Said described parcel of land contains 0. 940 acres, more or less, and is subject to any rights-of-way or other easements as recorded by instruments of record as now existing on said described parcel of land. WHEREAS, the petitioner was present, and WHEREAS, evidence was presented in support of the granting of the Conditional Use Permit for a church facility, and WHEREAS, Section 3. 3.D. of the Weld County Zoning Resolution authorizes such a use in an Agricultural District upon approval of a Conditional Use Permit by the Board of County Commissioners, and WHEREAS, the Board of County Commissioners of Weld County, Colorado heard all of the testimony and statements of those pre- ehthAL - 800564 pLl 319 N sent, has studied the request of the petitioner and the recommenda- tions of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter, and having been fully informed, is satisfied that the request for a Conditional Use Per- mit for a church facility on the hereinabove described tract of land complies with the conditions set forth in Section 3 . 3.D. (2) of the Weld County Zoning Resolution, and WHEREAS, the Board of County Commissioners desires to delete condition #1 contained in the Conditional Use Permit, which condi- tion statesias follows: "1. The Conditional Use Permit plat being amended to show a fifteen foot (15) access easement along the east property line. An easement for access to the property south of the sub- ject property was recommended by the Weld County Engineering Department in a memorandum dated November 6, 1980. " NOW, THEREFORE, BE IT RESOLVED by the Board of. 'County Com- missioners of Weld County,_ Colorado that the application of the General Assembly and Church of the First Born for a Conditional Use Permit for a church facility on the hereinabove described tract of land be, and hereby is, granted subject to the following: 1. The Development Standards contained in the Conditional Use Permit. 2 . The Development Standards for the Conditional Use Permit and the property owner' s signature shall be placed on the Conditional Use Permit plat and the plat shall be delivered to the office of the Department of Planning Services. Mr. Otis felt this condition should be deleted because there was no justification in the meeting for the church to, have to give any easement to anyone. The permitted uses on the hereon described property shall be a church facility and all other uses permitted by right in the Agricultural Zone District of the Weld County Zoning Resolution. 2. The Conditional Use Permit area shall be maintained in such a manner so as to prevent soil erosion, fugitive dust, and the growth of noxious weeds. 3. All parking, shall be provided on-site. 4. Ali facilities shall comply with all County and State Health Standards and Regulations pertaining to air quality, water quality, noise emission, and sanitary disposal systems. 5. All accesses shall have the approval of the Weld County Engineering Department. ' All accesses shall be constructed in accordance with the recounendations and/or requirements of the Weld County Engineering Department. 6. Access to the property shall be limited to the northeast corner of the property as ,shown hereon. 7. The Conditional Use Permit shall be limited to the plans shown hereon and governed by the Development Standards stated above and all applicable Weld CountylRegulations. Any material deviations fran the plans and/or Development Standards as.shown or stated above shall require the approval of an amendment to the Conditional Use Permit by the Planning Commission and the Board of County Cannissioners before' such changes fran the plans and/or Development Standards shall be permitted. Any other changes fran the plans and/or Development Standards shall be filed in the office of the Department Of Planning Services. 8. The property, owner and/or operator of this operation shall be responsible for canplying with all of the above stated Development Standards.
