Dear Keith:
RE: CHANGE ORDER REQUEST TO ENGINEERING FEE CONTRACT
KBN Project No. 03015-R
You had requested in an earlier project team meeting that we prepare an extra proposal to
our original engineering design contract based upon revisions to our scope of services.
We wanted to provide you with this information sooner, however, we've been waiting for
Colorado Boring to provide us with a bill that we just received today.
Our original design contract was for$23,450. Of this amount, $2,400 was intended for a
geotechnical investigation. This work was not subcontracted because the Public Works
Department determined the typical roadway section to be used with our design. This
reduces the design fee to $21,050. To date, we have billed the County$20,700.45.
We have completed the design work as outlined in our June 23, 2004 proposal and the
project was bid out February 15th.
During the final design stage of this project,we were asked to provide additional and
revised legal descriptions and exhibits(by King Surveyors), pothole existing
underground utilities, revise our drawings to reflect a change in the lane widths, striping,
etc., prepare 40 sets of design plans and specifications (along with addenda drawing
revisions) and coordinate with Earth Engineering Consultants for the construction
observation and testing services. A summary of these requested extras is shown below:
Contract Project Cost Increase
1. R.O.W./easements (King) 1,600 $2,476
a. KBN coord. & exh. for Leon - $ 734
2. Potholes— Colo. Boring (6) - $ 660
3. Revise lane widths & striping - $ 892
4. Type County's specs into computer - $ 648
4. Print plans & specs (40 sets) - $1,458
5. Const. observation&testing(ECC)
(agreement attached for review) - $5 000
TOTAL COUNTY REQUESTED EXTRAS $11,868

The County will oversee construction observation during the construction of the roadway
improvements. If we are requested to become involved,we assume we may invoice the
Public Works Department at our Standard Hourly Rates.
Finally, in the preparation of our proposal for design services, I had estimated a fee of
$2,200 to design the Winder ditch relocation/siphon improvements adjacent to the new
roadway alignment. I, unfortunately, was way off the mark. Due to the difficulties in
determining how the existing ditch worked, numerous site visits to check existing
structures, various alternative hydraulic analyses, two final designs (first option included
only one siphon with a higher road profile and corresponding earthwork volume;the
second option included two siphons with a lower road profile) we expended much more
time and resources than I had planned.
In total, we exceeded my design engineer manhour estimate by 267 hours. I would ask
that the County consider reimbursing this error in my judgment at my cost of$35.80 per
hour for my staff engineers. This would result in a fee increase request of$9,558.60.
I normally would not consider asking my client for an increase in my contract fee and
would certainly understand if you determine an increase is not warranted in this case.
If you have any questions regarding this proposal letter, please give me a call.
Sincerely,
/( ,
Michael C. Ketterling, PE
