RE: GRANT REQUEST FROM WAYNE AND PATRICIA MEDLIN TO PREADVERTISE SITE
SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT #1535
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has received a request from Wayne and Patricia Medlin, 15655
Riverdale Road, Brighton, Colorado 80602, for preadvertisement of an application for a Site
Specific Development Plan and Use by Special Review Permit#1535 for a Business Permitted as
a Use by Right and/or Use by Special Review in the Commercial Zone District (office with a gross
floor area larger than 3,000 square feet, outdoor storage, and maintenance of equipment), and
WHEREAS, said property is described as Lot B of Recorded Exemption#1636; being part
of the SE1/4SE1/4 of Section 19,Township 1 North, Range 66 West of the 6th P.M.,Weld County,
Colorado, and
WHEREAS,after study and review the Board deems it advisable to grant said request, with
the hearing date to be set as January 4, 2006, at 10:00 a.m.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the request from Wayne and Patricia Medlin for preadvertisement of an
application for a Site Specific Development Plan and Use by Special Review Permit#1535 for a
Business Permitted as a Use by Right and/or Use by Special Review in the Commercial Zone
District (office with a gross floor area larger than 3,000 square feet, outdoor storage, and
maintenance of equipment) be, and hereby is, granted.
BE IT FURTHER RESOLVED by the Board that the hearing date to consider said request
be, and hereby is, set as January 4, 2006, at 10:00 a.m.

COLORADO SUBJECT: Request for Pre-advertisement
Wayne and Patricia Medlin have submitted a request that the application for Use by Special Review
Permit #1535, which will be heard by the Planning Commission on December 20, 2005, be
pre-advertised. If you wish to approve this request,a hearing before the Board on January4,2006,
2005, will allow adequate time for advertising.

SUBJECT: Wayne Meldin — Pre-Advertisement
Mr. Wayne Meldin is requesting a pre-advertisement for USR-1535. The applicant has
indicated in the attached letter dated October 26, 2005 that the reason for this request is due to
a six month contract for the property with a 1031 company. The contract was dated September
8, 2005 which would make the contract expire February 8, 2005. The Use by Special Review
application was received on October 26, 2005. The Planning Commission hearing is scheduled
for December 20, 2005. The Clerk to the Board has calculated that the earliest the Board of
County Commissioners could review this case would be January 04, 2006.
The Department of Planning Services understands the concerns of the applicant's
representative but does have concerns regarding the application being ready for an early Board
of County Commissioner hearing. Staff will be requesting items to be completed prior to
scheduling the Board of County Commissioners hearing. Some of the items known at this time
are that the applicant shall submit surface use agreements with the oil and gas mineral owners
and lessees on site along with a sign plan and a screening and landscaping plan for the
property prior to scheduling the Board of County Commissioners hearing. Therefore, the
Department of Planning Services is recommending denial of the pre-advertisement for USR-
1535.
