This review is consistent with a previous review of PK-1055 on March 14, 2004. The
following comments are repetitive in nature. Please note that the requirement for two
points of access has been added as well as the minimum number of fire hydrants and fire
flows that are required from the 2003 International Fire Code.
1. There shall be a minimum of two points of access to this facility.
2. Each access shall be designed to carry a designed wheel load of 18000pounds
(80000 pound gvw) (1-I2O loading).
3. The accesses shall be constructed of a permanent all weather road base.
4. Addresses shall be posted clearly on the road fronting the property.
5. Addresses shall be posted clearly on the structure.
6. This building shall be provided with an approved Fire Sprinkler System and the
fire line shall be shown on the site utility drawings and approved by the Windsor-
Severance Fire Protection District.
7. The minimum fire flows required for this project are 3000 gpm at 20 psi and a
flow duration of three (3) hours.
8. The minimum number of fire hydrants required shall be three (3).
9. The Windsor-Severance Fire Protection District shall be afforded the opportunity
to review and approve all building drawings before a building permit is issued.

COLORADO SUBJECT: USR-1499, Windsor Assembly of God Church
The Weld County Public Works Department has reviewed this proposal; this project falls primarily under the
purview of the Use by Special Review Standards, Weld County Code, Chapter 23, Article II, Division 4, Section
23. Our comments and requirements are as follows:
COMMENTS:
State Highway 257/WCR 72: This intersection is presently unsignalized. WCR 72 at the approach to State
Highway 257 is under stop conditions and the traffic along State Highway 257 is free-flowing. Of all four legs,
only the northbound approach provides a separate right turn lane. No other channelization is provided at the
intersection.
The applicant has provided a traffic impact study by Parametrix. The study has been prepared by a
professional engineer licensed in the State of Colorado.
.<EQUIREMENTS:
The applicant should provide a traffic impact study of the intersection associated with the proposed USR use to
the Colorado Department of Transportation (CDOT).
CDOT has jurisdiction over all accesses to the state highways. Please contact Gloria Hice-Idler at the Greeley
office to verify the access permit or for any additional requirements that may be needed to obtain or upgrade
the permit. (State Highway 257/WCR 72)
WCR 72 is designated on the Weld County Road Classification Plan (FHU) as a collector status gravel road,
which requires an 80-foot right-of-way at full build out. There is presently a 60-foot right-of-way. The applicant
indicated an additional 10-foot of Weld County right-of-way has been reserved. We recommend dedication of
the additional 10 feet to accommodate adequate radiuses and any improvements that may be necessary for
any intersection widening that may occur in the future at this location.
Access/Parking: The applicant is identifying curb, gutter, sidewalk, and paved parking for the facility with
adequate turning radiuses on to WCR 72 with a left turn slot. The on-site parking spaces shall be properly
dimensioned and striped to accommodate the 101 parking spaces. There are also ADA parking spaces being
identified on the plat. The circulation appears to be adequate to accommodate the facility with drop off lanes
adjacent to the church building and direction arrows identifying traffic flows.
Storm Water Drainage: The applicant's drainage engineer, Latitude 39 Engineering/Development, has
provided a storm water drainage report stamped and signed by a professional engineer, Debbie Kula, P.E., is
licensed in the State of Colorado. Peter Schei, Weld County Drainage Engineer, reviewed the report in
"' ecember 2004.

Site Specific Development Plan and Special Review Permit for a Public and Quasi Public Building (Church) in the
A (agricultural zone district).
1. A building permit shall be obtained prior to the construction of any new building.
2. A plan review is required for each building for which a building permit is required. Plans shall include a floor
plan. Plans shall bear the wet stamp of a Colorado registered architect or engineer. Two complete sets of plans
are required when applying for each permit. Include a Code Analysis Data sheet provided by the Weld County
Auilding Department with each Building permit application.
3. Buildings shall conform to the requirements of the various codes adopted at the time of permit application.
Currently the following has been adopted by Weld County: 2003 International Building Code; 2003 International
Mechanical Code; 2003 International Plumbing Code; 2003 International Fuel Gas Code; and the 2002 National
Electrical Code and Chapter 29 of the Weld County Code.
4. The building will be classified as A-3 (Church) occupancy. Occupant load will be determined at the plan review.
Occupant loads of 300 or more require additional requirements of a manual fire alarm system and an automatic
fire sprinkler system. Contact Windsor Severance Fire Protection District for their requirements. Fire resistance
of walls and openings, construction requirements, maximum building height and allowable areas will be reviewed
at the plan review. Setback and offset distances shall be determined by the Zoning Ordinance.
5. Building height shall be measured in accordance with the 2003 International Building Code for the purpose of
determining the maximum building size and height for various uses and types of construction and to determine
compliance with the Bulk Requirements from Chapter 27 of the Weld County Code. Building height shall be
measured in accordance with Chapter 23 of the Weld County Code in order to determine compliance with offset
and setback requirements. Offset and setback requirements are measured to the farthest projection from the
building.

Dear Ms. Ogle:
I represent the Windsor Reservoir & Canal Company whose reservoir outlet generally
adjoins the subject submission along its easterly boundary.
This matter was previously submitted to me for review under Case No. PK-1055, to
which we responded by letter of March 22, 2004 directed to Sheri Lockman.
To avoid repeating some of the concerns we had as outlined in the March 22, 2004 letter,
I'm enclosing a copy, in case the files have not merged.
The concerns we raised in our March 22 letter remain the same. The situation concerning
providing for an operation and maintenance road as set forth in paragraph 1 of that letter has not
been addressed. Additionally, relative to the discharge of stormwater into the ditch as outlined in
paragraph 2 of the March 22 letter, that concern remains essentially the same. It also appears
that it may have been exacerbated; as I review the drawings provided to me with your
submission of December 28, 2004, it appears the detention pond may have increased
significantly in size.
The developer specifically needs an agreement with the Reservoir Company to discharge
any water into the ditch. This needs to be reviewed by myself and our operational staff as well
as the engineering aspects by our engineer, John Andrew. Any costs incurred as a result of these
activities are to be borne by the applicant.
Please be advised that until the legal and technical aspects of the proposal to discharge
waters into the ditch have been resolved, we will not permit that to happen.

Dear Ms. Lockman:
I represent the Windsor Reservoir & Canal Company. We have reviewed the submission
of March 8 for review of a PUD Sketch Plan for one (1) lot for the Windsor Assembly of God
Church, being your case number PK-1055. Our client owns and operates what you have
designated as the "Windsor Reservoir Outlet Ditch."
We have two areas of comment or concern.
1. An operation and maintenance road at least 25 feet wide, measuring perpendicular
from the top edge of the ditch out, needs to be maintained along the Windsor Reservoir Outlet
Ditch. It appears that the property line designated on the drawing probably preserves that
amount of space except for an area toward the upper right hand corner near an 8" CMP where the
topographical lines appear to put the ditch bank considerably closer to the property line than 25
feet. I believe our outlet ditch at that point is zoned by virtue of prescription. A prescriptive
ditch carries with it sufficient room on each side to operate and maintain the ditch. We have
taken the position historically that this is a minimum of 25 feet. It would be helpful if this was
shown on the drawing, if that would be appropriate.
2. It appears that there is a stormwater detention pond outlet from the small pond
(0.159 ac.) in a southerly direction which appears to discharge this stormwater into the Windsor
Reservoir Outlet Ditch. It is the policy of the Reservoir Company to allow no developed
stormwater to be discharged into our facilities. With proper planning and design, along with
considerations of ditch capacity and other controlling matters, the Reservoir Company may
consider entering into a contractual agreement which would permit the developer to discharge a
•
controlled rate of retained stormwater into its facility. This is a matter of review and negotiation
r with the Reservoir Company. Without an agreement in place, the Reservoir Company will allow
no developed stormwater to be discharged into the ditch.

Environmental Health Services has reviewed this proposal for a church. We have no
objections to the proposal, however, we do recommend that the following conditions be
part of any approval:
We recommend that the following requirements be incorporated into the permit as
conditions that must be met prior to issuance of building permits:
1. A stormwater discharge permit may be required for a
development/redevelopment/construction site where a contiguous or non-
, contiguous land disturbance is greater than or equal to one acre in area. Contact
the Water Quality Control Division of the Colorado Department of Public Health
and Environment at www.cdphe.state.co.us/wq/PermitsUnit for more information.
We recommend that the following requirements be incorporated into the permit as
conditions that must be met prior to the issuance of the Certificate of Occupancy:
1. The applicant shall install an engineer designed septic system to handle the
hydraulic load for a congregation of 296 people. The system design shall comply
with all County and State Laws, Regulations and Policies. In the event the septic
system(s) requires a design capacity of over 2,000 gallons of sewage per day the
applicants shall provide evidence that all requirements of the Water Quality
Control Division of the Colorado Department of Public Health and Environment
(specifically Policies WQSA-6 and WQSA-8 ) have been satisfied. Evidence of
compliance shall be provided to the Weld County Department of Public Health
and Environment.
2. The applicant shall submit evidence of an Underground Injection Control (UIC)
Class V Injection Well permit from the Environmental Protection Agency (EPA)
for any large-capacity septic system (a septic system with the capacity to serve
20 or more persons per day). Alternately, the applicant can provide evidence
from the EPA that they are not subject to the EPA Class V requirements.

We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions.
4. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
5. This facility shall adhere to the maximum permissible noise levels allowed in the
Residential Zone as delineated in 25-12-103 C.R.S., as amended.
6. Adequate handwashing and toilet facilities shall be provided for employees and
patrons of the church.
7. Any septic system located on the property must comply with all provisions of the
Weld County Code, pertaining to Individual Sewage Disposal Systems.
8. The facility shall utilize the existing public water supply. ( North Weld County
Water District)
9. Bottled water shall be utilized for drinking and hand washing during construction
of the project.
10.Adequate toilet facilities (port-a-potty) shall be provided during the construction of
the facility.
11.If applicable, the applicant shall obtain a stormwater discharge permit from the
Colorado Department of Public Health & Environment, Water Quality Control
Division.
12.The operation shall comply with all applicable rules and regulations of the State
and Federal agencies and the Weld County Code.

Subject: USR-1499 Windsor Assembly of God
Dear Mr. Ogle:
The Town of Windsor Planning Commission reviewed this referral at its regular meeting of
February 3, 2005. The subject property is located within the Town's Growth Management
Area (GMA) and is depicted as High Density Estate Single Family Residential on the
Town's Land Use Plan map. The Windsor Comprehensive Plan states that the E-2 Estate
Residential depiction provides for highly concentrated single-family residential subdivision
development which utilizes public water and sewer services. Comprehensive Plan
Residential Land Use Policy#9 states that, "Churches should be encouraged in residentially
zoned areas in Town due to the compatible nature of residential and church uses," however,
the Town also requires conditional use grant approval and site plan approval for a church
use. The proposal is also located within the Town's SH 257 North Corridor Plan area which
includes a higher level of site plan criteria including architectural, landscape and other
requirements.
The application materials indicate that the proposed site plan meets the intent of the
Colorado Highway 257 North Corridor Plan and, while it does appear that the proposed
church building may meet many of the requirements, the tower element is proposed to be
47'3"tall. Section P1.6 of said corridor plan states that ornamental architectural elements or
appurtenances such as clock towers or cupolas shall not exceed forty feet (40') in height.
Since the subject site is located within the Town's GMA boundary and is contiguous with
the Town's corporate limits along the west and south property lines, the property should be
annexed and develop within the Town of Windsor. In addition to the aforementioned
corridor plan requirements, the Town would almost certainly have conditions regarding
right-of-way dedication along SH 257 and WCR 72, storm drainage master plan
improvements, sanitary sewer and water service, trail connections along the irrigation
ditches and SH 257, and Windsor-Severance Fire Protection District requirements, among
other conditions. Therefore, the Town of Windsor Planning Commission recommends that
Weld County refer the applicant to the Town for annexation.

However, in the event that Weld County processes and approves the subject application, the
Planning Commission also recommends that any such approval be subject to the following
conditions:
1. The applicant shall dedicate additional right-of-way along the entire length of the
west property boundary to bring the east half of SH 257 up to required right-of-way
standards in accordance with CDOT and the Town Engineer.
2. The applicant shall dedicate additional right-of-way along the entire length of the
south property boundary to bring the north half of WCR 72 up to the Town's Rural
Collector standard of sixty feet(60') from centerline(one hundred twenty feet(120')
total).
3. The applicant shall be required to install all necessary improvements to SH 257 and
WCR 72.
4. The subject property lies within the Town of Windsor's Storm Drainage Master Plan
Area. The Master Plan assumes, and Windsor has adopted, an over-detention
standard for new developments within the Master Plan area. In order for this
proposed development to be compatible with the Master Plan, the Town requests
that over-detention be a requirement. The adopted over-detention standard requires
the 100-year developed discharge to be reduced to the 10-year historic discharge.
For the Windsor area, this equates to a limitation of 0.24 cfs allowable release rate
per acre of development.
5. The applicant shall dedicate trail easements (thirty feet (30') in width) along the
irrigation ditches and SH 257 for future connection to the Town of Windsor trail
system.
6. The applicant shall revise the proposed landscape plan to meet the Town's landscape
standards.
7. The applicant shall revise the proposed tower element on the church building to not
exceed a maximum of forty feet(40') in height.
8. The proposed sign shall comply with the Town of Windsor sign regulations of
Section 16-126 of the Municipal Code.
9. The applicant shall enter into an annexation agreement with the Town of Windsor
prior to recording the Use by Special Review plat. Such annexation agreement shall
require the subject property to annex to the Town at such time in the future that the
property becomes an enclave as defined by State Statute, with such annexation
agreement being recorded with the Weld County Clerk and Recorder.

This letter is written to respectfully request an amendment to the Windsor staff review for the
aforementioned Weld County land use case dated January 27,2005. In this letter, staff has
requested that nine conditions be forwarded to Weld County for inclusion into the USR
Conditions of Approval and Development Standards.
Each condition outlined in Windsor staff's report dated January 27, 2005 will be discussed below
in numerical format.
1. Additional right-of-way along the entire length of the west property boundary in
accordance with CDOT and the Town of Windsor Engineer.
Our drawings illustrate additional future right-of-way per prior review from CDOT.
2. Additional right-of-way along southern boundary with Weld County Road 72.
The requirement of 60' of right-of-way from centerline has been incorporated as
illustrated on our drawings.
3. Installation of all necessary improvements to State Highways 257 and Weld County
Road 72.
The project's traffic engineer met with Gloria Hice-Idler from CDOT and discussed
this proposal. At this point,CDOT does not require improvements.
4. Storm Drainage Master Plan Area. The condition from Windsor Staff is that the
adopted over detention standard be applied.
In development of this site,these standards were used to set aside a portion of the
property for future detention facilities. With the scale of development proposed and
budget constraints,we respectfully request this condition be removed from your
referral to Weld County.
5. Dedication of a 30' trail easement along the irrigation ditch on our eastern boundary
and State Highway 257.
We accept this condition.
6. Revision of landscape plan to meet Town Standards.

The State Highway 257 North Corridor Plan was consulted in preparing the existing
landscape plan. We appreciate the foresight of this plan and desire flexibility in
meeting the end goal. Such can be met with future plantings that will result through
donations, memorials, etc.to enhance the beauty of our site and surroundings. We
will also be happy to continue landscaping through the years as development in the
area progresses. We respectfully request this condition be removed from your
referral to Weld County.
7. Tower height. Traditionally church towers have been literally used as a call to
worship. This tower will be similar in use. The large amounts of glass in the façade
will display sculptural art,donated by the congregation over time, and lit from the
inside of the building. The intended result is a quiet call to worship.
We have looked at sketches reducing the height of the tower from 47' to 40'. While
we could save construction cost with a reduced height,we believe that the tower
looks stunted and mis-proportioned at a height of 40'.
We respectfully request this condition be removed from your referral to Weld
County.
8. Sign Regulations.
We accept this condition.
-- 9. Annexation Agreement between the Windsor Assembly of God Church and the Town
of Windsor.
We are open to working with the Town of Windsor toward an acceptable Annexation
Agreement. We respectfully request dialog start on this agreement,but not be a
condition of approval prior to recording the plat. We respectfully request that this
condition be deleted or amended.
We appreciate your thorough review of our request to accommodate our growing church home.
The necessity of going through the Weld County USR process is to accommodate our time frame
of getting a new church facility operational to house our growing congregation. We look forward
to working with the Town of Windsor in the future and being a part of the greater Windsor
community. Your thoughtful consideration of our requests is greatly appreciated.

In reviewing the new submittal dated August 5, 2005, the Exhibit A portion under the Transportation Items have
been recalculated and the estimated construction cost has been reduced. Kelly Jenkins, Public Works
Department, visited the site and provided the office with photographs. The applicant has placed silt fence,
cleared and grubbed, stripped the site and stockpiled the topsoil.
I cannot verify your street base items because you are showing it as cubic yards, which reflect cut and fill
sections usually shown in construction drawings. I am looking for the base section before you place the
asphalt. A sample would be 6 inches of base over 5 inches of asphalt or would it be a full depth section of
asphalt with no base item?
The street/parking lot paving quantity match mine, but the unit cost number appears to be low. I recommend
that the applicant provide written verification from your contractor on their letterhead that they will complete the
paving items for that amount of money.

County Public Works Department has reviewed this revised drainage report for the Windsor Assembly of God
Weld
Church. The Windsor Assembly of God Church 14 acre site is located on the northeast corner of the intersection of
State Highway 292 and WCR 72, approximately 2 miles north of the Town of Windsor. The site is constrained by
drainage ditches located along the northwest property line and the southeast property line. Proposed site improvements
include a church building and parking lot, entry reatures and driveway access to WCR 72.
This site has been approved for construction under a prior drainage plan; the applicant has submitted a new drainage plan
to address newly identified conditions at the site. The letter submitted by the applicant's engineer (Nolte Associates, Inc.
Gary Iwata, P.E.) states that the revised grading plan lowering the site by approximately 1 foot in elevation was
necessitated to balance site soil volumes. The Nolte letter states that the original design engineer's(Latitude 39)detention
pond outlet structure design erroneously releases the detained water at a rate higher than the 5-year storm historic rate as
required by Weld County Code. The Nolte letter states that all drainage improvements would be constructed as originally
designed(by Latitude 39)with the exception of a lowering of site elevations by approximately 1 foot and with a change of
the detention pond outlet structure to release at the required rate.
Comments
Drainage:
❑ Nolte's analysis and re-design of the revised detention outlet structure is an improvement over the previously
submitted and accepted design.
❑ Nolte's re-grading design does not substantially change any of the approved proposed site improvements.
❑ The proposed detention pond outlet design and regarding design are acceptable to Weld County Public Works.
❑ Weld County will not maintain drainage facilities located on private property.
❑ The area that includes the detention pond and outlet structure shall be placed in a recorded drainage easement.
❑ Final sediment control and erosion control measures (conforming to the revised drainage report)stamped, signed and
dated by a professional engineer licensed in the State of Colorado shall be installed prior to breaking ground. It is
recommended that the detention pond be constructed first to collect site runoff and sediment during construction.
❑ Applicant is requested to re-submit 3 complete sets of stamped and signed revised drainage and grading design
drawings for use by Public Works and Building Depar liiient inspectors and for the permanent project files.

I have reviewed the Final Drainage Report for the Windsor Assembly of God prepared by
Latitude 39 dated May 3, 2005. The site is below the highway grade and the flow will be
directed away from the CDOT Right of Way (ROW). The proposed project will have an
emergency access located at the northeast corner within CDOT ROW. The access will have
no negative impacts to CDOT drainage.
Recommendations:
Although there are no negative impacts to CDOT, the hydrology and hydraulics as it relates to
the detention pond appear to be incorrect. The hydrology was done assuming that all of the
developed basins have the same runoff coefficients. Two examples of this are basins C and F.
Both basins are over 75 percent impervious and yet the runoff coefficients used in the
calculation reflect an area with a percent impervious of approximately 12 percent. Secondly, the
hydraulic calculations assume that the entire basin follows to the detention pond at the
maximum time of concentration. Some of the basins do not flow into the pond and the lack of
routing over estimates the time of concentration. The hydrologic and hydraulic routing
calculations should be performed to accurately size the detention pond. As stated previously,
this has no impact to CDOT and is only for information.

Dear Gloria:
I have reviewed the Final Drainage Report for the Windsor Assembly of God prepared by
Latitude 39 dated May 3, 2005. The site is below the highway grade and the flow will be
directed away from the CDOT Right of Way (ROW). The proposed project will have an
emergency access located at the northeast corner within CDOT ROW. The access will have
no negative impacts to CDOT drainage.
Recommendations:
Although there are no negative impacts to CDOT, the hydrology and hydraulics as it relates to
the detention pond appear to be incorrect. The hydrology was done assuming that all of the
developed basins have the same runoff coefficients. Two examples of this are basins C and F.
Both basins are over 75 percent impervious and yet the runoff coefficients used in the
calculation reflect an area with a percent impervious of approximately 12 percent. Secondly, the
hydraulic calculations assume that the entire basin follows to the detention pond at the
maximum time of concentration. Some of the basins do not flow into the pond and the lack of
routing over estimates the time of concentration. The hydrologic and hydraulic routing
calculations should be performed to accurately size the detention pond. As stated previously,
this has no impact to CDOT and is only for information.
