is extremely damaging to our progress to be held up by the non-response of others that we cannot control. Monica suggested sending it to Jacqueline Hatch to see if it would be suitable. (ii) Monday, January 24,2005: Sent draft of proposed letter to Jacqueline. Received her response that it would be fine. (iii) Onctoinq: I have printed Fax Machine documentation for all faxes sent trying to elicit responses from the Mineral Owners. b) John S. Willey: Phone #fora "Judith Danielson" found for the last address of John Willey, 970-223-5272 (former spouse?). (i) Tuesday, January 25, 2005: Called above number and voicemail said, "Hi, you've reached Judy & Ed..." I did not leave a message as I was unsure who this was. (ii) January 25, 2005: Called Directory Assistance and asked for John Willey; none listed. Asked for any Willey at this address; none listed. Asked for Danielson, and J. Danielson is listed at this address. (iii) January 25,2005: Because a"Dane Willey" signed fpr our certified letter at this address. I called back in the evening and spoke to Judy. She said Dane is her& John Willey's son, and Dane had delivered the letter to John. She said John lives in Windsor and gave me his phone number, 970-222-3876. (iv) January 25, 2005: Called and spoke to John Willey at home phone#, 970-222- 3876. I explained the situation and he said he"sees no problems" with our planned use. I asked if I could fax him an Agreement that he could look over and sign if it looked OK to him. He said yes and gave me his work fax#, 970-229- 5365. I asked if I could call him there first, to let him know when the fax would be coming and he said that would not be necessary. In conversation, he said he would like to know who the other mineral owners are. I gave him the names over the phone and asked if Marylen Willey Lyons was related to him. He said,"Yes, she's my sister." He also said she was on vacation in Hawaii until February 11`r'. He then asked if I could send him the list of Mineral Owners. I explained we had to pay about $1000 for this list, but I would fax him the names with our Agreement letter tomorrow morning. Then 1 asked if he happened to speak to his sister while she's in Hawaii, could he please ask her to call us (gave my work 800#)or email us. so we could fax the Agreement letter to her hotel, as time was critical for us. (v) Wednesday, January 26, 2005: Faxed the Agreement letter to John Willey at his work. As a good will gesture to be helpful to him, I also sent him the list of Mineral Owners that he knew we had paid big bucks for. I reiterated our request for his help in contacting his sister. (vi) Wednesday,January 26,2005: Called John Willey at home at 8:30 PM because I had not heard from him in response to the fax I sent. He said he"was so busy today, I didn't get over to the fax area." He was happy to hear that I had sent the names of the mineral owners, as "I have some history in the area." I asked about it and he said his Grandfather owned a farm covering many of the now existing smaller land parcels. He asked if we had a well head on our property. I said no, and he described it as being somewhere close to the junction of County Road 2 and WCR 1 I told him that was just southwest of our property, across County Road 1. 1 invited him out to see what our property and Rev. 12.07.05 surrounding area looked like and he thanked me and said yes, that would be interesting. Since he hadn't wanted to give me his work number, I gave him my work phone# and asked him to call me tomorrow if he couldn't find the fax I had sent. (vii)Thursday, January 27, 2005: Did not get a phone call (or any response)from John Willey, so assumed he found the Fax I had sent the previous day. (viii) Thursday, January 27, 2005: Since we still had no response from John Willey, we spoke with our attorney, Theresa Pickner, and explained the problems we are having getting responses back from the Mineral Owners, as they do not have any motivation or reason to follow up with us in a timely matter(or even at all !) She advised us to not"bug them every day" but to be persistent. (ix) Tuesday, February 1. 2005: Since we do not have a Work Phone Number for John Willey, I sent him another Fax at his work. I did not include the original Fax info, but just had a cover letter briefly re-explaining the prior Fax and asking if he ever received it or had any questions? I asked him to please contact us and gave multiple contact options. The cover page had his name in very large. bolded letters so that anyone seeing the fax would get it to him. (x) Monday, February 7, 2005: Update—No response from John Willey in any form as yet. Could he be waiting for his sister to return? c) Marylen Willey Lyons: 970-870-6457(Tom Lyons); 970-879-3974. (i) Tuesday, January 25, 2005: Called 970-870-6457. The phone just rang and rang with no option to leave a voicemail message. (ii) Tuesday,January 25, 2005: Called 970-879-3974. This produced a ring, and then it just beeped. Unsure if Fax number because it wasn't a normal Fax ,^ screech. (iii) Tuesday,January 25. 2005: Found out from John Willey that Marylen is his sister and she will be on vacation in Hawaii until February 11, 2005. (iv) Tuesday, January 25, 2005: Asked John Willey for help in contacting Marylen prior to 2/11/05 because the timing is critical for us. (v) Wednesday, January 26, 2005: Again asked John Willey(in written form on Fax)for assistance in contacting Marylen Lyons. As a good will gesture to be helpful to him, in turn, I sent him the list of Mineral Owners that I had mentioned to him that we had paid a lot of money for. i hoped that this action would encourage him to help us contact his sister. Spoke to the person who answered the phone and explained what I was looking for and why. She said, "That would be our Royalties Department" and she transferred me to a voicemail that said, "You have reached the `Revenue Accounting Helpline' and the recorded message gave info for that and said if the caller had other issues or questions to leave a message. I left a message asking for the name and phone number of someone dealing with "Agreements between Mineral Rights Owners and Surface Owners." I asked for a call back as soon as possible. (ii) Wednesday.January 26, 2005: Have had no response, so called the main number again and explained I had not received a call back and I needed to talk to someone"live." She said, "They are only there between 2 and 4 PM" (Central Time) and"answer the phone during that time." I ask for that direct number and she gives me 800-359-1692. It is just past that time today (3PM Mountain Time) Rev. 12.07.05 and I cannot call the next day because I have a work Project Meeting at the exact same time frame. (iii) Friday, January 28,2005: Called the 800-359-1692 phone number in correct time frame and spoke to Lou Ann Johnson who answered, "Owner Relations Hotline." She said, "The 'Land Man'for that area is Bill Shackelford." She gave me a phone number for him, 800-800-1101. (iv) Friday, January 28, 2005: Called 800-800-1101 and spoke directly to Bill Shackelford. He said he is actually not the person to talk to about this. He gave me another name and number for George Peters, 832-636-7937. He said George is part of a"special group that handles minerals and permitting." (v) Friday, January 28. 2005: Called George Peters at.832-636-7937 at 2PM Colorado Time and got his voice mail. I left a detailed message about why I was calling and asked for a call back as soon as possible and gave him my cell phone number. (vi) Tuesday, February 1,2005: About 3PM, George Peters returned my call on my cell phone. I was able to answer and spoke with him about our situation and explained our proposed use for the property. He said to go ahead and fax the letter and gave me his Fax number, 832-636-5755. I asked him about how long it might take for him to look it over and approve or not? He said he would have to "pass it on to make sure everyone blesses it." He then commented that we were probably in a hurry. I explained yes, and why. He said he would do what he could. Property Entrance — no lighting is planned for installation at the entrance to our driveway. However, because the area is particularly dark, we will install some reflective materials to help clearly identify the boundaries of our driveway. Horse Barn Exterior — the barn currently has exterior lights on the south side. We will install similar flood lights on the west side, to illuminate the grooming areas. (A) Pasture — the main entrance to the pasture will be lit and used as needed. This light will be controlled by an on-demand timer so that it will shut itself off when unattended. (B) Outdoor Arena — The outdoor arena currently is partially screened on the south by a hill approximately 15 feet high. The area immediately south of the dog barn will be used for tractor and tractor implement storage. This area is currently partially screened to the south and east by a 4-6 foot berm. This berm will be capped with up to an 8 foot wall both to visually screen the equipment storage but also as an integral element of our noise abatement plan. Our SE neighbor's driveway is immediately adjacent to the south side of the dog barn. There currently exist 6 small evergreen trees growing on that berm; the wall will be installed to the north of the trees so that the trees remain visible from off of the property. This process will improve the surface to one that is water and dust resistant. If dust from the driveways becomes a problem, we will apply an approved surface treatment. Hones in pasture, and dogs in yards — horses and dogs both may wear away the natural grass cover and expose the top soil of their respective turnout areas. Our pasture management plan addresses both noxious weed control and soil improvement in the intent to maintain the grassland nature of our property. Composting and spreading our manure waste will help improve the viability of the top soil. Compost will be spread on portions of the property periodically. Regular mowing will control weeds while promoting grass growth. We also will restore irrigation to the horse pasture to also promote grass growth. We own shares of ISH ditch water that will be used for irrigation. Riding Arena — Our riding arena is filled with granite sand specifically used to resist breakdown and minimize dust. In the interim, wastes will be stored in bins provided by our waste contractor. Our waste contractor is: Waste Management — Fort Collins 500 E. Vine Drive Fort Collins, CO 80524 970-482-6319 Kennel Operation Wastes Dog Wastes Solid dog wastes will be picked up several times a day and disposed of in the waste container provided by Waste Management Corporation. The container will be kept closed to minimize odor or pest accumulation and the contents of this container will be removed from the property weekly. Cleaning Chemicals Commercial cleaners and sanitizers commonly used by kennels will be used for cleaning kennel floors and walls daily. They will be washed into the septic system, which has been sized with this use in mind. Chemicals stored on site will not exceed a 3 month supply. Feed bags, other packaging We anticipate that many of our overnight boarding clients will bring their dog's regular food with them so that we will not need to provide food for the majority of the dogs left with us. Never the less, a 40 pound bag of dog food will feed approximately 50 dogs for one day. At peak occupancy of 60 dogs overnight, with 100% not providing their own food, this will consume no more than 2 40-pound bags of dog food per day. Other packaging we anticipate will be for laundry supplies, shipping materials for retail products, etc. These wastes will be recycled when possible, and otherwise disposed of as regular trash. Revised July 24, 2005 DRAFT I)Ssk Sun Pony Ranch—Waste Management Plan Page 2 of 3 Po"Horse Operation Wastes Manure and bedding Currently our 4 horses produce between 5 and 8 cubic feet of manure and bedding waste overnight when they are in the barn. At maximum capacity of 20 horses this may reach 40 cubic feet a day. We will use hot composting to convert manure mixed with bedding(wood shavings), moldy hay, and other organic wastes into a slow release fertilizer and an excellent soil conditioner. Our compost plan involves a rotational, three-pile system. The three pile system involves two piles that are in different stages of composting, while one pile is collecting new material. Every 6 weeks the piles will be transitioned to the next stage. The transition serves both to mix and aerate the pile accelerating decomposition. At a maximum of 40 cubic feet a day for 6 weeks this makes each pile potentially 1700 cubic feet of compost, or piles approximately 15 feet x 15 feet x 8 feet tall. Since composting reduces the volume of the material by 40 to 65%, each pile will get smaller. The raw manure pile will be frequently covered with organic wastes such as hay or grass clippings to contain odors and be less attractive to insects. Once the composting process begins, the odor naturally decreases. In addition, the heat generated by the hot compost process (120° and 160°F) is inhospitable to insect eggs or larvae, preventing the spread of these pests. Application of the compost to our pastures will be accompanied by pasture harrowing, to incorporate the compost into the top soil and maximize nutrient absorption. These applications are counter effective if done while the ground is frozen or saturated, so applications will be timed during the appropriate weather conditions. During the day all horses will be turned out to our 10 acre pasture. The pasture harrowing will also break up clumps of manure in pasture so that they can be absorbed as well. Feed bags, other packaging wastes Currently we are consuming less than one bag of feed per horse per month. At peak capacity of 20 horses this volume will grow, yet we do not anticipate this waste to be a significant volume. This waste, along with all other packaging for shampoos, first aid supplies, and equipment will be disposed of in the regular trash by Waste Management Corporation to be removed from the property weekly.
