This will follow up on our fax of August 31, 2005 and my phone conversation with you
regarding our handling of display fireworks on Lot B of the property south of Road 18
near Keenesburg and covered by AmUSR-1416.
In accordance with the above referenced amended use, we have four magazines for
storage of 1.3 display fireworks. This property is covered under our BATF license 5-CO-
001-24-6G-00040. The U.S. Bureau of Alcohol, Tobacco and Firearms inspected the site
and recorded the GPS location for this site. All handling of display fireworks will take
place in this area.
There will be no 1.3 fireworks in any of our warehouse buildings at any time. When
customers arrive for pick up we will have them sign all paperwork in the office, then they
will drive their vehicle to the storage compound, where we will bring out their order.
They will load it onto their vehicle and depart from that point.
During the day we will work with a small amount of 1.4 fireworks. There will be no
more than 20 pounds net weight of 1.4 fireworks in the building at any one time and none
will be stored overnight.
We are enclosing a copy of our BATF license for your files. Please do not hesitate to
contact our office if you need further clarification on this issue.

The 135.18 acre property in Keenesburg was held in your and your husband's name in joint
tenancy. When a joint tenant dies, all that is necessary to clear title to real estate is to record a
certified copy of the death certificate and a Supplemental Affidavit if the name on the deed differs
from the name on the death certificate. Enclosed are certified copies of the recorded death certificate
and Supplemental Affidavit. The Keenesburg property is Parcel#130528100033,and I am enclosing
a copy of its Weld County Assessor Property Profile, which I downloaded online. Although your
husband's name appears as an owner, the Weld County Assessor's office assured me the property
is now held solely in your name as a result of the recorded death certificate and that they just hadn't
updated the website yet.

Stonebraker Equipment Staging& Storage Facility
Dear Mr. Gathman:
The subject amended Use By Special Review as submitted and as reviewed and approved by the
Weld County Planning Commission and the Weld County Board of County Commissioners on
April 5, 2005 and April 13, 2005, respectively, entailed some 38,400 square feet of building space
within three proposed buildings, sited upon a 3.58 t acre(480' x 325') parcel.
In the course of the approval proceedings, it has come to the attention of the Applicant, her
associates and representatives and the Weld County Department of Planning&Building
Inspection that fire suppression sprinkling may be required for certain spaces wherein fireworks
are temporarily placed during the staging process. At this date, it is unknown if, in fact, sprinkling
is required, and if so, how best to address the issue in terms of design, configuration and massing
of the sprinkled space. Final design may take place some time in the future, subsequent to
recording the AMUSR Plat which will show only three buildings.
On April 7, 2005, April 18, 2005, April 13, 2005 and May 10, 2005, the undersigned and yourself
discussed the situation; for example, what if the best building layout would entail four buildings --
not 3 (i.e., building a"stand-alone" structure for those functions requiring sprinkling). A separate
building might make sense in the interest of safety, as well as economics. Would a new USR
proceeding be required?
You stated that you felt as long as the layout did not create any additional space over that in the
original AMUSR, it would not represent a"substantive change". The undersigned, representing
the Applicant, serves to state that no additional space over the 38,400 square feet and 3.58 ±acre
site area would be required and subsequently I have affirmed that commitment with the Applicant.

1 have included three rough concept sketches. The purpose of this correspondence is to
document the situation should it arise in the future.
In addition, based upon our telephone conversation of May 13, 2005, it is my understanding that
Condition for Approval prior to recording the Plat No. 1, K, "The Applicant shall provide
evidence of ATF approval or provide evidence that ATF requirements are not applicable" has
been satisfied founded upon your conversation with an ATF representative on May 11, 2005.
