The following comments are repetitive in nature. Our comments and requirements are as follows: COMMENTS: State Highway 257/WCR 72: This intersection is presently unsignalized. WCR 72 at the approach to State Highway 257 is under stop conditions and the traffic along State Highway 257 is free-flowing. Of all four legs, only the northbound approach provides a separate right turn lane. No other channelization is provided at the intersection. The applicant has provided a traffic impact study by Parametrix. The study has been prepared by a professional engineer licensed in the State of Colorado. .<EQUIREMENTS: The applicant should provide a traffic impact study of the intersection associated with the proposed USR use to the Colorado Department of Transportation (CDOT). CDOT has jurisdiction over all accesses to the state highways. Please contact Gloria Hice-Idler at the Greeley office to verify the access permit or for any additional requirements that may be needed to obtain or upgrade the permit. (State Highway 257/WCR 72) WCR 72 is designated on the Weld County Road Classification Plan (FHU) as a collector status gravel road, which requires an 80-foot right-of-way at full build out. There is presently a 60-foot right-of-way. The applicant indicated an additional 10-foot of Weld County right-of-way has been reserved. We recommend dedication of the additional 10 feet to accommodate adequate radiuses and any improvements that may be necessary for any intersection widening that may occur in the future at this location. Access/Parking: The applicant is identifying curb, gutter, sidewalk, and paved parking for the facility with adequate turning radiuses on to WCR 72 with a left turn slot. The on-site parking spaces shall be properly dimensioned and striped to accommodate the 101 parking spaces. There are also ADA parking spaces being identified on the plat. The circulation appears to be adequate to accommodate the facility with drop off lanes adjacent to the church building and direction arrows identifying traffic flows. Storm Water Drainage: The applicant's drainage engineer, Latitude 39 Engineering/Development, has provided a storm water drainage report stamped and signed by a professional engineer, Debbie Kula, P.E., is licensed in the State of Colorado. A building permit shall be obtained prior to the construction of any new building. 2. A plan review is required for each building for which a building permit is required. Plans shall include a floor plan. Plans shall bear the wet stamp of a Colorado registered architect or engineer. Two complete sets of plans are required when applying for each permit. Include a Code Analysis Data sheet provided by the Weld County Auilding Department with each Building permit application. 3. Buildings shall conform to the requirements of the various codes adopted at the time of permit application. Currently the following has been adopted by Weld County: 2003 International Building Code; 2003 International Mechanical Code; 2003 International Plumbing Code; 2003 International Fuel Gas Code; and the 2002 National Electrical Code and Chapter 29 of the Weld County Code. 4. The building will be classified as A-3 (Church) occupancy. Occupant load will be determined at the plan review. Occupant loads of 300 or more require additional requirements of a manual fire alarm system and an automatic fire sprinkler system. Fire resistance of walls and openings, construction requirements, maximum building height and allowable areas will be reviewed at the plan review. Setback and offset distances shall be determined by the Zoning Ordinance. 5. Building height shall be measured in accordance with the 2003 International Building Code for the purpose of determining the maximum building size and height for various uses and types of construction and to determine compliance with the Bulk Requirements from Chapter 27 of the Weld County Code. This matter was previously submitted to me for review under Case No. PK-1055, to which we responded by letter of March 22, 2004 directed to Sheri Lockman. To avoid repeating some of the concerns we had as outlined in the March 22, 2004 letter, I'm enclosing a copy, in case the files have not merged. The concerns we raised in our March 22 letter remain the same. The situation concerning providing for an operation and maintenance road as set forth in paragraph 1 of that letter has not been addressed. Additionally, relative to the discharge of stormwater into the ditch as outlined in paragraph 2 of the March 22 letter, that concern remains essentially the same. It also appears that it may have been exacerbated; as I review the drawings provided to me with your submission of December 28, 2004, it appears the detention pond may have increased significantly in size. The developer specifically needs an agreement with the Reservoir Company to discharge any water into the ditch. This needs to be reviewed by myself and our operational staff as well as the engineering aspects by our engineer, John Andrew. Any costs incurred as a result of these activities are to be borne by the applicant. Please be advised that until the legal and technical aspects of the proposal to discharge waters into the ditch have been resolved, we will not permit that to happen. We have reviewed the submission of March 8 for review of a PUD Sketch Plan for one (1) lot for the Windsor Assembly of God Church, being your case number PK-1055. Our client owns and operates what you have designated as the "Windsor Reservoir Outlet Ditch." We have two areas of comment or concern. 1. An operation and maintenance road at least 25 feet wide, measuring perpendicular from the top edge of the ditch out, needs to be maintained along the Windsor Reservoir Outlet Ditch. It appears that the property line designated on the drawing probably preserves that amount of space except for an area toward the upper right hand corner near an 8" CMP where the topographical lines appear to put the ditch bank considerably closer to the property line than 25 feet. I believe our outlet ditch at that point is zoned by virtue of prescription. A prescriptive ditch carries with it sufficient room on each side to operate and maintain the ditch. We have taken the position historically that this is a minimum of 25 feet. It would be helpful if this was shown on the drawing, if that would be appropriate. 2. It appears that there is a stormwater detention pond outlet from the small pond (0.159 ac.) in a southerly direction which appears to discharge this stormwater into the Windsor Reservoir Outlet Ditch. It is the policy of the Reservoir Company to allow no developed stormwater to be discharged into our facilities. With proper planning and design, along with considerations of ditch capacity and other controlling matters, the Reservoir Company may consider entering into a contractual agreement which would permit the developer to discharge a • controlled rate of retained stormwater into its facility. This is a matter of review and negotiation r with the Reservoir Company. Without an agreement in place, the Reservoir Company will allow no developed stormwater to be discharged into the ditch. We have no objections to the proposal, however, we do recommend that the following conditions be part of any approval: We recommend that the following requirements be incorporated into the permit as conditions that must be met prior to issuance of building permits: 1. A stormwater discharge permit may be required for a development/redevelopment/construction site where a contiguous or non- , contiguous land disturbance is greater than or equal to one acre in area. Contact the Water Quality Control Division of the Colorado Department of Public Health and Environment at www.cdphe.state.co.us/wq/PermitsUnit for more information. We recommend that the following requirements be incorporated into the permit as conditions that must be met prior to the issuance of the Certificate of Occupancy: 1. The applicant shall install an engineer designed septic system to handle the hydraulic load for a congregation of 296 people. The system design shall comply with all County and State Laws, Regulations and Policies. In the event the septic system(s) requires a design capacity of over 2,000 gallons of sewage per day the applicants shall provide evidence that all requirements of the Water Quality Control Division of the Colorado Department of Public Health and Environment (specifically Policies WQSA-6 and WQSA-8 ) have been satisfied. Evidence of compliance shall be provided to the Weld County Department of Public Health and Environment. 2. The applicant shall submit evidence of an Underground Injection Control (UIC) Class V Injection Well permit from the Environmental Protection Agency (EPA) for any large-capacity septic system (a septic system with the capacity to serve 20 or more persons per day). Alternately, the applicant can provide evidence from the EPA that they are not subject to the EPA Class V requirements. EXHIBIT We recommend that the following requirements be incorporated into the permit as development standards: 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. 4. Fugitive dust and fugitive particulate emissions shall be controlled on this site. 5. This facility shall adhere to the maximum permissible noise levels allowed in the Residential Zone as delineated in 25-12-103 C.R.S., as amended. 6. Adequate handwashing and toilet facilities shall be provided for employees and patrons of the church. 7. Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to Individual Sewage Disposal Systems. 8. The facility shall utilize the existing public water supply. ( North Weld County Water District) 9. The subject property is located within the Town's Growth Management Area (GMA) and is depicted as High Density Estate Single Family Residential on the Town's Land Use Plan map. The Windsor Comprehensive Plan states that the E-2 Estate Residential depiction provides for highly concentrated single-family residential subdivision development which utilizes public water and sewer services. Comprehensive Plan Residential Land Use Policy#9 states that, "Churches should be encouraged in residentially zoned areas in Town due to the compatible nature of residential and church uses," however, the Town also requires conditional use grant approval and site plan approval for a church use. The proposal is also located within the Town's SH 257 North Corridor Plan area which includes a higher level of site plan criteria including architectural, landscape and other requirements. The application materials indicate that the proposed site plan meets the intent of the Colorado Highway 257 North Corridor Plan and, while it does appear that the proposed church building may meet many of the requirements, the tower element is proposed to be 47'3"tall. Section P1.6 of said corridor plan states that ornamental architectural elements or appurtenances such as clock towers or cupolas shall not exceed forty feet (40') in height. Since the subject site is located within the Town's GMA boundary and is contiguous with the Town's corporate limits along the west and south property lines, the property should be annexed and develop within the Town of Windsor. In addition to the aforementioned corridor plan requirements, the Town would almost certainly have conditions regarding right-of-way dedication along SH 257 and WCR 72, storm drainage master plan improvements, sanitary sewer and water service, trail connections along the irrigation ditches and SH 257, and Windsor-Severance Fire Protection District requirements, among other conditions. Therefore, the Town of Windsor Planning Commission recommends that Weld County refer the applicant to the Town for annexation. riEXHIBIT However, in the event that Weld County processes and approves the subject application, the Planning Commission also recommends that any such approval be subject to the following conditions: 1. The applicant shall dedicate additional right-of-way along the entire length of the west property boundary to bring the east half of SH 257 up to required right-of-way standards in accordance with CDOT and the Town Engineer. 2. The applicant shall dedicate additional right-of-way along the entire length of the south property boundary to bring the north half of WCR 72 up to the Town's Rural Collector standard of sixty feet(60') from centerline(one hundred twenty feet(120') total). 3. The hydrology was done assuming that all of the developed basins have the same runoff coefficients. Two examples of this are basins C and F. Both basins are over 75 percent impervious and yet the runoff coefficients used in the calculation reflect an area with a percent impervious of approximately 12 percent. Secondly, the hydraulic calculations assume that the entire basin follows to the detention pond at the maximum time of concentration. Some of the basins do not flow into the pond and the lack of routing over estimates the time of concentration. The hydrologic and hydraulic routing calculations should be performed to accurately size the detention pond. Recommendations: Although there are no negative impacts to CDOT, the hydrology and hydraulics as it relates to the detention pond appear to be incorrect. The hydrology was done assuming that all of the developed basins have the same runoff coefficients. Two examples of this are basins C and F. Both basins are over 75 percent impervious and yet the runoff coefficients used in the calculation reflect an area with a percent impervious of approximately 12 percent. Secondly, the hydraulic calculations assume that the entire basin follows to the detention pond at the maximum time of concentration. Some of the basins do not flow into the pond and the lack of routing over estimates the time of concentration. The hydrologic and hydraulic routing calculations should be performed to accurately size the detention pond. As stated previously, this has no impact to CDOT and is only for information.
