CODE ORDINANCE 2005-15
IN THE MATTER OF REPEALING AND REENACTING, WITH AMENDMENTS, CHAPTER 5
APPENDICES, OF THE WELD COUNTY CODE
BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF
WELD, STATE OF COLORADO:
WHEREAS,the Board of County Commissioners of the County of Weld, State of Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter,is vested with the authority
of administering the affairs of Weld County, Colorado, and
WHEREAS,the Board of County Commissioners, on December 28, 2000, adopted Weld
County Code Ordinance 2000-1,enacting a comprehensive Code for the County of Weld, including
the codification of all previously adopted ordinances of a general and permanent nature enacted on
or before said date of adoption, and
WHEREAS,the Weld County Code is in need of revision and clarification with regard to
procedures, terms, and requirements therein.
NOW, THEREFORE, BE IT ORDAINED by the Board of County Commissioners of the
County of Weld, State of Colorado,that certain existing Appendices of the Weld County Code be,
and hereby are, repealed and re-enacted, with amendments, and the various Appendices are
revised as follows, with all fees to be effective January 1, 2006.

BE IT FURTHER ORDAINED by the Board that the Clerk to the Board be, and hereby is,
directed to arrange for Colorado Code Publishing to supplement the Weld County Code with the
amendments contained herein, to coincide with chapters, articles, divisions, sections, and sub-
sections as they currently exist within said Code; and to resolve any inconsistencies regarding
capitalization,grammar, and numbering or placement of chapters,articles,divisions,sections,and
sub-sections in said Code.
BE IT FURTHERORDAINEDbythe Board if any section,subsection,paragraph,sentence,
clause, or phrase of this Ordinance is for any reason held or decided to be unconstitutional, such
decision shall not affect the validity of the remaining portions hereof. The Board of County
Commissioners hereby declares that it would have enacted this Ordinance in each and every
section, subsection, paragraph, sentence, clause, and phrase thereof irrespective of the fact that
any one or more sections, subsections, paragraphs, sentences, clauses, or phrases might be
declared to be unconstitutional or invalid.
The above and foregoing Ordinance Number 2005-15 was, on motion duly made and
seconded, adopted by the following vote on the 19th day of December, A. D., 2005.

RATES FOR CLERK TO THE BOARD
TRANSCRIPTS FROM TAPES:
IF TRANSCRIBEDIN-HOUSE: $60.00/hour for time spent on the transcription, plus$4.00 per
page. (Provides two certified copies of transcript to requestor.) Minimum charge of$60.00,
with a deposit of three times the clock time of the tape to be paid in advance, with balance
payable prior to receipt of transcript. Transcripts will be completed as staff time is available.
Fee non-refundable. No deadline will be assured.
IF TRANSCRIBED BY OTHER THAN CLERK TO BOARD STAFF: Actual cost of services
performed, including postage and delivery charges,with one paper copy of transcript and one
copy on diskette provided for County. Minimum charge of$60.00,with a deposit of estimated
costs figured at$4.00 per page and 45 pages per hour, plus$20.00 for postage and handling.
COPIES OF TAPES/USE OF RECORDING EQUIPMENT:
$60.00 machine set-up fee plus$10.00/hour for use of equipment and$20.00/hour for clerk's
salary, pro-rated to half-hour segments, based on estimated time of hearing; and $5.00 per
tape. Estimated cost to be paid in advance. No unsupervised use of equipment will be allowed.
Copies of tapes will be completed as staff time is available. No deadlines will be assured.

Inter-Governmental Agreements will specify"GIS-usable"data exchange with entities,e.g., DXF files
of subdivisions, annexations and boundaries from municipalities, GPS survey points and section
corners from municipalities and other government agencies.
Contracts with surveyors will specify what contribution of data and/or time will be made by the
surveyor in exchange for fee waivers.The GIS Department will review all contributions proposed by
surveyors in order to assess the quality and/or suitability of the proposed contributions and to
determine if those contributions would substantially improve the quality or content of Weld County's
GIS. If they do not, no fees for digital data will be waived.

REQUIRED BID AMOUNT
Pursuant to Article XIV, Section 14-9, Section 5 of the
Weld County Home Rule Charter,
written, sealed bids and a ten-day period
for consideration and investigation of the bids is required
for purchases in excess of an amount set annually
by the Board of County Commissioners by Ordinance.
Through repeal and re-enactment of this Appendix,
the amount set for the year 2006 is $10,000.00.
