HomeMy WebLinkAbout20051664.tiff RESOLUTION RE: GRANT MOBILE HOME PERMIT, ZPMH #2439 - RONALD AND SUE GRABRIAN WHEREAS,the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS,the Board of County Commissioners of Weld County,Colorado,on the 2nd day of May,2005,considered the request of Ronald and Sue Grabrian,6325 Weld County Road 23, Fort Lupton,Colorado 80621,for a mobile home to be used as a Temporary Accessory to the Farm,and WHEREAS, said mobile home is to be occupied in an A (Agricultural) Zone District on a parcel of land being more particularly described as follows: N1/2 SE1/4 of Section 35,Township 2 North, Range 67 West of the 6th P.M., Weld County, Colorado WHEREAS,on May 2,2005,the Board of County Commissioners continued this matter to June 6,2005,at 9:00 a.m.,to allow time for the applicant to discuss his options with the Department of Planning Services staff, and WHEREAS,on June 6, 2005, the Board of County Commissioners, having heard all of the testimony, finds that said request should be granted subject to the following conditions: 1. The applicant must obtain a building permit for a mobile home and must comply with all installation standards of Chapter 29 of the Weld County Code, applicable to mobile homes, prior to locating the mobile home on the property. 2. Prior to the occupancy of the mobile home, the mobile home shall be connected to an approved septic system and a legal water supply. 3. The mobile home shall not be occupied until such time that the applicant has complied with Conditions #1 and #2 above. 4. The applicant shall submit a statement of an Exit Plan acknowledging that the temporary permit shall cease to exist at any such time as the mobile home is used for other than the permitted use. Such statement shall include detailed plans for removal of the mobile home upon expiration of the permit, or at such time as the permit is not renewed by either the Department of Planning Services or Board of County Commissioners, the applicant will have 30 days to put the Exit Plan into place. 5. The mobile home will be occupied by persons employed at, or engaged in, the operation of the use where the mobile home is located. Said employment may be part-time;however,it shall be no less than ten(10)hours per week. Accessory farm use of the mobile home shall be established and re-validated on an annual basis as follows: evidence shall be submitted by the applicant or property owner by the first of each year for review and acceptance by the Department of Planning Services verifying that the mobile home occupant is employed at,or engaged in,the farming 2005-1664 PL1645 AZ— / 1O- ZPMH #2439 - RONALD AND SUE GRABRIAN PAGE 2 operation on the subject property for the minimum of ten (10)hours per week. The evidence shall consist of tax records, employment agreements or other documentation as determined suitable by the Department of Planning Services. Failure to submit the required documentation may result in cessation of the allowance of the mobile home for temporary accessory farm use. 6. The mobile home shall not be occupied by any persons other than those permitted through the Mobile Home Permit for a Temporary Accessory to the Farm. Failure to comply will result in revocation to the permit. 7. The mobile home will not be used as an income source by the applicant for rental to persons who are not employed upon the lot. 8. The applicant shall submit documentation to the Department of Planning Services by May 1st of each year describing the status of the accessory farm unit. This permit is temporary and shall terminate once the use ceases to exist,at which time the applicant shall have thirty (30) days to remove the mobile home from the property. 9. All temporary permits for mobile homes shall not be transferable by the applicant and/or owner to any successor;the zoning permit shall terminate automatically upon conveyance or lease of the property. The mobile home shall be removed from the property, or a new zoning permit shall be applied for and approved. 10. All proposed or existing structures will meet the minimum setback and offset requirements for the zone district in which the property is located. Pursuant to the definition of setback in the Weld County Code, the required setback is measured from the future right-of-way line. 11. Derelict manufactured(mobile)home:a manufactured(mobile)home that is partially or totally damaged by fire,earthquake,wind,or other natural causes,or is in a state of general dilapidation, deterioration, or decay resulting from improper lack of maintenance, vandalism, or infestation with vermin or rodents. Any such derelict manufactured(mobile)home shall be returned to and maintained in the condition as originally established on the site and as inspected by the Weld County Department of Building Inspection, or it shall be removed from the site. 12. Any future structures or uses on the site must obtain the appropriate zoning and building permits. 13. Effective January 1, 2003, building permits issued on the proposed lot will be required to adhere to the fee structure of the Weld County Road Impact Program. 2005-1664 PL1645 ZPMH #2439 - RONALD AND SUE GRABRIAN PAGE 3 14. All construction or improvements occurring in the floodplain, as delineated on Federal Emergency Management Agency (FEMA) FIRM Community Panel Map 080266 8064 C,dated September 28, 1982,shall comply with the Flood Hazard Overlay District requirements of Chapter 23, Article V, Division 3, of the Weld County Code. 15. Weld County Road 23 is designated on the Weld County Road Classification Plan as a collector status road, which requires 80 feet of right-of-way at full build out. There is presently 60 feet of right-of-way. This road is maintained by Weld County. 16. Should noxious weeds exist on the property, or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant to Section 15-1-10 of the Weld County Code. 17. The applicant shall maintain compliance with Section 23-4-170 of the Weld County Code at all times. NOW,THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the request of Ronald and Sue Grabrian for permission to place a mobile home to be used as a Temporary Accessory to the Farm on the above described parcel of land, which was found to be in compliance with Chapter 23, Article IV, Division 3, of the Weld County Code, be, and hereby is, granted subject to the hereinabove listed conditions. It is the opinion of the Department of Planning Services' staff that the applicant has not shown compliance with Section 23-4-170 of the Weld County Code, as follows: a. The mobile home will be occupied by persons principally employed at or principally engaged in the operation of the use where the mobile home is located. Accessory farm use of the mobile home shall be established and revalidated on an annual basis as follows: evidence shall be submitted by the applicant or property owner on the anniversary of the permit's issuance for review and acceptance by the department of planning services verifying that the mobile home occupant is principally employed at or engaged in the farming operation on the subject property. The evidence shall consist of tax records (W-2 forms), employment agreements or other documentation as determined suitable by the department of planning services. Failure to submit the required documentation may result in cessation of the allowance of the mobile home for temporary accessory farm use. The applicant currently has three existing mobile homes located on the property that were approved by the Board of County Commissioners for Temporary Accessory Farm Units. In addition, Mr. Grabrian has stated that he rents out one of the units approved by the Board as an Accessory to the Farm, ZPMH-2401, which is a direct violation to his permit. Therefore, staff concurs that there is no justification for a fourth mobile home for a Temporary Accessory Farm unit to be placed on the property as the three current units shall be utilized for their approved uses as Temporary Accessory Farm units. Mr. Grabrian has also stated he has three employees on site and such evidence has been provided for three employees only. 2005-1664 Should the Board of County Commissioners approved this request,the Department of Planning Services'staff recommends the following conditions be attached: 1. The applicant must obtain a building permit for a mobile home and must comply with all installation standards of Chapter 29 of the Weld County Code applicable to mobile homes prior to locating the mobile home on the property. 2.
