RE: APPROVAL OF RECORDED EXEMPTION NO. 625 - SPENCER FEEDLOTS ,
INC.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County Com-
missioners at a public meeting held in the Chambers of the Board,
that the division into two parcels of land, as shown on the plat
known as Recorded Exemption No. 625, being the property of Spencer
Feedlots, Inc. , described as part of the South 1, Section 21,
Township 7 North, Range 65 West of the 6th P.M. , Weld County,
Colorado, being more particularly described in the plat which
shall be provided by the applicant and known as Exhibit "A" , said
plat to be recorded, does not come within the purview of the
definition of the terms, "subdivision" and "subdivided land" ,
pursuant to its authority under Section 30-28-101 (10) (d) , CRS
1973, as amended.
NOW, THEREFORE BE IT RESOLVED by the Board of County Com-
missioners that the hereinabove described parcel of land owned
by Spencer Feedlots, Inc. be, and hereby is, exempt from the
definition of the terms, "subdivision" and "subdivided land" .
BE IT FURTHER RESOLVED by the Board that this approval is
conditional upon the applicant submitting a mylar plat to the
Department of Planning Services Office to be recorded in the
office of the Clerk and Recorder. The plat shall be drawn in
accordance with the requirements of Section 9-2 C. (4) of the
Weld County Subdivision Regulations. The plat shall be sub-
mitted with ninety (90) days from the date of approval by the
Board.

Re: Recorded Exemption #625
Dear Commissioners:
The attached application, plat and related items are in reference to a
request from Spencer Feedlots, Inc. for a recorded exemption. The parcel
of land on which this request is being made is described as Part of the
South 1/2, Section 21, Township 7 North, Range 65 West of the 6th P.M. ,
Weld County, Colorado.
The property is located approximately 3 miles Northeast of Eaton on
Weld County Road 78. The property contains approximately 219.5 acres of
Class I(prime) , Ile (prime) , IIs(prime) , IVs, VIw irrigated and IVe non-
irrigated soils.
The request is to divide the property into parcels of 213.53 acres and 5.97 acres,
more or less. It is the intent of the applicant to split off a 5.97 acre par-
cel which has an agricultural warehouse.
Based upon the submitted information and policies of the County, the Depart-
ment of Planning Services staff recommends the request be approved for the
following reasons:
1. The request complies with Section 9-2 C. of the Weld
County Subdivision Regulations submission requirements.
2. The request complies with Section 9-2 E. of the Sub-
division Regulations as follows:

The 219.5 acres, more or less, under consideration will
allow uses which are consistent with the intent clause
of the Agricultural Zone District. The uses will be
compatible with existing surrounding uses.
The proposal is in compliance with Section 1-3 of the
Weld County Subdivision Regulations and the proposed
land division complies with the Weld County Comprehensive
Plan; therefore, the proposed use is consistent with
efficient and orderly development.
The proposal does not exist in an overlay district area.
The proposed lots meet minimum lot size requirements for
land division.
The Colorado Division of Water Resources has indicated
adequate water service is available for this proposal.
The proposed lots are not part of a recorded exemption
within the last five years.
The two lots proposed will have adequate access from
Weld County Road 78.
The Weld County Health Department has indicated, in a
letter dated June 22, 1983 that both lots will have
adequate sewage capacity.
The Department of Planning Services staff recommendation for approval is con-
ditional upon the applicant submitting a mylar plat to the Department of
Planning Services' office to be recorded in the office of the Clerk and Re-
corder. The plat shall be drawn in accordance with the requirements of
Section 9-2 C. (4) of the Weld County Subdivision Regulations. The plat shall
be submitted within ninety (90) days from the date of approval by the Board.

COMMENTS:
Subject site is irrigated cropland (tilled and vegetables) , a set of improvements, former
gravel pits, and a warehouse. The 5.97 acre warehouse parcel (Lot A) is the lot
proposed for separation from the rest of the farm. Lots A and B have access to
Weld County Roads 41 and 78, both gravel. Improvements for Lot B include two houses, barn,
and five outbuildings. One of the former gravel pits has been converted to a landfill
(i.e. Colorado Landfill, Inc. ). Farming activities occupy the southwest quarter of this
Section (160 acres) . Wasteland can be found in and near the former gravel pits.

STATEMENT IN SUPPORT OF APPLICATION FOR RECORDED EXEMPTION
1 . The purpose of this request is to split off approximately 5 . 97
acres from 219 .5 acres. The 5 . 97 acres has historically been used for
first a concrete mixing facility and later an agricultural warehouse.
The 213 .53 acres has historically been used for farm land, and will
continue to be used for farm land.
2 . The proposal is consistent with the Weld County Comprehensive
Plan, since the two ( 2 ) parcels will continue to be used for agri-
cultural purposes , without any real change in their historical use.
3 . See No. 2 above.
4 . The proposed uses are compatible with the surrounding land
uses , since all surrounding land uses are agricultural .
5 . The uses permitted would be compatible with future development
of the surrounding area, since this is an agricultural area and is
designed to remain an agricultural area.
