I am responding on behalf of Commissioner Masden. Please be advised that we just received a Use by Special
Review(USR)application from Mr. Loya. Commissioner Masden is not at liberty to discuss any pending case
outside of the public hearing forum. I will attempt to answer any and all questions that you might have.
The Violation Hearing case was indeed continued to August 3, 2005 @ 9:00 a.m. (915 10th St). The purpose of
that hearing will be to determine if the case should be referred to the County Attorney's Office for legal action or
not. It is my understanding that Mr. Loya is no longer operating and will not hold any other events until (and if) his
Use by Special Review application is approved and recorded. If no additional events occur, the Violation Hearing
will more than likely be cancelled pending the USR outcome.
As far as legal advise, we are unable to advise you (your neighborhood)what is in your best interest. Any
property (within 500 feet) bordering this parcel will be automatically notified of the hearing. Should you have any
additional questions, please feel free to contact me either by e-mail, phone or if you wish to schedule an
appointment, I would be more than happy to sit down with you. Thank-you.

Commissioner Masden,
I met you at the last hearing regarding the horse-racing that was taking place north of our property in southern
Weld County. When will there be a hearing regarding permit/code revisions for this subject? Isn't there a hearing
coming up this week about whether or not the County should pursue legal action against the gentleman who was
operating the horse races without a permit? The more people I talk with about this issue, the more people are not
happy about the possibility of a horse track in our area.
What is the best way to proceed on this end with the Board? Do we get other neighbors to testify/speak; do we
get a petition going, do we hire an attorney?
Also, it seems that Commissioner Geile has a personal relationship with the potential applicant. Is that a conflict
of interest? I was just wondering if Commissioners can or will recuse themselves from proceedings when there is
a conflict such as this appears to be. It really bothered me at the meeting that Commissioner Geile appeared to
be bringing his personal relationship with the gentleman ( I believe his name was Mr. Loya) into the picture and
that the legal issues were being downplayed or swept to the side due to that personal relationship. I don't want to
seem petty, but my thought was "here is politics at its worst." I must admit I was rather disappointed. I don't wish
the gentleman (Mr. Loya) harm, but I certainly want the process to be unbiased as it would be with anyone else in
that position.
Anyway, thank you for speaking with me after the meeting and please let me know what the normal course of
action is - if it is not a conflict for you to do so. We want to make sure that whatever action we take is one that is

in line with the general rules of the hearings.
This potential racetrack is obviously a huge concern to those of us in this area. I heard also today from a
knowledgeable source that there is also cock-fighting going on in this area of Weld County. It amazes me how
people think they can break the law out in the country because no one will care. We obviously do care! Thank
you in advance for your response and any help you can give in pointing us in the right direction so that we can be

The Department of Planning Services requests the following changes to the existing staff
comments.
The applicants for USR-1522 Alberto Loya c/o Todd Hodges Design have submitted a revised
plat illustrating the proposed landscaping and lighting on site.
Page 4 remove items 1. B and 1.C requiring a landscaping and lighting plan be submitted.
A. The applicant shall provide the Department of Planning Services with a
Landscape/Screening Plan for review. (Department of Planning Services)
B. Tho applicant shall provide a Lighting Plan. Should exterior lighting be a part of
this facility,- all light standards shall be delineated on the plat and be in
accordance with Section 23 3 250.6.6 of the Weld County Code. (Department of

The applicant shall complete all proposed improvement including those regarding
landscaping, screening, access improvements and parking lot requirements or enter into
an Improvements Agreement according to policy regarding collateral for improvements

Dear Weld County Planning Commissioners:
Kerr-McGee Rocky Mountain Corporation ("ICMRMC") is the owner of valid oil and gas
leases underlying all or part of the Alberto Loya Rodeo Development, for which Alberto Loya, is
seeking a site specific plan and special review permit approval. KMRMC and Alberto Loya
have been negotiating a Surface Use Agreement, the terms of which will govern the parties'
simultaneous use of the subject property. KMRMC does not object to the site specific plan
approval for which Alberto Loya is applying. However, the parties have not yet concluded an
agreement, and KMRMC therefore requests that the Weld County Planning Commission
withhold plat approval of this site specific application until the parties execute and record a
surface use agreement.

I am concerned with the up coming hearing on Case Number:USR-1522. The property of Alberto Loya
at S2 SFA Section 30,T3N,R65W of the 6d'P.M., Weld County,Colorado. This property is directly south
of my property. Since my property is adjacent to Alberto Loya's property my concerns are great to the
proposed land use changes. My husband and I purchased this land because it was in a ranching area. I do
not wish to see the ranch land around me go commercial. Some of the reasons for this are as follows:
I. This past year there was a racetrack put in without a hearing even though there was public betting.
2. The racing was reckless and dangerous to both horse and rider.
3. At one point a horse broke through our 4-strand barbed wire fence and proceeded to race loose on my
property. People on a 4 wheeler then chased same animal on my property without my consent.At
which point 3 more of my fences were damaged.
4. The property directly west of Loya's was also damaged by 4-wheeler use.
5. The races also brought in a large volume of traffic that would at times end up on my property looking
for the races.
6. Trashcans were not dumped and would blow over allowing the contents to blow onto other peoples
property. Creating an unsightly mess as well as a health hazard.
These are just a few of the problems we had with the Loya's having just a couple of races. I have show
horses that could not be easily replaced if an out of control animal comes in and destroys my fencing. I
have a young daughter and I don't want to have to tell her she can't ride on weekends do to the dangers
posed by negligent neighbors. In the past the Mr. Loya has not shown us that the property will be managed
in a safe and responsible manner. I see no reason to believe that this will change with the addition of a
larger complex. I wish to submit at this time that my husband and I are very opposed to the land being
changed from A(Agricultural)Zone to Commercial. We feel very strongly that this will have a very
negative impact on the quality of this area.

I am forwarding this correspondence pursuant to being approached by the
opponents and proponents of the aforementioned Referral seeking an endorsement.
To start, I will preface my comment by recognizing that the Referral is located
outside the Town's generally accepted three (3) mile urban growth area and the
Planning Department's referral radius criteria. However, I feel that it may have an impact
on the town of Platteville.
The applicant, Alberto Loya, operates the El Vergel Nightclub in the town of
Platteville. In researching the last three (3) renewal applications for El Vergel's Tavern
Liquor License, the Platteville Local Liquor Licensing Authority voted to approve all
renewals upon presentation of the appropriate background checks.

Indoor vs. outdoor arenas
Noise report/abatement
- Applicant: "Loud noises such as radios and other music is not
appropriate to this site as the music often scares the horses. Any music
played prior and after the event will be kept to a minimum level to not
disturb neighbors. Music will be played during the day but not during
an actual event."
- State law states limit is 55dB (normal conversation)
- Neighbors already have experienced extremely loud music, cheering,
announcers, etc.
- Noise report and abatement should be required

Lighting
- Requesting waiver for lighting plan
- Large number of"small" lights can compromise character of area
Times/days of events
- Unclear: "special occasions" vs. "special events"
- Every weekend? Every Wednesday?
- How many months of the year?
Traffic loads on limited access rural roads
- Turn-off into facility right at a tight corner in the road
- Danger increased by use of alcohol, even tightly controlled
- Danger increased by flooding from poor storm water management
- Even after major construction, applicant believes "storm flow
patterns . . . shall follow historical drainage patterns."
Dust abatement
- Insufficient plan (only water, only on race days)
- Platte Valley Soil Conservation District: "Valent sand soil . . has very
high potential for wind erosion . . . "
- Construction will disturb existing stabilized soil on majority of the
acreage
- Constant traffic (foot, equestrian, vehicle) and wind creates fugitive
dust
- State law says that no visible dust can escape property lines
Trash abatement
- Plan addresses on-site trash, what about trash off-site (roads, ditches,
fields)?
CLOSING:
- Plan needs far more development before approval _
- This facility is not appropriate for this area
- It is appropriate for areas such as the fair grounds

I the undersigned, do strongly disagree with the proposed zoning change (Case Number: USR-
1522)to S2 SE4 Section 30, T3N, R65W of the 6'h P.M. Weld County, Colorado. Located
adjacent to CR 39; approximately 2 miles south of CR 32. I the undersigned, do not wish to see
the land changed for an Agricultural Zone to a Commercial Zone. I the undersigned, do not feel
that the addition of Rodeos and Horse Racing on a large scale will be a good addition to our
community.
