BOARD OF COUNTY COMMISSIONERS

The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity
with the laws of the State of Colorado at the regular place of meeting in the Weld County Centennial Center,
Greeley, Colorado, September 26, 2005, at the hour of 9:00 a.m.
ROLL CALL: The meeting was called to order by the Chair Pro-Tem and on roll call the following members
were present, constituting a quorum of the members thereof:
Commissioner William H. Jerke, Chair- EXCUSED
Commissioner M. J. Geile, Pro-Tem
Commissioner David E. Long
Commissioner Robert D. Masden
Commissioner Glenn Vaad
Also present:
County Attorney, Bruce T. Barker
Acting Clerk to the Board, Jenny VanEgdom
Director of Finance and Administration, Donald D. Warden
MINUTES: Commissioner Long moved to approve the minutes of the Board of County Commissioners
meeting of September 21, 2005, as printed. Commissioner Masden seconded the motion, and it carried
unanimously.
AMENDMENTS TO AGENDA: There were no amendments to the agenda.
PUBLIC INPUT: No public input was given.
CONSENT AGENDA: Commissioner Masden moved to approve the consent agenda as printed.
Commissioner Long seconded the motion, and it carried unanimously.
COMMISSIONER COORDINATOR REPORTS: There were no Commissioner Coordinator Reports.
WARRANTS: Donald Warden, Director of Finance and Administration, presented the following warrants
for approval by the Board:
All Funds $782,468.62
Commissioner Long moved to approve the warrants as presented by Mr.Warden. Commissioner Masden
seconded the motion, which carried unanimously.

NEW BUSINESS:
SECOND READING OF ORDINANCE#2005-9, IN THE MATTER OF REPEALING AND REENACTING,
WITH AMENDMENTS,CHAPTER 8 PUBLIC WORKS,OF THE WELD COUNTY CODE: Commissioner
Vaad moved to read by title only. The motion, which was seconded by Commissioner Masden, carried
unanimously. Bruce Barker,County Attorney,read said title into the record and stated two sections will be
added to Chapter8 regarding illegal discharges and illicit connections to the Storm Sewer System,only for
the areas within the MS4 Boundary. He stated the other changes are in regards to construction site runoff
regulations. He further stated the only change made since the first reading is in the title of Article IX, and
the title should be changed to read "Illegal Discharges and Illicit Connections to Storm Sewer System."
Commissioner Vaad moved to approve Ordinance#2005-9 on second reading with the noted modifications.
The motion, which was seconded by Commissioner Long, carried unanimously.
SECOND READING OF ORDINANCE#2005-10, IN THE MATTER OF REPEALING AND REENACTING,
WITH AMENDMENTS, CHAPTER 14 HEALTH AND ANIMALS, OF THE WELD COUNTY CODE:
Commissioner Vaad moved to read by title only. The motion,which was seconded by Commissioner Long,
carried unanimously. Mr. Barker read said title into the record and stated no changes have been made to
the Ordinance since first reading. He stated the amendments regard rules and regulations concerning
methamphetamine laboratory cleanup. Commissioner Long moved to approve Ordinance#2005-10 on
second reading. The motion, which was seconded by Commissioner Vaad, carried unanimously.
SECOND READING OFORDINANCE#2005-11,IN THE MATTER OF REPEALING AND REENACTING,
WITH AMENDMENTS,CHAPTER 2ADMINISTRATION,AND CHAPTER 3 PERSONNEL,OF THE WELD
COUNTY CODE: Commissioner Vaad moved to read by title only. The motion, which was seconded by
Commissioner Long, carried unanimously. Mr. Barker read said title into the record and stated the
Ordinance needs to be continued, as more changes are proposed to be discussed in a work session.
Responding to Chair Pro-Tem Geile, Mr. Barker suggested continuing the matter to October 24, 2005, at
9:00 a.m. Commissioner Vaad moved to continue said matter to October 24, 2005, at 9:00 a.m. The
motion, which was seconded by Commissioner Masden, carried unanimously.
SECOND READING OF ORDINANCE#2005-12, IN THE MATTER OF REPEALING AND REENACTING,
WITH AMENDMENTS,CHAPTER 5 REVENUE AND FINANCE,AND CHAPTER 6 LAW ENFORCEMENT,
OF THE WELD COUNTY CODE: Commissioner Long moved to read by title only. The motion,which was
seconded by Commissioner Masden, carried unanimously. Mr. Barker read said title into the record and
stated a change is needed regarding the model traffic code. He stated the change will allow any offender
who can prove he or she was wearing a seatbelt at the time of infraction to receive a$5.00 reduction in fine
or penalty assessment. He further stated the other changes needed are in regard to Appendix 6A, and on
pages 12 and 13, under section reference 1101, school zones need to be added in conjunction with
construction zones. Commissioner Vaad moved to approve Ordinance#2005-12 on second reading with
the noted modifications. The motion,which was seconded by Commissioner Masden,carried unanimously.
RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the
consent agenda. Ordinances#2005-9, #2005-10, and #2005-12 were approved on second reading.
Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted by
the Acting Clerk to the Board.
