Thank you, Kevin Lyles F,a Kevin Lyles 10671 Butte Drive Longmont, CO 80504 January 17, 2005 Jacqueline Hatch Weld County Department of Planning Services 980 10th Street Greeley, CO 80631 RE: Case Number AmPF-431 (RS-1072) I wish to submit this letter of protest regarding the proposed amendment to the PUD Final Plat for Lot 1, Block 3 and the Open Space of the Western Dairymen Cooperative PUD. Upon review of the case file and examination of the property, I have the following '-"oncerns: 1)The proposed amendment reduces the preserved open space by approximately one acre, from 19 .33 acres to 18 .36 acres. 2)Additionally, the majority (approx. 84%) of the Oil & Gas Area has now been incorporated into the open space parcel. This effectively reduces the preserved open space even further, as evidenced by the large, desolate traffic area servicing these facilities. These infringements on the dedicated open space parcel are proposed by the applicant to increase development acreage and gain significantly more frontage on Highway 119 . I believe these private benefits must be balanced by some measure of value (environmental, recreational, or scenic) to the open space, which is lacking in the current application. Possible modifications to this proposal to make it more balanced with the public interest and compatible with adjacent open space management (Idaho Creek PUD) include: 1) Reconfiguration of Lot 1 to minimize loss of open space (see attached example - area bounded by green preserves approx. 19 acres) . 2) Paving access to the Oil & Gas Area to reduce vehicular traffic footprint (encroachment on open space) and eliminate dust. 3)Eliminate vehicular access to the adjacent open space parcel to the south by means of earthwork, gates, or other measures. I believe these modifications can result in meeting the applicant ' s objectives while not compromising the value of the open space parcel . Thank you for your consideration. Kevin Lyles ,r Is' ,;?
