FINDINGS AND RESOLUTION RE: FINDINGS AND RESOLUTION CONCERNING APPLICATION OF EATON COUNTRY CLUB, FOR A HOTEL AND RESTAURANT LIQUOR LICENSE WITH OPTIONAL PREMISES, AND AUTHORIZATION FOR CHAIR TO SIGN - EXPIRES NOVEMBER 16, 2006 The application of Eaton Country Club, 37661 Weld County Road 39, Eaton, Colorado 80615,for a Hotel and Restaurant Liquor License with Optional Premises, came on for hearing on the 24th day of October, 2005, at 9:00 a.m., and the Board of County Commissioners of Weld County, Colorado, having heard the testimony and evidence adduced at said hearing, having considered the testimony,evidence and remonstrances filed with said Board,and having carefully weighed the same, now makes the following findings: 1. The evidence discloses that the applicant has sustained the burden of proof as to the desires of the inhabitants. 2. The applicant is of good character and reputation. 3. The applicant has proven the reasonable requirements of the neighborhood. RESOLUTION WHEREAS,the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS,the Board has considered the application of Eaton Country Club,37661 Weld County Road 39, Eaton,Colorado 80615,for a Hotel and Restaurant Liquor License with Optional Premises, for the sale of malt, vinous, and spirituous liquors, for consumption by the drink on the premises only, and WHEREAS,said applicant has paid to the County of Weld the sum of $150.00 for the hearing fee, in addition to the other required fees, and WHEREAS,due to the Findings of the Board of County Commissioners in this matter as stated herein,the Board deems it advisable to approve said application for a Hotel and Restaurant Liquor License with Optional Premises for Eaton Country Club. 2005-3116 g( /71-7-X)/ Si) LC0/37 HOTEL AND RESTAURANT LIQUOR LICENSE WITH OPTIONAL PREMISES - EATON COUNTRY CLUB PAGE 2 NOW,THEREFORE,BE IT RESOLVED by the Board of County Commissioners of Weld County,Colorado,that having examined said application,the qualifications of the applicant, and the testimony of those present at the hearing, does hereby grant License Number 2005-17 to said applicant to sell malt, vinous, and spirituous liquors for consumption by the drink on the premises only, and the Board does hereby authorize and direct the issuance of said license by the Chair of the Board of County Commissioners, attested to by the Clerk to the Board of Weld County, Colorado,which license shall be in effect until November 16,2006, providing that said place where the licensee is authorized to sell malt, vinous, and spirituous liquors for consumption by the drink on the premises only, shall be conducted in strict conformity to all of the laws of the State of Colorado and the rules and regulations relating thereto, heretofore passed by the Board of County Commissioners of Weld County,Colorado,and any violations thereof shall be cause for revocation of the license. It is intended that this policy should provide guidelines for the committee and in no way should this policy limit the scope of the Operations Committee. General Policy Statements 1. The Committee is to provide support and advice to the General Manger in regards to all operation aspects of the Club. This will include the grounds management, restaurant and bar management, and office management and when appropriate,the golf management. This will be an advisory committee, and in no sense shall be construed as part of the management team of the Club. 2. The Committee will act as a policy making board upon the recommendation by the General Manager and/or by the direction from the Board of Directors. The committee along with the G/M will propose to the Board any changes to present policies or any new policies deemed to be needed by the Board or the Committee. 3. The Committee will examine the financial statements on a monthly basis and report to the Board any particular concerns the committee may have in regards to such. The committee and the G/M from time to time may make recommendations to the Board regarding financing or budgetary items deemed necessary by the Committee. 4. The Committee will also provide direction to the Activities Committee in regard to activities not golf related. The Operations Committee will be advisory only and will act as the intennediary to the Board for proposals for various new activities in the future. 5. The Committee will provide direction to the Restaurant Committee in regards to the operation of the restaurant and bar facilities. The Operations Committee will be advisory only and will act as the intermediary to the Board for proposals regarding the restaurant and bar. The Committee will provide free flowing feedback to the General Manager regarding all aspects of the Club. Upon receiving this feedback,the G/M will take the information back to the management team to determine the importance of the information and the manner in which certain information shall be dealt with. The Committee authorizes the G/M to make all day-to-day decisions in the management of the Club,but encourages the G/M to call on the Committee, as he/she deems necessary. While there I made an on-site inspection regarding the Liquor License Application filed. The application is for a Hotel and Restaurant Liquor License with Optional Premises. It will be heard by the Board of County Commissioners as the liquor licensing authority for Weld County on October 24, 2005, at 9:00 a.m. My inspection revealed the following: 1.
