RE: APPROVAL OF RECORDED EXEMPTION NO. 697 - STANLEY FURROW
WHEREAS , the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS , the Board of County Commissioners, pursuant to its
authority under Section 30-28-101 (10) (d) , CRS , as amended, did
determine at a public meeting held in the Chambers of the Board,
that a certain parcel of land, to be divided into two parcels,
as shown on the plat known as Recorded Exemption No. 697 , does
not come within the purview of the definition of the terms,
"subdivision" and "subdivided land" , and
WHEREAS , the request for Recorded Exemption No. 697 was
submitted by Stanley Furrow for property being located in Part
of the S', Section 18 , Township 6 North, Range 64 West of the
6th P.M. , Weld County, Colorado, being more particularly de-
scribed in the plat which shall be provided by the applicant
and known as Exhibit "A" , said plat to be recorded, and
WHEREAS , this request is to divide the property into par-
cels of 10 acres and 115 acres, more or less.
NOW, THEREFORE , BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, that the hereinabove de-
scribed parcel of land be, and hereby is, exempt from the defi-
nition of the terms , "subdivision" and "subdivided land" .
BE IT FURTHER RESOLVED by the Board that this approval is
subject to the following conditions: 1) the applicant shall sub-
mit a mylar plat to the Department of Planning Services to be
recorded in the office of the Weld County Clerk and Recorder.
The plat shall be drawn in accordance with the requirements of
Section 9-2C. (4) of the Weld County Subdivision Regulations .
The plat shall be submitted within ninety days from the date of
approval by the Board of County Commissioners; 2) a Flood Hazard
Development permit shall be approved, in accordance with Section
53 of the Weld County Zoning Ordinance, before construction or
substantial improvement of any structure shall commence in the
100 year flood plain; 3) prior to issuance of a residential build-
ing permit to Lot A, the applicant shall submit evidence of legal
access to State Highway 392 or Weld County Road 49; and 4) an
additional 10 foot of right-of-way shall be reserved across the
southern property lines of Lots A and B as requested by the
Division of Highways. The total right-of-way shall be 40 feet
north of the centerline of State Highway 392 . The additional 10
foot reservation shall be noted on the plat prior to recording
said plat.

Re: Recorded Exemption #RE 697
Dear Commissioners:
The attached application, plat and related items are in reference to a request
from Stanley Furrow for a recorded exemption. The parcel of land on which
this request is being made is described as Pt. Sk Section 18, T6N, R64W of the
6th P.M. , Weld County, Colorado.
The property is located 21 miles south of the Community of Galeton on State
Highway 392. The property contains approximately 125 acres of Class VIw, IIw,
I irrigated soil. The parcel of land under consideration is the total
contiguous land holdings of the applicant.
The request is to divide the property into parcels of 10 acres and 115 acres,
more or less. Mr. Furrow would like to separate a 10 acre parcel of range
land for a future sale and retain the 115 acre parcel for a personal residence
and agricultural production.
Based upon the submitted information and policies of the County, the
Department of Planning Services staff recommends the request be approved for
the following reasons:
1. The request complies with Section 9-2C. of the Weld County
Subdivision Regulations submission requirements; and
2. The request complies with Section 9-2E. of the Subdivision
Regulations as follows:
The 125 acres, more or less, under consideration will
allow uses which are consistent with the intent clause of
the agricultural zone district. The uses will be
compatible with existing surrounding uses.

- The proposal is in compliance with Section 1-3 of the Weld
County Subdivision Regulations and the proposed land
division complies with the Weld County Comprehensive Plan.
Therefore, the proposed use is consistent with efficient
and orderly development.
- The proposed lots meet minimum lot size requirements for
land division.
- North Weld County Water District has indicated adequate
water service is available for this proposal.
- The proposed lots are not part of a recorded exemption
within the last five (5) years.
- The two lots proposed will have adequate access from State
Highway 392 and Weld County Road 49.
The Department of Planning Services staff recommendation for approval is
conditional upon the following:
1. The applicant shall submit a mylar plat to the Department of Planning
Services to be recorded in the office of the Weld County Clerk and
Recorder. The plat shall be drawn in accordance with the requirements of
Section 9-2C. (4) of the Weld County Subdivision Regulations. The plat
shall be submitted within ninety (90) days from the date of approval by
the Board of County Commissioners.
2. A Flood Hazard Development permit shall be approved, in accordance with
Section 53 of the Weld County Zoning Ordinance, before construction or
substantial improvement of any structure shall commence in the 100 year
flood plan.
3. Prior to issuance of a residential building permit to lot A, the
applicant shall submit evidence of legal access to State Highway 392 or
WCR 49.
4. An additional 10 foot of right-of-way shall be reserved across the
southern property lines of lots A and B as requested by the Divison of
Highways. The total right-of-way shall be 40 feet north of the
centerline of State Highway 392. The additional 10 foot reservation
shall be noted on the plat prior to recording said plat.

Dear Mr. Allison:
We have reviewed the Stanley Furrow exemption request and ask for your con-
sideration of the following comments.
1 . Projected traffic on this portion of State Highway 392 indicates the need
for an 80-foot minimum total right of way, 40 feet each side of the highway
centerline. Since the existing width is 30 feet north of the centerline,
an additional ten feet should be provided by reservation or, preferably,
dedication as permitted by local regulations.
2. This portion of S.H. 392 is designated as a Category Three highway for
the purpose of access control . Direct access to the highway shall be
permitted only when there is no other reasonable access to the general
street system, or if the denial of direct access to the State highway
and alternative access to County Road 49 would be more detrimental to
the general street system.
This exemption request proposes the creation of a lot, Lot "A," which
would desire direct access to S.H. 392. This 125.01-acre total property
ownership has alternative access to Weld County Road 49 and no existing
access to the State highway.
To be consistent with the intent of a Category Three highway, access to
Lot "A" should be obtained from County Road 49 rather than directly to
S.H. 392. This could be accomplished by means of an access easement to
the proposed lot from the County road, or by moving the lot so that it
would have frontage on the County road.

Applicant for the proposed recorded exemption is Stanley Furrow. The appli-
cant's address is Route 1, Box 187, Greeley, Weld County, Colorado, 80631.
(phone 352-5246). The applicant's residence is Lot "B" of the proposed recorded
exemption.
The total acreage is 125.01 acres, and the applicant seeks to divide it into a
10.0 acre parcel (Lot "A") and a 115.01 acre parcel (Lot "B") . Domestic water
(North Weld County Water District) is available for both parcels. Lot "B" has a
septic system and a septic system is proposed for Lot "A".
Applicant desires to split off and sell a parcel of non-productive farm area to
provide retirement income. The applicant will retain the 115.01 acre parcel for
his own use as a residence and grazing land for his cattle. A small portion of
the 10.0 acre parcel is within the 100 year flood plain as defined by the FIRM.
The proposed usage is consistent with the Weld County Comprehensive Plan in that
no prime agricultural land will be removed from production. Applicant feels
that the proposal is consistent with the intended uses of the District in which
the parcel is located and that the proposed use is consistent with the agricul-
tural nature of the District.
