Dear Mr. Ogle,
This letter serves the purpose of addressing Conditions of Approval and Development Standards for the Sierra
Acres PUD Change of Zone. I respectfully request these modifications be made at the December 7, 2005 Board
of County Commissioners hearing.
Condition ofApproval Item 3.0.
This Condition and eventual Plat Note states only Lots 1 and 2 meet the minimum lot size requirements for
Auxiliary Quarters. This referral note is from the Weld County Public Health and Environment referral dated
August 24, 2005. The PUD process allows flexibility. Additionally,the submitted materials requested the ability
for all lots to have Auxiliary Quarters. Therefore, we respectfully request the Plat Note be amended to read that
all lots shall have the ability for Auxiliary Quarters.
Condition ofApproval Item 3.Y
This Condition and eventual Plat Note states the oil and gas facilities shall be fenced in accordance with the Weld
County Sheriff Office's referral dated August 17, 2005. Discussion has occurred between the applicant and
operator. The operator will fence at their discretion. Therefore,this condition should be dropped as fencing these
areas are not an obligation or responsibility of the landowner.
Condition ofApproval 6E. and LA.9.
The Windsor School District has approved the attached revised entrance. The applicant has met with the
Windsor/Severance Fire Protection District and the U. S. Postal Service regarding the internal road, entrance and
mail delivery location. Evidence of School District approval is attached.
Item I.A.2. Plat Amendment and Item 6.K, at the time of Final Plat Submission
Both conditions do not apply to this application and we herein respectfully request the conditions be deleted.
Item I.A.6. Plat Amendment
Attached is a landscape detail for the entrance generated by Anthony Brigham. In this detail, groundcover and
plant material are specified. Photographs of an entrance prototype and sign detail are included. Please forward
this plan to the Board of County Commissioners for their review and approval.
The applicant has met with the Windsor/Severance Fire Protection District and the U. S. Postal Service regarding
the internal road,entrance and mail delivery location.

County prior to the Board of County Commissioner's Hearing scheduled for December 7, 2005.

RE: Sierra Acres (formerly MBM) Planned Unit Development located in unincorporated Weld County,
south of and adjacent to State Highway 392 and west of and adjacent to Weld County Road 27.
Dear Superintendent Lessman and Mr.Sullivan:
This letter serves the purpose of summarizing items discussed and solidifying a basic understanding of
conditions you will request from Weld County through the development review phases of the
aforementioned subdivision.
I would like to thank you for scheduling a meeting to discuss the aforementioned subdivision with me on
your agendas. Dave Sullivan and I had a time-efficient meeting to discuss the potential of a bus entering
the proposed subdivision and placement of a school shelter along the northern entrance. Mr. Sullivan
-indicated the school bus will not enter the subdivision except for the proposed flared entrance where the
eternal road and Weld County Road 27 meet. The bus shelter will remain just south of the entrance. As
stated in my previous letter of November 22, 2004, a bus pull-off along Weld County Road 27 is not
required as the bus will stop at the entrance within this flared area discussed previously. Additionally,
staging of vehicles along the internal road may occur during poor weather in the morning for pick-up and
in the afternoon for delivery.
The current cash-in-lieu of land dedication fee is$1,214.57 per lot. This fee is required to be paid prior to
recording the final plat through Weld County. Evidence of payment is a condition prior to recording this
plat. Our clients understand this fee may decrease or increase as time passes.
We would like to receive written confirmation that the two letters, the first dated November 22, 2004 and
this letter,have met with your approval. Please sign the bottom of this letter and return a copy to me for
our application to Weld County,or you may provide a letter of response under separate cover. We look
forward to working with you through the referral process. A goal of these early meetings is to gain your
support, incorporate your needs, and solidify our design prior to when site designs are submitted for
review to Weld County Planning Services. By doing so, your referral is positive as your input has been
